AN ORDINANCE APPROVING THE 1ST AMENDMENT
AND RESTATEMENT TO THE INTERGOVERNMENTAL
AGREEMENT BETWEEN THE CITY OF PUEBLO, A
COLORADO MUNICIPAL CORPORATION ("CITY"), AND
THE STATE OF COLORADO, ACTING BY AND THROUGH
THE COLORADO DEPARTMENT OF TRANSPORTATION
("CDOT"), PROJECT MTF M086-088 (24024) / TAP M086-
091 (24079) FOR PRAIRIE AVENUE TO MINNEQUA LAKE
TRAIL PROJECT, BUDGETING AND APPROPRIATING
FUNDS IN THE AMOUNT OF $1,022,542 FOR SAID
PROJECT AND AUTHORIZING THE MAYOR TO
EXECUTE SAME
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The 1st Amendment and Restatement to the Intergovernmental Agreement
(“IGA”) between the City of Pueblo, a Colorado Municipal Corporation, and State of
Colorado, acting by and through the Colorado Department of Transportation (CDOT),
Project: MTF M086-088 (24024)/TAP M086-091 (24079), Prairie Avenue to Minnequa
Lake Trail, a copy of which is attached, having been approved as to form by the City
Attorney, is hereby approved.
SECTION 2.
Subject to encumbrances by the Colorado State Department of Transportation,
funds from Prairie Avenue to Minnequa Lake Trail (MTF M086-088 (24024)/TAP M086-
091) in the amount of $1,022,542.00 are hereby budgeted and appropriated for the
Prairie Avenue to Minnequa Lake Trail, No. CI2115.
SECTION 3.
The Mayor is authorized to execute and deliver the IGA 1st Amendment and
Restatement in the name of the City of Pueblo and the City Clerk is directed to affix the
seal of the City thereto and attest same.
SECTION 4.
The officers of the City are authorized to perform any and all acts consistent with
this Ordinance to implement the policies and procedures described herein.
SECTION 5.
This Ordinance shall become effective on the date of final action by the Mayor
and City Council.

SUMMARY:
This Ordinance approves a 1st Amendment and Restatement of an Intergovernmental
Agreement (“IGA”) between the City of Pueblo, a Colorado Municipal Corporation
(“City”) and the State of Colorado, Colorado Department of Transportation (“CDOT”)
relating to the Prairie Avenue to Minnequa Lake Trail, and budgets and appropriates
funds totaling $1,022,542 for the Project.
PREVIOUS COUNCIL ACTION:
Ordinance 9969, final adoption by City Council on July 26, 2021, established project
CI2115, approved the Intergovernmental Agreement (IGA) between the City of Pueblo
and the Colorado Department of Transportation (CDOT), budgeted and appropriated
funds totaling $388,000 for the Prairie Avenue to Minnequa Lake Trail Project.
Resolution 14816, final approval by City Council on February 28, 2022, awarded an
Agreement for Professional Design Services to Dibble & Associates Consulting
Engineers, Inc., for engineering design services for Prairie Avenue to Minnequa Lake
Trail Project.
BACKGROUND:
This Ordinance approves the 1st Amendment and Restatement to the
Intergovernmental Agreement, originally effective on May 10, 2021, between the City
and CDOT. This amendment is due to an additional Multimodal Transportation &
Mitigation Options Funding (MMOF) grant that was awarded to the City.
The project includes the design and construction of an on-street and off-street trail
connection from Prairie Avenue and SH45, Pueblo Boulevard, to Lake Minnequa in the
City, Project M086-088 (24024) and M086-091 (24079). The project will include the
design of the entire project and will include construction of a ten-foot-wide concrete
multi-use trail, trailhead improvements and trail grade improvements. The project will
also include lighting, crosswalk improvements, on-street bike lanes, bollards and some
grading.
FINANCIAL IMPLICATIONS:
Grant funds in the amount of $388,000 were previously awarded, budgeted and
appropriated. Additional grant funds, in the amount of $1,022,542 are being budgeted
and appropriated into CI2115, Prairie Avenue to Minnequa Lake Trail.

None.
STAKEHOLDER PROCESS:
None.
ALTERNATIVES:
Currently, there are no alternatives for completing the improvements without the
funding from CDOT, the Multimodal Transportation & Mitigation Options Funding
(MMOF) grant funds.
RECOMMENDATION:
Approve the Ordinance.
