HomeMy WebLinkAbout10017ORDINANCE NO. 10017 AN ORDINANCE REMOVING THE REQUIREMENT THAT APPLICATIONS FOR ORIGINAL ISSUANCE AND APPLICATIONS FOR RENEWAL FOR CITY ISSUED LICENSES CONTAIN A NOTARIZED AFFIDAVIT BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (brackets indicate matter being deleted, underscoring indicates new matter being added) SECTION 1. Chapter 1, of Title IX of the Pueblo Municipal Code is amended to read as follows: Sec. 9-1-6. Procedure for issuance of license. (a) Formal Application Required. Every person required to procure a license under the provisions of this Code or any ordinance or law of the City shall submit an application for such license to the License Officer. The application shall: (1) Form. Be a \[written\] statement upon forms provided by the License Officer\[; such form shall include an affidavit, to be sworn to by the applicant before a Notary Public or other oath-taking official of the State\]. Any false statement knowingly made on any application shall be grounds for rejection of such application or revocation of any license issued upon the basis of such false statement. . . . Sec. 9-1-11. Renewal; fee, application. . . . (b) Renewal License Procedure. The applicant for the renewal of a license shall submit an application for such renewal to the License Officer. The application shall: (1) Form. SECTION 2. The officers and staff of the City are authorized to perform any and all acts consistent with the intent of this Ordinance to implement the policies and procedures described herein. Gradisar VIA: Marisa Stoller, City Clerk FROM: Marisa Stoller, City Clerk SUBJECT: AN ORDINANCE REMOVING THE REQUIREMENT THAT APPLICATIONS FOR ORIGINAL ISSUANCE AND APPLICATIONS FOR RENEWAL FOR CITY ISSUED LICENSES CONTAIN A NOTARIZED AFFIDAVIT SUMMARY: Currently all applications for original issuance and renewal of any license that is issued by the City must include an affidavit that is sworn before a notary public or other oath taking official of the state. This ordinance removes that requirement. PREVIOUS COUNCIL ACTION: Council has not previously acted on this issue. BACKGROUND: Applications for original issuance and for renewal of City issued licenses are being moved online through opengov.org. Traditionally, applications were completed on paper and physical copies were turned into the appropriate licensing officer. At that time authorized city personnel would notarize the signature on the affidavit. As applications are moved online applicants are no longer required to go to the licensing officer’s office. As a result, applicants would have to seek out their own notary public to notarize their affidavit adding an additional step and thereby complicating the application process. If this ordinance passes and the notarized affidavit requirement is removed, license holders may still have their license revoked if it is discovered they made false statements on their application. FINANCIAL IMPLICATIONS: N/A BOARD/COMMISSION RECOMMENDATION: N/A STAKEHOLDER PROCESS: N/A ALTERNATIVES: If this Ordinance does not pass applicants for City issued licenses will still be required to submit a notarized affidavit with their application.
