HomeMy WebLinkAbout14720 RESOLUTION NO. 14720 A RESOLUTION ADOPTING A FEE SCHEDULE FOR PRETREATMENT OPERATIONS WHEREAS, the Environmental Protection Agency (EPA) requires industries with potential of discharging pollutants to be permitted, inspections to be performed, and sampling and analysis to be done by the City’s Pretreatment Program to assure compliance with EPA regulations; and WHEREAS, Section 16-7-110 of the Pueblo Municipal Code provide that the City of Pueblo may adopt reasonable fees for reimbursement of costs of setting up and operation the City’s Pretreatment Program; and WHEREAS, the Pueblo City Council hereby finds and determines that the following fee schedule is fair and reasonable in relation to the cost and expense, both direct and indirect in providing the identified services; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The following fee schedule is hereby adopted pursuant to Section 16-7-110 of the Pueblo Municipal Code for reimbursement of the following costs with respect to setting up and operating the City's Pretreatment Program. Services Fees Sampling Grab sample $37.05 per sampling event Composite sample $74.10 per sampling event Permit Issuance (application review and Discharge permit $412.45 every permit drafting of permit) renewal or new permit issuance Zero-Discharge $247.47 every permit renewal or new permit issuance Document review (Periodic Compliance Discharge permit $494.94 per year Report review and Zero-Discharge Certificate) Zero-Discharge $247.47 per year Enforcement costs (not related to legal costs) Commercial Laboratory Costs Recover cost invoiced by laboratory for analysis Pueblo Wastewater Laboratory Fee based on average of two outside laboratory rates for the same analysis Section 2. The officers and staff of the City are authorized to perform any and all acts consistent with the intent of this Resolution and to implement the policies and procedures described therein. SECTION 3. This Resolution shall become effective immediately upon passage and approval. Gradisar, Mayor VIA: Marisa Stoller, City Clerk FROM: Nancy Keller, Wastewater Director SUBJECT: A RESOLUTION ADOPTING A FEE SCHEDULE FOR PRETREATMENT OPERATIONS SUMMARY: This Resolution adopts Pretreatment fees for reimbursement of costs of operating the City’s Pretreatment Program. PREVIOUS COUNCIL ACTION: None BACKGROUND: Pueblo Code of Ordinance Section 16-7-110 provides that the city may adopt reasonable fees for reimbursement of costs of setting up and operating the City’s Pretreatment Program including fees necessary to cover the costs of reviewing applications, processing data, cost for sampling and sample analysis, and other tasks to carry out the requirements of the program. The fees were developed using the rate of each of the employees that would be doing the task. The laboratory cost recovery fees are based on the rate the commercial laboratory charges the city for the analysis, and the cost recovery fees for the City’s Wastewater Laboratory are based on an average of two commercial laboratory analysis fees. FINANCIAL IMPLICATIONS: The fees accurately reflect staff time and other expenses pertaining to the Pretreatment Program operating costs. BOARD/COMMISSION RECOMMENDATION: None STAKEHOLDER PROCESS: None ALTERNATIVES: Alternative No. 1 – No Action Costs will continue to be covered by the rate payers and not recovered from the industries. RECOMMENDATION: Approval of the Resolution.
