CI-2113 - AMERICAN RESCUE PLAN ACT, FOR PURPOSES OF ESTABLISHING A VACCINE INCENTIVE PROGRAM FOR CITY EMPLOYEES AS AUTHORIZED BY SECTION 603 (a) OF THE AMERICAN RESCUE PLAN ACT AND INTERIM FINAL RULE 31 CFR 35.6 (b)(1)(i) RECITALS The following recitals are incorporated in and made a part of this Resolution: WHEREAS, on March 11, 2021, President Biden signed the U.S. Senate-amended H.R. 1319 (P.L. 117-2) known as the American Rescue Plan Act (hereinafter “ARPA”); and WHEREAS, on May 10, 2021, the U.S. Treasury issued the Interim Final Rule to implement ARPA in Title 31, Part 35 of the Code of Federal Regulations (“CFR”); and WHEREAS, under the Interim Final Rule, recipients may use Coronavirus State and Local Fiscal Recovery Funds (“CSLFRF”) to respond to the COVID-19 public health emergency, including expenses related to COVID-19 vaccination programs; and WHEREAS, programs that provide incentives reasonably expected to increase the number of people who choose to get vaccinated, or that motivate people to get vaccinated sooner than they otherwise would have, are an allowable use of ARPA funds so long as such financial incentives are reasonably proportional to the expected public health benefit. See CSLFRF Frequently Asked Questions No. 2.12. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO that: SECTION 1. There is hereby established a Vaccine Incentive Program for City employees as authorized by Section 603(a) of the American Rescue Plan Act and Interim Final Rule 31 CFR 35.6 (b)(1)(i). The City Council finds and concludes: (a) The Vaccine Incentive Program is reasonably expected to increase the number of City employees who choose to get vaccinated, or is reasonably expected to motivate City employees to get vaccinated sooner than they otherwise would have; and (b) A $500.00 incentive payment is necessary to provide sufficient motivation to City employees to become immediately vaccinated. Fairness and equity require that the $500.00 incentive payments also be made to City employees who chose, for public health reasons, to be vaccinated prior to the date of this Resolution; and (c) The $500.00 incentive payments established hereby are reasonably proportional to the expected public health benefits to be realized in the community. SECTION 2. Funds in the amount of Five Hundred Thirty Thousand Dollars ($530,000) are hereby authorized for payment from Project No. CI-2113 – American Rescue Plan Act, for purposes of funding the Vaccine Incentive Program established hereby. SECTION 3. From the date of this Resolution until September 15, 2021, every City employee who presents his or her assigned Department Director with a copy a COVID-19 Vaccination Record Card issued by the Center for Disease Control and Prevention of the U.S. Department of Health and Human Services, indicating the completion of the COVID- 19 vaccination protocol, shall be entitled to receive additional compensation from the City in the amount of $500.00, to be paid pursuant to the City’s payroll policies and procedures. SECTION 4. The officers and staff of the City are authorized to perform any and all acts consistent with this Resolution to implement the policies and procedures described herein. SECTION 5. This Resolution shall become effective immediately upon final passage. PREVIOUS COUNCIL ACTION: By Ordinance No. 9931, approved on May 17, 2021, the City Council established Project No. CI- 2113 and budgeted and appropriated up to $36.7 million in funds which were expected to be distributed to the City from the American Recovery Plan Act (“ARPA”) for covered costs and eligible expenses to be incurred during the period which began on March 11, 2021 (the date ARPA became law) until December 31, 2024 (to be expended by December 31, 2026). BACKGROUND: Under the Interim Final Rule, recipients of may use Coronavirus State and Local Fiscal Recovery Funds (“CSLFRF”) to respond to the COVID-19 public health emergency, including expenses related to COVID-19 vaccination programs. Programs that provide incentives reasonably expected to increase the number of people who choose to get vaccinated, or that motivate people to get vaccinated sooner than they otherwise would have, are an allowable use of funds so long as such costs are reasonably proportional to the expected public health benefit. See CSLFRF Frequently Asked Questions No. 2.12. FINANCIAL IMPLICATIONS: The vaccination status of all City employees is unknown. The $530,000 of ARPA funds being authorized for payment would provide a $500.00 financial incentive to all actively employed City staff including those yet-to-be vaccinated and those previously vaccinated. The actual cost of the vaccination incentive program is expected to be less if the vaccination rate of less than 100% and due to employee attrition and turnover. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Resolution. STAKEHOLDER PROCESS: Not applicable to this Resolution.
