AN ORDINANCE AMENDING THE FISCAL YEAR 2021
STAFFING ORDINANCE BY A STAFFING ADJUSTMENT
WITHIN THE STORMWATER DEPARTMENT
WHEREAS, it is necessary to revise the staffing levels to achieve necessary and
increased efficiency and functionality within the Stormwater Department; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (brackets indicate matter
being deleted, underscore indicates matter being added)
SECTION 1.
The following section captioned “Planning and Community Development” “of Ordinance
No. 9852, being the 2021 Staffing Ordinance, is amended as follows:
SECTION 2.
The officers and staff of the City are directed and authorized to perform any and all acts
consistent with the intent of this Ordinance to effectuate and transactions described therein.
SECTION 3.
This Ordinance shall be deemed to amend the Fiscal Year 2021 Budget and staffing with
respect to the number and allocation of positions within the Stormwater Department and shall
become effective on the date of final action by the Mayor and City Council.

SUBJECT: AN ORDINANCE AMENDING THE FISCAL YEAR 2021 STAFFING ORDINANCE
BY A STAFFING ADJUSTMENT WITHIN THE STORMWATER DEPARTMENT
SUMMARY:
The Stormwater Department requests to adjust the department staffing through the addition of a
full-time position classified as an Associate Engineer II – SW (Stormwater) in the Engineering
Division.
PREVIOUS COUNCIL ACTION:
On December 28, 2020 Ordinance No. 9852 was approved by City Council. This Ordinance
provided authorized staffing for Fiscal Year 2021.
BACKGROUND:
The Stormwater Department requests to adjust its staffing by creating one Associate Engineer II
– SW (Stormwater) position within the Engineering Division.
The Stormwater Departments Engineering Division currently has a Civil Engineer Drainage and
a part-time Stormwater Intern who will be returning to school later in August. The Associate
Engineer II-SW position is needed to support critical engineering review and compliance activities
for the department to include the management of the Stormwater collections fee, assessment of
vacant accounts and filing liens on delinquent property owners, processing and recording
stormwater quality easements and maintenance agreements per the City’s MS4 permit,
management of Stormwater capital improvement projects and emergency point repair projects,
GPS surveying and stormwater system updates, and other department responsibilities requiring
this advanced level of experience.
The Stormwater Department has experienced a dramatic increase in workload volume due to the
significant increase in residential and commercial development within the City. Stormwater staff
are overwhelmed with subdivision and commercial plan reviews. In addition, the Colorado
Department of Public Health and Environment issued a new MS4 permit this year with increased
regulations that contain even more stringent requirements. The consequence of falling behind
on MS4 compliance activities is of substantial concern to not only the Stormwater Department but
the City and could come with costly fines if these professional duties are not executed in a timely
and thorough fashion. This position would provide critical staff support now and into the future to
continue the important work of the Stormwater Department to maintain the City’s compliance with
stormwater regulations.
FINANCIAL IMPLICATIONS:
No additional funding will be required in 2021 as the approximately $26,779.09 in costs for the
remainder of the year will be covered by existing budget.

ALTERNATIVES:
The no action alternative would be to retain staffing levels as they are which is not operationally
desirable given the significant engineering and compliance activities.
RECOMMENDATION:
Approval of the Ordinance.
