AN ORDINANCE REFERRING BALLOT ISSUE “2A –
REVENUE FOR ROADS” TO BE DECIDED BY THE
ELIGIBLE ELECTORS OF THE CITY OF PUEBLO AT THE
MUNICIPAL GENERAL ELECTION TO BE HELD ON
NOVEMBER 2, 2021
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that
SECTION 1.
Ballot Issue 2A shall be and hereby is referred to a vote of the eligible electors of
the City of Pueblo at the City's municipal general election to be held on November 2,
2021. The ballot issue (submission clause and title) therefore shall be as follows:
BALLOT ISSUE NO. 2A – REVENUE FOR ROADS
WITHOUT IMPOSING ANY NEW TAX OR INCREASING THE RATE OF
ANY EXISTING TAX, SHALL THE CITY OF PUEBLO BE PERMITTED TO
RETAIN AND SPEND UP TO $576,609, THE AMOUNT OF CITY
REVENUES RECEIVED IN FISCAL YEAR 2020 ABOVE THE 2020
FISCAL YEAR REVENUE AND SPENDING LIMITATIONS, FOR ROAD
REPAIRS AND IMPROVEMENTS WITHIN THE CITY AND FOR FISCAL
YEAR 2021 AND THEREAFTER, SHALL THE CITY OF PUEBLO BE
PERMITTED TO COLLECT, RETAIN AND SPEND THE FULL AMOUNT
OF CITY REVENUES RECEIVED FROM ALL SOURCES, INCLUDING
ALL INVESTMENT INCOME THEREON, WITH THE CITY’S
COMMITMENT TO SPEND A MINIMUM OF $5,000,000 ANNUALLY FOR
STREET MAINTENANCE AND REPAIRS AND ROAD IMPROVEMENTS
WITHIN THE CITY, ALL AS VOTER APPROVED REVENUE CHANGES
AND EXCEPTIONS TO THE REVENUE, SPENDING AND OTHER
LIMITATIONS OR CONDITIONS WHICH WOULD OTHERWISE APPLY
PURSUANT TO ARTICLE X, SECTION 20 OF THE COLORADO
CONSTITUTION OR ANY OTHER LAW?

SECTION 2.
The officers and staff of the City are authorized to take all actions necessary or
appropriate to effectuate the provisions of this Ordinance.
SECTION 3.
This Ordinance shall become effective on the date of final action by the Mayor and
City Council.

SUBJECT: AN ORDINANCE REFERRING BALLOT ISSUE “2A – REVENUE FOR ROADS”
TO BE DECIDED BY THE ELIGIBLE ELECTORS OF THE CITY OF PUEBLO AT
THE MUNICIPAL GENERAL ELECTION TO BE HELD ON NOVEMBER 2, 2021
SUMMARY:
Attached is a proposed Ordinance referring ballot issue “2A – Revenue for Roads” to the voters
of the City of Pueblo at the November 2, 2021 municipal general election.
PREVIOUS COUNCIL ACTION:
Not applicable to this Ordinance.
BACKGROUND:
Due to a lack of available revenue, for the last several years, the City has not been able to fund
necessary road maintenance and street repairs and improvements.
FINANCIAL IMPLICATIONS:
2A does not impose any new tax or increase the rate of any existing tax.
If 2A passes, any new tax or any increase in the rate of any existing tax must be approved by the
voters of the City of Pueblo.
In Fiscal Year (“FY”) 2020, the City received $576,609 over its revenue and spending limitations.
2A permits the City to retain and spend $576,609 solely for street repairs and road improvements.
For FY 2021 and thereafter, 2A permits the City to collect, retain and spend the full amount of
City revenues received from all sources with the City’s commitment of spending a minimum of
Five Million Dollars (“$5,000,000.00) annually for needed street maintenance and repairs and
road improvements.
BOARD/COMMISSION RECOMMENDATION:
Not applicable to this Ordinance.
STAKEHOLDER PROCESS:
Members of the public are the primary stakeholders affected by the proposed Ordinance. The
issue of street maintenance and repairs and road improvements has been discussed at various
public Council meetings and work sessions during the past year.
ALTERNATIVES:
If the Ordinance is not approved, street maintenance and repairs and road improvements will
remain underfunded.
RECOMMENDATION:
This Ordinance must be adopted in order to refer the ballot measure to the voters.
