HomeMy WebLinkAbout14787* RESOLUTION NO. 14787 A RESOLUTION AWARDING A CONSTRUCTION CONTRACT IN THE AMOUNT OF $117,336 TO INDUSTRIAL CONSTRUCTORS/MANAGERS, INC., FOR PROJECT NO. 21A-054 INSTALLATION OF SHADE STRUCTURE AT LAKE MINNEQUA PARK AND OPEN SPACE AND AUTHORIZING THE PURCHASING AGENT TO EXECUTE SAME WHEREAS, an emergency City improvement contract was requested by the Director of Public Works and authorized by the Mayor in accordance with Section 1-10-5 of the Pueblo Municipal Code for Project CI1911, Installation of Shade Structure at Lake Minnequa Park and Open Space; and WHEREAS, the proposal of Industrial Constructors/Managers, Inc., was determined to be the proposal which will achieve maximum economy to the City under the conditions prevailing; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. A contract for Project CI1911, Installation of Shade Structure at Lake Minnequa Park and Open Space is hereby awarded to said bidder for a total amount of $117,336.00. SECTION 2. Funds in the amount of $117,336.00 shall be available from Project CI1911, Lake Minnequa Park and Open Space Improvement Project. SECTION 3. The Purchasing Agent is hereby authorized to execute said contract on behalf of the City of Pueblo, a Colorado Municipal Corporation, and the City Clerk shall affix the seal of the City thereto and attest the same. SECTION 4. The officers and staff of the City are authorized to perform any and all acts consistent with this Resolution to implement the policies and procedures described herein. SECTION 5. This Resolution shall become effective immediately upon passage and approval. Hayes, P.E., Director of Public Works SUBJECT: A RESOLUTION AWARDING A CONSTRUCTION CONTRACT IN THE AMOUNT OF $117,336 TO INDUSTRIAL CONSTRUCTORS/MANAGERS, INC., FOR PROJECT NO. 21A-054 INSTALLATION OF SHADE STRUCTURE AT LAKE MINNEQUA PARK AND OPEN SPACE AND AUTHORIZING THE PURCHASING AGENT TO EXECUTE SAME SUMMARY: This Resolution awards a construction contract to Industrial Constructors/Managers (ICM), Inc for the Shade Structure Installation at Lake Minnequa Park and Open Space, CI1911. ICM, Inc will be awarded a contract in the amount of $117,336.00. PREVIOUS COUNCIL ACTION: On May 28, 2019, though Ordnance No. 9470, City Council approved an IGA between the City of Pueblo and Pueblo County relating to the use of 2016 Ballot Question 1A Capital Improvement Program Project funding for the Lake Minnequa Park Improvements. On September 23, 2019, through Ordinance No. 9548, City Council approved to establish Capital Project CI1911 – Lake Minnequa Park Improvements, budget and appropriate $1.5 million form the Fund Balance Account of the General Fund to be reimbursed by Pueblo County 1A Capital Improvement Program Funds. On July 13, 2020, through Ordinance No. 9750 City Council approved to budget and appropriate $1,000,000 from 2016 County Ballot 1A Capital Improvement Program Project funding for Project No. CI1911 – Lake Minnequa Park Improvements On July 27, 2020, through Resolution 14436, City Council awarded a construction contract to Solid Earth Civil Constructors, Inc for parking lot and concession stand improvements at Lake Minnequa. On February 22, 2021, through Resolution 14561, City Council awarded a construction contract to Total Terrain, Inc for Lake Minnequa Field Extension, Phase 3B. BACKGROUND: The shade structure being installed at Lake Minnequa Park and Open Space was previously located at the HARP Riverwalk in Gateway Plaza. During the expansion of the Pueblo Convention Center and the PBR Sports Center HARP paid ICM to disassemble the shelter and store it for up to two (2) years. During the shade structure disassembly and removal, ICM, Inc documented the removal for future re-assembly. The shade structure has been stored by ICM, Inc for approximately three (3) years since the removal. The Parks and Recreation Department and HARP have determined that the shade shelter should be installed at the Lake Minnequa Park and Open Space rather than purchasing a new shade shelter. The installation will include the engineering of a new foundation, construction of the foundation, installation of the canopy and structure and a 6” concrete slab. The IGA with Pueblo County requires that the work be completed, and paid for, by December 27, 2021. The County has indicated that they will grant a three (3) to four (4) month extension but has yet to officially take action on the extension request. The majority of the time extension will be required for engineering, permitting, and installation of the shade shelter according to ICM, Inc. Due to the probability of losing the funding from the County 1A, an emergency City improvement contract was requested by the Director of Public Works and authorized by the Mayor. FINANCIAL IMPLICATIONS: Funds in the amount of $117,336.00 shall be paid from the Lake Minnequa Park and Open Space Project, CI1911. If the structure is not installed and paid for by the end of the extension (pending), the County will close the project and will not approve additional billing from the City. BOARD/COMMISSION RECOMMENDATION: None. STAKEHOLDER PROCESS: None. ALTERNATIVES: Denial of this Resolution will result in cancellation of the Project. RECOMMENDATION: Approval of this Resolution.
