AN ORDINANCE APPROVING AND ACCEPTING A GRANT
AWARD TO THE CITY OF PUEBLO AND PUEBLO POLICE
DEPARTMENT FROM THE PATRICK LEAHY BULLETPROOF
VEST PARTNERSHIP ADMINISTERED BY THE U.S.
DEPARTMENT OF JUSTICE, ACCEPTING $1,805.77 FOR YEAR
2020 AND $16,081.74 FOR YEAR 2021, TOTALING $17,887.51,
ESTABLISHING PROJECT NUMBER PS2111, AND BUDGETING
AND APPROPRIATING FUNDS NOT TO EXCEED $87,887.51 TO
PROJECT NUMBER PS2111
WHEREAS, the City Council of Pueblo has the authority on behalf of the City of Pueblo,
including its Police Department, to accept funding from the U.S. Department of Justice (“DOJ”)
for public and municipal purposes; and
WHEREAS, the DOJ in accordance with the Patrick Leahy Bulletproof Vest Partnership
(“BVP”) has tendered an award in a total amount of $17,887.51, $1,805.77 for the 2020 year and
$16,081.74 for the 2021 year, upon conditions recited therein or incorporated therein by
reference; and
WHEREAS, acceptance of the funding for the purposes for which it has been made is in
the best interest of the City and will benefit the health, welfare, and safety of the citizens of the
City; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
Project Number PS2111 is hereby established.
SECTION 2.
The grant award from the Patrick Leahy Bulletproof Vest Partnership (“BVP”) administered
by the U.S. Department of Justice, to the Pueblo Police Department, totaling $17,887.51, is
hereby approved and accepted in accordance with its terms and conditions.
SECTION 3.
All funds accepted under this ordinance shall be budgeted and appropriated into Project
Number PS2111. A transfer of funds from the Police Department’s operating budget to Project
Number PS2111 in an amount not to exceed $70,000 is also approved. Said funds shall only be
expended and used for this Project.
SECTION 4.
The officers and staff of the City are authorized to perform any and all acts consistent with
the intent of this Ordinance to effectuate the policies and procedures described herein.
SECTION 5.
This Ordinance shall become effective on the date of final action by the Mayor and City
Council.

SUMMARY:
The U.S. Department of Justice (“DOJ”) has informed the Pueblo Police Department
(“PPD”) that funds are available under the Patrick Leahy Bulletproof Vest Partnership
(“BVP”) to assist PPD with purchasing bulletproof vests for its police officers.
PREVIOUS COUNCIL ACTION:
Previous grants of this nature have routinely been approved when offered.
BACKGROUND:
Body armor has a recommended life span of five years. PPD provides its officers with
body armor, which requires continuous replacement on a five-year (5) rotation. The body
armor currently being used by PPD officers will expire soon and needs to be replaced.
PPD will need to replace approximately 116 vests in the first few months of 2022. The
new body armor will provide all authorized sworn positions with body armor that complies
with the most current National Institute of Justice (NIJ) 0101.06 standard.
An application for funding assistance was submitted to the BVP in May 2021. In
response, the BVP awarded the City of Pueblo $1,805.77 for the 2020 year and
$16,081.74 for the 2021 year, totaling $17,887.51. These funds may only be used for the
purchase of bulletproof vests.
FINANCIAL IMPLICATIONS:
This ordinance creates project number PS2111. The department has been awarded a
total of $17,887.51 from the BVP Program, sponsored by the DOJ. The City is required
to match at least fifty percent (50%) of the cost of qualifying vests. The cost of the new
vests will be approximately $84,100; therefore additional funds from the Police
Department’s operating budget in the amount of approximately $70,000 are required to
complete the purchase of the vests. This Ordinance will allow the department to utilize
the grant funding to acquire the needed vests while reducing the overall cost to the
Department. The remaining cost will come out of the regular PPD budget.

Not applicable to this Ordinance.
STAKEHOLDER PROCESS:
There is no stakeholder process required for award.
ALTERNATIVES:
Decline the BVP award and increase the cost of purchasing needed police equipment by
requiring more funds from PPD’s budget.
RECOMMENDATION:
Approval of the Ordinance.
