AN ORDINANCE APPROVING AN ENGAGEMENT LETTER
WITH SPENCER FANE LLP TO REPRESENT THE CITY OF
PUEBLO, A MUNICIPAL CORPORTATION REGARDING THE
LEGAL REVIEW OF A SERVICE PLAN FOR THE PROPOSED
PASTORA RANCH METROPOLITAN DISTRICTS 1-3 AND
AUTHORIZING THE MAYOR TO EXECUTE SAID ENGAGEMENT
LETTER
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Engagement Letter pertaining to the review of the service plans for the proposed
Pastora Ranch Metropolitan Districts 1-3 between the City of Pueblo, a Colorado municipal
corporation and Spencer Fane LLP, dated July 28, 2021, a copy of which is attached hereto
including all associated documents, having been approved as to form by the City Attorney, is
hereby approved. The Mayor is authorized to execute and deliver said Engagement Letter in the
name of the City and the City Clerk is directed to affix the seal of the City thereto and attest same.
SECTION 2.
The officers and staff of the City are authorized to perform any and all acts consistent with
the intent of the Ordinance to implement the policies and procedures described herein.
SECTION 3.
This Ordinance shall become effective immediately upon final action by the Mayor
and City Council.

SUBJECT: AN ORDINANCE APPROVING AN ENGAGEMENT LETTER WITH
SPENCER FANE LLP TO REPRESENT THE CITY OF PUEBLO, A
MUNICIPAL CORPORATION REGARDING THE LEGAL REVIEW OF A
SERVICE PLAN FOR THE PROPOSED PASTORA RANCH
METROPOLITAN DISTRICTS 1-3 AND AUTHORIZING THE MAYOR TO
EXECUTE SAID ENGAGEMENT LETTER
SUMMARY:
The City has received an application to approve service plans for the Pastora Ranch
Metropolitan Districts 1-3. The City is seeking assistance from Spencer Fane LLP to
assist the City in the review of the metropolitan district service plans for Pastora Ranch.
Spencer Fane was previously hired to represent the City in the review of service plans for
other recently established metropolitan districts in 2018.
PREVIOUS COUNCIL ACTION:
None.
BACKGROUND:
The City has received applications to approve service plans for three new metropolitan
districts for Pastora Ranch 1-3 that would be established within the corporate boundaries
of the City. The Law Department has authorized the assistance of Spencer Fane LLP to
assist the City in the review of the service plans for the three proposed metropolitan
districts. Spencer Fane was previously hired in 2018 to assist the City in reviewing the
service plans for the North Vista Highlands Metropolitan Districts 1-5. The hourly rate
for Spencer Fane is $440.00 per hour. The costs incurred by the City for the review of the
service plans will be required to be paid by the applicant for the Pastora Ranch
Metropolitan Districts prior to any final action of City Council being provided to the Pueblo
District Court.
FINANCIAL IMPLICATIONS:
There are no financial implications for the City.

ALTERNATIVES:
If City Council does not approve this Ordinance, Spencer Fane will not be retained.
RECOMMENDATION:
