AN ORDINANCE APPROVING AND AUTHORIZING THE
EXECUTION OF OPERATING ARP GRANT APRIL 26, 2022,
RELATING TO AWARD NO. CO-2022-013-00 BETWEEN THE
CITY OF PUEBLO AND THE UNITED STATES OF AMERICA,
DEPARTMENT OF TRANSPORTATION, FEDERAL TRANSIT
ADMINISTRATION, IN THE AMOUNT OF $307,724; BUDGETING
AND APPROPRIATING $75,000 INTO PROJECT PT2201,
BUDGETING AND APPROPRIATING $102,724 INTO PROJECT
PT2202, AND BUDGETING AND APPROPRIATING $130,000
INTO PROJECT PT2203
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The ARP Grant Agreement FTA Section 5307, dated April 26, 2022, relating to Award No.
CO-2022-013-00 between the City of Pueblo and the United States of America, Department of
Transportation, Federal Transit Administration, a copy of which is attached hereto, having been
approved as to form by the City Attorney, is hereby approved.
SECTION 2.
The Mayor is authorized to execute and deliver the Grant Agreement in the name of the
City and the City Clerk is directed to affix the seal of the City thereto and attest same.
SECTION 3.
Project Numbers PT2202 and PT2203 are hereby established, and with respect to the
grant funds received under the Grant Agreement, $75,000 is budgeted and appropriated into
Project PT2201, $102,724 is budgeted and appropriated into Project PT2202, and #130,000 is
budgeted and appropriated into project PT2203.
SECTION 4.
The officers and staff of the City are authorized to perform any and all acts consistent with
this Ordinance to implement the policies and procedures described herein.
SECTION 5.
This Ordinance shall become effective on the date of final action by the Mayor and City
Council.

SUMMARY:
Attached is a Grant Agreement between the City of Pueblo and the Federal Transit Administration
for FY2021 Section 5307 Arp Act Grant for $307,724.00 allocation.

BACKGROUND:
This is a FY2021 Section 5307 ARP Act Grant for $307,724.00 allocation. Per the ARP Act, the
grant provided is 100% federal share. This grant utilizes ARP Act funding to prevent, prepare for,
and respond to COVID-19. The grant scope of work includes the following projects:
$205,000 – Bus; Support Equipment and Facilities; and
$102,724 – Operating Assistance.
$307,724 Total Grant
FINANCIAL IMPLICATIONS:
The anticipated total project cost is $307,724. The Federal share is 100% with no City match
requirement.
BOARD/COMMISSION RECOMMENDATION:
Pueblo Transit Board recommends approval.
STAKEHOLDER PROCESS:
Not applicable.
ALTERNATIVES:
The alternative, should this Ordinance not pass, is for the City of Pueblo to not receive their 2021
ARP Act Grant Apportionment.

Award Executive Summary
This application requests FY21 ARP Section 5307 funds apportioned to Pueblo Transit for the
amount of$307,724 (partial apportionment), representing 100%federal share of the total eligible
amount. The remaining balance of$297,737 will be requested in a future grant application or
amendment. This application utilizes ARP funding to prevent, prepare for and respond to
coronavirus.
Purpose: Pueblo Transit will utilize ARP funds to purchase replacement equipment and assist with
operating expenses.
Activities to be Performed: This application includes one project to provide operating assistance and
purchase a replacement support vehicle and replace surveillance cameras. Details are included in
the Program of Projects (POP) in the application documents.
Expected Outcomes: The selected projects will support Pueblo Transit as they continue to recover
from the impacts of the COVID-19 pandemic.
Intended Beneficiaries: Transit riders in Pueblo.
Subrecipient Activities: N/A
Pueblo Transit agrees that if it receives federal funding from the Federal Emergency Management
Agency (FEMA) or through a pass-through entity through the Robert T. Stafford Disaster Relief and
Emergency Assistance Act, a different federal agency, or insurance proceeds for any portion of a
project activity approved for FTA funding under this Grant Agreement, it will provide written
notification to FTA, and reimburse FTA for any federal share that duplicates funding provided by
FEMA, another federal agency, or an insurance company.
The Recipient certifies that it, and its subrecipients and contractors that are providers of public
transportation, have not furloughed any employees since March 27, 2020 (the enactment date of the
CARES Act).
This grant uses pre-award authority and will note$205,000 as an unliquidated obligation balance in
the initial FFR.

