A RESOLUTION CONCERNING THE ASSESSMENT OF COSTS
FOR THE DEMOLITION AND ABATEMENT OF DANGEROUS
STRUCTURES UPON THE PROPERTY LOCATED AT 515
BROWN AVENUE WITHIN THE CITY OF PUEBLO, AND
SETTING A DATE FOR COUNCIL HEARING THEREON
WHEREAS, pursuant to the provision of Chapter 13 of Title IV of the Pueblo Municipal
Code and Chapter 8 of the Uniform Code for the Abatement of Dangerous Buildings (IBC), as
adopted and amended, the Director of Public Works has caused the demolition and removal of
buildings and structures found to be dangerous, and;
WHEREAS, the Director of Public Works has filed his report with respect to the costs
thereof with the City Clerk, a copy of which is attached hereto and incorporated herein; NOW,
THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
A hearing on assessment of such costs and on any property owners’ or agents’
complaints, objections, or protests to the costs of demolition and removal of buildings and

structures is hereby scheduled to be held before the City Council on Monday, the 13 day of
September, 2021, commencing at 7:00 p.m., or as soon thereafter as permitted by the Business

of City Council, in the Council Chambers, 3 floor, 1 City Hall Place, Pueblo, CO 81003.
SECTION 2.
The City Clerk shall notify the owners or agents of the property to be assessed, as shown
in the report of the Director of Public Works, that such demolitions and removal have been
completed, and specifying:
(a) The entire cost of the demolition and removal plus notification and filing costs;
(b) That any complaints, objections, or protest shall be made IN WRITING by the owners
or agents, to the City Council and filed in the office of the City Clerk prior to the time
set for hearing as indicated in Section 1 of this Resolution
(c) That upon the day and hour for hearing, the City Council will hear and pass upon the
report from the Director of Public Works, together with any objections or protests which
may be filed by any person interested in or affected by the proposed assessment of
costs.
SECTION 3.
The officers and staff of the City are authorized to perform any and all acts consistent with
this Resolution to implement the policies and procedures described herein.
SECTION 4.
This Resolution shall become effective immediately upon passage and approval.

PROPERTY LOCATED AT 515 BROWN AVENUE WITHIN THE CITY OF
PUEBLO, AND SETTING A DATE FOR COUNCIL HEARING THEREON
SUMMARY:
This resolution will set a date for a public hearing regarding the assessment of costs for the
demolition of dangerous structures at 515 Brown Avenue in the City of Pueblo.
PREVIOUS COUNCIL ACTION:
On November 23, 1998, by Ordinance No. 6369, City Council adopted with modifications the
Uniform Code for the Abatement of Dangerous Buildings, 1997 Edition.
On September 28, 2015, by Resolution No. 13309, City Council approved the award of a building
demolition contract for multiple properties including the abatement of dangerous buildings on the
property at 515 Brown Avenue.
BACKGROUND:
Pursuant to Chapter 13 of Title IV of the Pueblo Municipal Code and Chapter 8 of the Uniform
Code for Abatement of Dangerous Buildings, the Building Official has determined that building(s)
located at 515 Brown Avenue were in a dangerous condition, and after giving proper notice to the
owners, requested the City to demolish the buildings. These buildings have been demolished,
and the costs incurred by the City have been compiled by the Director of Public Works in a Report
of Demolition.
In accordance with Section 903 of the Uniform Code for the Abatement of Dangerous Buildings,
1997 Edition (as amended), a public hearing is required prior to making an assessment to recover
costs related to demolition work performed by the City.
Passage of this Resolution will set a date for the required public hearing so that City Council may
hear the Report of Demolition as well as any complaints, objections, or protests filed by interested
parties related to the project.
FINANCIAL IMPLICATIONS:
Passage of this Resolution will have no direct financial impacts upon the City.
BOARD/COMMISSION RECOMMENDATION:
Not applicable to this Resolution.
STAKEHOLDER PROCESS:
The property at 515 Brown Avenue was inspected by the Building Official at Pueblo Regional
Building Department. Following the inspection, a condemnation Notice and Order was served
and posted, as required, and the property owner was provided an opportunity to appeal the Notice
and Order. The property owner failed to make the required repairs or to abate the dangerous
buildings on the property and the Notice and Order was recorded with the Pueblo County Clerk
and Recorder’s office. The case was then referred to the City for with a request from the Building
Official for the City to abate the dangerous buildings on the property. The demolition work was
completed in early 2016 and the total cost incurred by the City was $17,386.00.
ALTERNATIVES:
If this resolution is not approved, the City will not be able to hold the public hearing required under
Section 903 of the Uniform Code for the Abatement of Dangerous Buildings prior to assessing
the demolition project costs and the City will not recover the costs associated with the completed
project.
RECOMMENDATION:
Approval of the Resolution.
