A RESOLUTION AUTHORIZING PAYMENT IN AN AMOUNT
NOT TO EXCEED $363,537 FROM PROJECT CI2113 -
AMERICAN RESCUE PLAN ACT FOR TWO
GOVERNMENTAL SERVICES PROJECTS AS
AUTHORIZED BY SECTION 603(c)(1)(C) OF THE
AMERICAN RESCUE PLAN ACT AND U.S. TREASURY
FINAL RULE 31 CFR 35.6
WHEREAS, on March 11, 2021, President Biden signed the U.S. Senate-amended
H.R. 1319 (P.L. 117-2) known as the American Rescue Plant Act (hereinafter “ARPA”;
and
WHEREAS, on May 10, 2021, the U.S. Treasury issued the Interim Final Rule to
implement ARPA in Title 31, Part 35 of the Code of Federal Regulations (“CFR”); and
WHEREAS, on January 6, 2022, the U.S. Treasury issued, with an effective date
of April 1, 2022, the Final Rule to implement ARPA in Title 31, Part 35 of the Code of
Federal Regulations (“CFR”); and
WHEREAS, under ARPA Section 603 (c)(1)(C) and the Final Rule 31 CFR 35.6
recipients may use Coronavirus Local Fiscal Recovery (“CLFR”) Funds on governmental
services pursuant to the revenue replacement calculation; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
Payment in an amount not to exceed $363,537.00 is hereby authorized from
Project CI2113 – American Rescue plan for the following two governmental services
projects.

Total $ 363,537
SECTION 2.
The officers and staff of the City are authorized to perform any and all acts
consistent with this Resolution which are necessary or desirable to implement the
transactions described herein.
SECTION 3.
This Resolution shall become effective immediately upon final passage.

SUMMARY:
This Resolution authorizes payment not to exceed $363,537.00 from project CI2113 American
Rescue plan act for two (2) governmental services projects. This payment is authorized by section
603 (c)(1)(C) of the American Rescue Plan Act and U.S. Treasury Final Rule 31 CFR 35.6
PREVIOUS COUNCIL ACTION:
On April 11, 2022, by Resolution No. 14854, City Council authorized the expenditure of
$500,000.00 in ARPA Revenue Replacement / Government Services funds to purchase a fire
pumper truck. Under this Resolution, the allocation for the purchase of a fire pumper truck is
increased by $208,537.00 for a purchase price of $708,537.00.
BACKGROUND:
ARPA authorized a revenue replacement calculation that would allow state and local governments
to use a portion of ARPA allocation for governmental services. The City of Pueblo has calculated
its lost revenue as a result of the COVID-19 pandemic to be $10,000,000.00. This Resolution
funds two governmental services projects as follows:

The City’s Fire Chief is recommending that the City purchase a 2024 Spartan MetroStar 6-person,
4-door cab and chassis, triple combination, fire pumper from Mile-Hi Fire Apparatus, Inc., 10650
Irma Drive, Suite 17A, Northglenn, CO 80233.
The City’s Director of Parks and Recreation is recommending that the City purchase a 6-yard rear
loader, diesel-powered trash truck.
FINANCIAL IMPLICATIONS:
Funding for these projects will be paid out of Project CI2113 – American Rescue Plan.

ALTERNATIVES:
City Council could decide not to authorize payment for the two governmental service projects.
RECOMMENDATION:
Approval of this Resolution.