years. The cameras replace out of date cameras and require replacement. Sole source procurement

Effective November 2014, FTA recipients are required to submit, within 30 days of
making an award, the name of the successful bidder and the total dollar value of the
contract. Remember, only eligible TVMs may bid on FTA-assisted transit vehicle
procurements. Recipients must report these vehicle purchases on the form on ETA's
website:

As your agency undergoes the procurement process for vehicles, please ensure that
you are in compliance with these requirements and verifying that any manufacturers
bidding on the contract have so complied. Please find linked here a list of transit
vehicle manufacturers (TVMs) that have DBE programs and goals which are FTA-
approved:

These TVMs are approved to bid on and be awarded FTA-assisted vehicle contracts.

Requirements to Remember for: Remanufacture or Rebuilt Vehicles:
Your agency must comply with all applicable Federal laws and regulations related to
this project, including the accessibility specifications for transportation vehicles.
Specifically, your agency must comply with the ADA Standards for rehabilitating vans
and cutaway buses. If altering or rebuilding vehicles, the vehicles must be readily
accessible. (DOT ADA Regulation 49 C.F.R. 37.75; DOT ADA Regulation 49 C.F.R.
37.83; and DOT ADA Regulation 49 C.F.R. 37.89.)
If a remanufactured or rebuilt vehicle will not be accessible, the grantee must submit
information to FTA demonstrating that the structural integrity of the vehicle would be
significantly compromised if it is made accessible. Include an appropriate structural
engineering analysis. (DOT ADA Regulation 49 C.F.R. 37.75 (c); DOT ADA

Award Executive Summary_ This application requests FY21 ARP Section 5307 funds apportioned to
Pueblo Transit for the amount of$307,724 (partial apportionment), representing 100% federal share of
the total eligible amount. The remaining balance of$297,737 will be requested in a future grant
application or amendment. This application utilizes ARP funding to prevent, prepare for and respond to
coronavirus.
Purpose: Pueblo Transit will utilize ARP funds to purchase replacement equipment and assist with
operating expenses.
Activities to be Performed: This application includes one project to provide operating assistance and
purchase a replacement support vehicle and replace surveillance cameras. Details are included in the
Program of Projects (POP) in the application documents.
Expected Outcomes: The selected projects will support Pueblo Transit as they continue to recover from
the impacts of the COVID-19 pandemic.
Intended Beneficiaries: Transit riders in Pueblo.
Subrecipient Activities: N/A
Pueblo Transit agrees that if it receives federal funding from the Federal Emergency Management
Agency (FEMA) or through a pass-through entity through the Robert T. Stafford Disaster Relief and
Emergency Assistance Act, a different federal agency, or insurance proceeds for any portion of a
project activity approved for FTA funding under this Grant Agreement, it will provide written notification
to FTA, and reimburse FTA for any federal share that duplicates funding provided by FEMA, another
federal agency, or an insurance company.
The Recipient certifies that it, and its subrecipients and contractors that are providers of public
transportation, have not furloughed any employees since March 27, 2020 (the enactment date of the
CARES Act).
This grant uses pre-award authority and will note $205,000 as an unliquidated obligation balance in the
initial FFR.
Research and Development: This award does not include research and development activities.
Indirect Costs: This award does not include an indirect cost rate.
Suballocation Funds: Recipient organization is directly allocated these funds and is eligible to apply
for and receive these funds directly.
