HomeMy WebLinkAbout10222ORDINANCE NO. 10222 AN EMERGENCY ORDINANCE APPROVING AND ACCEPTING A GRANT FROM THE COLORADO DEPARTMENT OF LOCAL AFFAIRS (DOLA) FOR THE STATE’S POOLS SPECIAL INITIATIVE PROGRAM, AUTHORIZING THE MAYOR TO EXECUTE SAME, ESTABLISHING PROJECT NO. CI2211, BUDGETING AND APPROPRIATING FUNDS IN THE AMOUNT OF $25,000 TO SAID PROJECT NO. CI2211 WHEREAS, on June 30, 2022, the City of Pueblo was notified by the Colorado Department of Local Affairs that it will receive grant funds in the amount of $25,000.00 for the Governor’s Pools Special Initiative 2022 (PSI) program; and WHEREAS, if the PSI program and grant funds are not immediately approved, and the $25,000.00 is not budgeted and appropriated, staff will not be recruited and retained for public swimming pools per the PSI program prior to closure of the pool season on September 5, 2022; and WHEREAS, acceptance and execution of the grant and the budgeting and appropriating of the associated $25,000.00 is immediately needed for Pueblo’s public swimming pools in order: (1) to attract and retain public pool employees through the summer and ensure adequate staffing levels, where having insufficient staff and lifeguards at public pools would create conditions hazardous to the public health and safety; and (2) to attract and retain public pool employees to preserve public pool properties and ensure they does not fall into a derelict or dangerous condition; and WHEREAS, in accordance with Charter Section 3-20, an emergency ordinance is required for the immediate preservation or protection of public health, property, or safety, and the completion of the PSI program and acceptance of the grant is declared an emergency. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Pools Special Initiative 2022 Grant (“Grant”) between the City of Pueblo, a Municipal Corporation, and the Colorado Department of Local Affairs, a copy of which is attached hereto, having been approved as to form by the City Attorney, is hereby approved. SECTION 2. The Mayor is authorized to accept the Grant in the name of the City and the City Clerk is directed to affix the seal of the City thereto and attest same. SECTION 3. Project No. CI2211 – Pools Special Initiative Grant is hereby established. SECTION 4. Funds in the amount of $25,000.00 are hereby accepted from the Colorado Department of Local Affairs pursuant to the Grant and are hereby budgeted and appropriated to Project No. CI2211 – Pools Special Initiative Grant. SECTION 5. Grant funds shall be used in accordance with the PSI-22-003 City of Pueblo – Pools Special Initiative 2022 Grant Award and Next Steps Agreement notification received on June 30, 2022. SECTION 6. The officers and staff of the City are authorized to perform any and all acts consistent with this Ordinance to implement the policy and procedures described therein. SECTION 7. This Ordinance shall become effective on the date of final action by the Mayor and City Council. PREVIOUS COUNCIL ACTION: Not applicable to this Ordinance. BACKGROUND: On June 24, 2022, the City of Pueblo, along with numerous other Colorado municipalities and agencies, applied for the Governor’s “Pools Special Initiative” grant to receive state funding to help ensure public swimming pools across the State of Colorado are open and properly staff in th time for the July 4 holiday and for the remainder of the summer months. th On June 30, 2022, Governor Polis announced the grants ahead of the July 4 holiday weekend, where the City of Pueblo along with seventy-one other municipalities and agencies across Colorado would receive funds to help swimming pools to open and expand hours this summer in light of the country’s workforce shortage. Pueblo was one of the few in Southern Colorado who received this maximum grant amount. The “Pools Special Initiative 2022” provides incentives to attract and retain public pool employees through the summer and ensure adequate staffing levels to allow pools to open at maximum capacity. The grant will be beneficial in keeping qualified lifeguards, ensuring that our pools can increase operating hours and stay open longer in the summer after many lifeguards return to school in the fall, and expanding capacity to teach life-saving swim lessons. FINANCIAL IMPLICATIONS: The grant award funds will be utilized to cover additional personnel expenses at the City’s four outdoor swimming pools as a result of increased operating hours and programs through the end of the summer season, which ends on Labor Day, September 5, 2022. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Ordinance. STAKEHOLDER PROCESS: Not applicable to this Ordinance. ALTERNATIVES: If this Ordinance is not approved, the City will be required to return the grant funds to the Colorado Department of Local Affairs, and the City swimming pools will not add additional operating hours or days to enhance the recreational swimming needs of the community. Statutory Authority. C.R.S. 24-32-106(1)(c) 2. Funding Period: July I, 2022 through September 30, 2022 3. Use of Funds a. Grant funds will only be spent on costs associated with the recruitment and retention of public swimming pool employees. Eligible expenses include but are not limited to: ■ any expenses related to recruitment of public swimming pool employees such as marketing and advertising,job board fees, referral bonuses; ■ any expenses related to retention of public swimming pool employees such as to pay increases, signing bonuses, fringe benefits, team building opportunities, employee appreciation expenses. b. Grantee counties, municipalities, and special districts understand that any grant funds expended outside of the intent of this program must be returned to the Department of Local Affairs within 30 days of the ruling by DOLA of improper fund use. c. Grant funds expire September 30, 2022. Grantee counties, municipalities, and special districts must not incur any expenses after September 30, 2022. d. Ineligible expenses include but are not limited to: any expenses not related to recruitment and retention of public swimming pool employees such as utilities, pool supplies, pool equipment and furniture, maintenance expenses, recruitment and retention expenses for non-swimming pool employees, training*, any expenses already accounted for in your current budget. *for assistance with training costs, contact your local workforce center. 4. Documentation. Recipient shall retain documentation on all uses of the funds, including invoices, receipts, data and financial records, and any other documentation that establishes compliance for up to three (3) years after the final report is approved using PSI funds. Such documentation shall be provided to DOLA or its duly authorized representatives upon request. 5. Monitoring. a. DOLA or the State of Colorado reserves the right to initiate detailed monitoring or auditing of any grantee at its sole discretion. b. The review shall provide assurance that the information self-reported by Grantee is accurate and complete, and identify unallowable or questionable expenditures for follow-up. When concerns are noted during the review process, the Grantee shall provide documentation of the expenditures or accounting practices to DOLA for verification. c. Funds spent outside of the stated program intent must be returned to DOLA within 30 days of identification by DOLA of improper use. 6. Financial Reporting. a. Recipient counties, municipalities, and special districts must provide DOLA with itemized reports upon the complete expense of both (2) advance payments detailing how grant funds were spent. Invoices and proof of payment must be provided to support the expenditures. b. Recipient counties, municipalities, and special districts must submit a final report upon the completion of the project. c. Any unspent funds must be returned to DOLA no later than October 31, 2022 and prior to submitting the final report. Unspent funds will be deobligated by DOLA. 7. In the event of a conflict between the terms and conditions of the Grantee's Application and the terms and conditions of this award agreement letter, the terms and conditions of this award agreement letter shall prevail.
