AN ORDINANCE APPROVING A RENTAL AGREEMENT FOR
THE USE OF AN OFFICE SPACE AND THE FIRE FIGHTING
RELOAD BASE AT THE PUEBLO MEMORIAL AIRPORT
BETWEEN THE CITY OF PUEBLO, A MUNICIPAL
CORPORATION, AND THE STATE OF COLORADO
DEPARTMENT OF PUBLIC SAFETY, DIVISION OF FIRE
PREVENTION AND CONTROL, AND AUTHORIZING THE
MAYOR TO EXECUTE SAME
WHEREAS, the City of Pueblo is the owner and operator of the Pueblo Memorial Airport
together with the land on which said Airport is situated; and
WHEREAS, the State of Colorado Department of Public Safety, Division of Fire Prevention
and Control, is desirous of leasing 31501 Bryan Circle, Suite 120, and the Fire Fighting Reload
Base, at 31851 Bryan Circle, both of which are owned by the City of Pueblo; NOW,
THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Standard Lease Agreement \[Improved Real Property\] (“Lease”), by and between the
City of Pueblo, a Municipal Corporation, and the State of Colorado Department of Public Safety,
Division of Fire Prevention and Control, to lease office space at 31501 Bryan Circle, Suite 120,
and the Fire Fighting Reload Base, at 31851 Bryan Circle at Pueblo Memorial Airport, a copy
of which is attached hereto and made a part hereof by reference, after having been approved as
to form by the City Attorney, is hereby approved.
SECTION 2.
The Mayor is hereby authorized to execute the Lease in the name and on behalf of the
City of Pueblo, where the Mayor may execute the Lease by electronic signature and such
electronic signature shall be attributable to the Mayor and the City of Pueblo.
SECTION 3.
The officers and staff of the City are authorized to perform any and all acts consistent with
the intent of this Ordinance and the attached Lease to implement the terms and conditions
described therein.
SECTION 4.
This Ordinance shall become effective on the date of final action by the Mayor and City
Council.

AUTHORIZING THE MAYOR TO EXECUTE SAME
SUMMARY:
The State of Colorado Department of Public Safety, Division of Fire Prevention and Control,
(“State”) is desirous of renting and occupying an existing office space of approximately 1,400
square feet and the Fire Fighting Reload Base, also known as the tanker base reload pit,
(“Base”) at the Pueblo Memorial Airport.
PREVIOUS COUNCIL ACTION:
Not applicable to this Ordinance.
BACKGROUND:
The City owns 31501 Bryan Circle (Hangar) and 31851 Bryan Circle (Base). The hangar office
space has been vacant since October 31, 2021. The Base is used to reload airplanes with fire
retardant during the fire season. Since the United States Forest Service granted the Base to the
City on March 14, 2022, the Base has not been utilized.
FINANCIAL IMPLICATIONS:
Not applicable to this Ordinance.
BOARD/COMMISSION RECOMMENDATION:
Not applicable to this Ordinance.
STAKEHOLDER PROCESS:
Not applicable to this Ordinance.
ALTERNATIVES:
If City Council does not approve this Ordinance, the office space will remain vacant and the Base
will go unused.
RECOMMENDATION:
The Department of Aviation recommends approval of this Ordinance.
