HomeMy WebLinkAbout15024* RESOLUTION NO. 15024 A RESOLUTION AWARDING A CONSTRUCTION CONTRACT IN THE AMOUNT OF $421,688.63 TO MERRIMAN LAND WORKS DBA FLAT & FANCY FOR PROJECT NO. 22-026R, ARKANSAS RIVER TRAIL PHASE 4 - REBID, SETTING FORTH $200,000 FOR CONTINGENCIES, AND AUTHORIZING THE PURCHASING AGENT TO EXECUTE SAME WHEREAS, competitive bids for Project No. 22-026R, Arkansas River Trail Phase 4 have been received and examined; and WHEREAS, the proposal of Merriman Land Works dba Flat & Fancy, was the lowest of those bids determined to be responsive, and the Committee of Awards recommends to the City Council that it authorize Project No. 22-026R, Arkansas River Trail Phase 4 to be performed; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that SECTION 1. City Council authorizes Project No. 22-026R, Arkansas River Trail Phase 4 to be performed, and the contract for said project is hereby awarded to Merriman Land Works dba Flat & Fancy in the amount of $421,688.63. SECTION 2. The Purchasing Agent is hereby authorized to execute said contract on behalf of the City of Pueblo, A Municipal Corporation, and the City Clerk shall affix the seal of the City thereto and attest the same. SECTION 3. In addition to the amount of the bid set forth, as aforementioned, an additional amount as stipulated in this section is hereby established for contingencies and additional work. Contingencies and Additional Work………$200,000.00 SECTION 4. Funds for Project 20-026R (including contingencies and additional work) shall be from Project No. PL1606, Arkansas River Trail Upgrade. SECTION 5. The officers of the City of Pueblo are authorized to perform any and all acts consistent with this Resolution to implement the policies and procedures described therein. SECTION 6. This Resolution shall become effective immediately upon passage and approval. Gradisar VIA: Marisa Stoller, City Clerk FROM: Andrew Hayes, Public Works Director SUBJECT: A RESOLUTION AWARDING A CONSTRUCTION CONTRACT IN THE AMOUNT OF $421,688.63 TO MERRIMAN LAND WORKS DBA FLAT & FANCY FOR PROJECT NO. 22-026R, ARKANSAS RIVER TRAIL PHASE 4 - REBID, SETTING FORTH $200,000 FOR CONTINGENCIES, AND AUTHORIZING THE PURCHASING AGENT TO EXECUTE SAME SUMMARY: Attached is a resolution awarding a construction contract to Merriman Land Works dba Flat & Fancy for 22-026R, Arkansas River Trail Phase 4. PREVIOUS COUNCIL ACTION: Ordinance 9010, passed and approved on July 25, 2016, established the Arkansas River Trail Upgrade and Safety Improvements Phase 4 Project, budgeted and appropriated funds in the amount of $770,618, transferred funds in the amount of $65,887 from the Conservation Trust Fund, Authorized funds in the amount of $88,237 from the Black Hills Underground Utility Fund to be expended and approved an IGA between the City of Pueblo and CDOT to receive grant funds in the amount of $616,494. Ordinance 9487, final adoption by City Council on June 24, 2019, authorized an additional $69,292 from the Black Hills Energy Underground Utility Fund. Ordinance 9480, final adoption by City Council on June 10, 2019, approved a contract between the City of Pueblo and CDOT for the maintenance and operation of the trailhead and trail improvements at SH 96 (4th Street) and Arkansas River. Ordinance 9751, final adoption by City Council on July 27, 2020, authorized an additional $28,187.20 from the Black Hills Energy Underground Utility Fund, approved an IGA between the City and CDOT and budgeted and appropriated the additional grant funds in the amount of $200,000. BACKGROUND: The Project is the fourth phase of the upgrade and reconstruction of the 25-year old section of the Arkansas River Trail northwest of Santa Fe Avenue along the southside of the Arkansas River. The Project will connect the bike/pedestrian trail to the southside th of the 4 Street Bridge, provide parking for trail users, and connect a trail access from th the nearest bike/pedestrian crossing west of the 4 Street Bridge to the Arkansas River Trail. The Resolution awards the construction contract to Merriman Land Works dba Flat & Fancy. FINANCIAL IMPLICATIONS: Funding (including contingencies) in the amount of $621,688.63 will be paid from account PL1606 Arkansas River Trail Upgrade. BOARD/COMMISSION RECOMMENDATION: None. STAKEHOLDER PROCESS: None. ALTERNATIVES: Denial of this resolution will cancel the project. RECOMMENDATION: Approval of the Resolution.
