CO-2022-013-00 BETWEEN THE CITY OF PUEBLO AND THE UNITED STATES OF AMERICA, DEPARTMENT OF TRANSPORTATION, FEDERAL TRANSIT ADMINISTRATION, IN THE AMOUNT OF $307,724; BUDGETING AND APPROPRIATING $75,000 INTO PROJECT PT2201, BUDGETING AND APPROPRIATING $102,724 INTO PROJECT PT2202, AND BUDGETING AND APPROPRIATING $130,000 INTO PROJECT PT2203 BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The ARP Grant Agreement FTA Section 5307, dated April 26, 2022, relating to Award No. CO-2022-013-00 between the City of Pueblo and the United States of America, Department of Transportation, Federal Transit Administration, a copy of which is attached hereto, having been approved as to form by the City Attorney, is hereby approved. SECTION 2. The Mayor is authorized to execute and deliver the Grant Agreement in the name of the City and the City Clerk is directed to affix the seal of the City thereto and attest same. SECTION 3. Project Numbers PT2202 and PT2203 are hereby established, and with respect to the grant funds received under the Grant Agreement, $75,000 is budgeted and appropriated into Project PT2201, $102,724 is budgeted and appropriated into Project PT2202, and #130,000 is budgeted and appropriated into project PT2203. SECTION 4. The officers and staff of the City are authorized to perform any and all acts consistent with this Ordinance to implement the policies and procedures described herein. SECTION 5. This Ordinance shall become effective on the date of final action by the Mayor and City Council. PREVIOUS COUNCIL ACTION: No previous Council actions BACKGROUND: This is a FY2021 Section 5307 ARP Act Grant for $307,724.00 allocation. Per the ARP Act, the grant provided is 100% federal share. This grant utilizes ARP Act funding to prevent, prepare for, and respond to COVID-19. The grant scope of work includes the following projects: $205,000 – Bus; Support Equipment and Facilities; and $102,724 – Operating Assistance. $307,724 Total Grant FINANCIAL IMPLICATIONS: The anticipated total project cost is $307,724. Requirements to Remember for: Remanufacture or Rebuilt Vehicles: Your agency must comply with all applicable Federal laws and regulations related to this project, including the accessibility specifications for transportation vehicles. Specifically, your agency must comply with the ADA Standards for rehabilitating vans and cutaway buses. If altering or rebuilding vehicles, the vehicles must be readily accessible. Subrecipient Activities: N/A Pueblo Transit agrees that if it receives federal funding from the Federal Emergency Management Agency (FEMA) or through a pass-through entity through the Robert T. Stafford Disaster Relief and Emergency Assistance Act, a different federal agency, or insurance proceeds for any portion of a project activity approved for FTA funding under this Grant Agreement, it will provide written notification to FTA, and reimburse FTA for any federal share that duplicates funding provided by FEMA, another federal agency, or an insurance company. The Recipient certifies that it, and its subrecipients and contractors that are providers of public transportation, have not furloughed any employees since March 27, 2020 (the enactment date of the CARES Act). This grant uses pre-award authority and will note $205,000 as an unliquidated obligation balance in the initial FFR.
