AN ORDINANCE ACCEPTING FUNDS IN THE AMOUNT OF
$20,000 FROM RICHMOND AMERICAN HOMES COLORADO (A
COLORADO CORPORATION) FOR COSTS ASSOCIATED WITH
REPAIR OF THREE CITY STREETS, AND BUDGETING AND
APPROPRIATING TO ACCOUNT HUAN01 – STREET
RESURFACING
WHEREAS, Richmond American Homes Colorado (a Colorado Corporation) is
constructing homes in the Crestview Hills Subdivision within the City of Pueblo and operations
related to that construction resulted in pavement damage to City roadways; AND,
WHEREAS, Richmond American Homes Colorado (a Colorado corporation) has agreed
to reimburse the City of Pueblo for a portion of the cost to repair damaged pavement on Inspiration
Drive, Widener Drive, and Meadowlark Drive; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
Funds in the amount of $20,000 are accepted from Richmond American Homes Colorado.
SECTION 2.
Accepted funds in the amount of $20,000 shall be budgeted and appropriated to Account
No. HUAN01 – Street Resurfacing.
SECTION 3.
The officers and staff of the City are authorized to perform any and all acts consistent with
this Ordinance to implement the policies and procedures described herein.
SECTION 4.
This Ordinance shall become effective on the date of final action by the Mayor and City
Council.

SUMMARY:
The attached Ordinance will authorize the acceptance of a payment from Richmond American
Homes to reimburse the City for a share of the cost associated with the repair of pavement
damage to three streets within the City – Inspiration Drive, Widener Drive, and Meadowlark Drive.
The Ordinance will also budget and appropriate the proceeds from the payment to Account
HUAN01 – Street Resurfacing.
PREVIOUS COUNCIL ACTION:
None.
BACKGROUND:
Richmond American Homes is currently constructing homes in the Crestview Hills subdivision
within the City. During an earlier phase of construction, dump trucks were used along a hauling
route that caused damage to the pavement on three roads (Widener Drive, Inspiration Drive, and
Meadowlark Drive) in the neighborhood. Richmond American Homes is providing a payment of
$20,000 which represents a reasonable fair share of the costs associated with required repairs to
the roadway. The remaining cost of repair will be paid from available City funds.
FINANCIAL IMPLICATIONS:
Prompt repair of the roadways will prevent further damage to the road base material and minimize
any additional cost associated with the repair. Approving this Ordinance will expedite the repair
process and allow the City to apply the Richmond American Homes payment toward the
completion of the project.
BOARD/COMMISSION RECOMMENDATION:
Not applicable to this Ordinance.
STAKEHOLDER PROCESS:
City staff have worked with Richmond American Homes staff to identify the required scope and
estimate the cost of repairs.
ALTERNATIVES:
If this Ordinance is not approved, the City will bear the full burden of cost to repair the damaged
roadways.
RECOMMENDATION:
Recommend approval of the Ordinance.
