AN ORDINANCE EXCLUDING THE AUTOMATIC INCLUSION
OF THE KEATING SCHOOL LOCATED AT 215 EAST ORMAN
AVENUE TO THE LOCAL HISTORIC REGISTER AFTER BEING
DESIGNATED ON THE NATIONAL REGISTER OF HISTORIC
PLACES
WHEREAS, the building at 215 East Orman, Keating School, was placed on the
National Register of Historic Places (NRHP) on December 7, 2021; and,
WHEREAS, properties that enter the National Register of Historic Places are
automatically included onto the local register of historic places and subject to municipal
regulations; and,
WHEREAS, the property owner submitted an application to exclude the building from
the local register within 180 days of December 7, 2021 on March 25, 2021 according to
Pueblo Municipal Code 4-14-8(I); and,
WHEREAS, the City Historic Preservation Commission’s recommendation and the
exclusion application and submitted its recommendation to approve the exclusion; NOW,
THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The City Council finds and determines that 215 E. Orman Avenue, Pueblo, Colorado,
and legally described as Lots 1 to 13 INC Block 131 Colorado Coal + Iron Company’s Addition
No 1, has been placed on the National Register of Historic Places.
SECTION 2.
The City Council finds that allowing the property to opt out of the local historic register
would not endanger historic preservation or degrade the quality of life in the surrounding
neighborhood. The applicant has a contract to preserve the historic character of the building
with the current owner.
SECTION 3.
The City Council approves the exclusion for The Keating School located at 215 E.
Orman Avenue, Pueblo, CO to not be included within the list of local historic landmarks and
subject to the requirements of Section 4-14-8 of the Pueblo Municipal Code.
SECTION 4.
The officers and staff of the City are authorized to perform any and all acts consistent
with the intent of the Ordinance to implement the policies and procedures described herein.
SECTION 5.
This Ordinance shall become effective immediately upon final action by the Mayor and
City Council.

SUBJECT: AN ORDINANCE EXCLUDING THE AUTOMATIC INCLUSION OF THE
KEATING SCHOOL LOCATED AT 215 EAST ORMAN AVENUE TO THE
LOCAL HISTORIC REGISTER AFTER BEING DESIGNATED ON THE
NATIONAL REGISTER OF HISTORIC PLACES
SUMMARY:
This Ordinance will exclude 215 East Orman Avenue from the automatic inclusion as a
local Pueblo Historic Landmark, pursuant to the Historic Preservation Code, Chapter 14,
Title IV of the Pueblo Municipal Code.
PREVIOUS COUNCIL ACTION:
None.
BACKGROUND:
The applicant is requesting that the property be excluded from automatic inclusion in the
Local Register of Historic Places in accordance with Section 4-14-8 (I) of the Pueblo
Municipal Code. The exclusion process was initiated by applicant, Keating School, with
permission by the owner, Pueblo City Schools District 60. The property qualified for the
National Register of Historic Places (NRHP) was listed on the NRHP December 2, 2020.
The application to exclude was received by the City March 25, 2021. According to Section
4-14-8 (I) of the Pueblo Municipal Code owners have 180 days to submit their letter and
application. Findings of the Historic Preservation Commission are attached.
FINANCIAL IMPLICATIONS:
There are no financial impacts to the City of Pueblo. The applicant is aware of the financial
tax benefits available to historically designated properties.
BOARD/COMMISSION RECOMMENDATION:
The City of Pueblo Historic Preservation Commission voted 7-0, with all seven
commissioners voting to approve the opting out of the local register.
STAKEHOLDER PROCESS:
The Historic Preservation Commission conducted a public hearing regarding this
exclusion application.
ALTERNATIVES:
The structure will become locally landmarked, and the Pueblo Historic Preservation
Commission will have jurisdiction over the property should it be sold.
RECOMMENDATION:
Staff recommends approval of the opt out for the landmark property.

Keating School opt out application for Local Designation
Dear Beritt,
Keating School, a nonprofit organization, is in the process of purchasing the school property
located at 215 East Orman, Pueblo, CO. The property is listed under Central Junior High School
or Keating Junior High School. It was listed on the National Register of Historic Places on
December 7, 2020.
From the ordinance that was approved by the Pueblo City Council in December 2020, I did not
see an application to opt out of the local preservation designation so therefore the "Nomination
Application for Local Historic Designation" was completed with a disclaimer it was to opt out
not in. The application lists a fee to apply to be included but no fee was listed in the ordinance
for opting out.
