AN EMERGENCY ORDINANCE ESTABLISHING PROJECT NO.
CI2113 AND BUDGETING AND APPROPRIATING FUNDS
ACCEPTED AND DISTRIBUTED TO THE CITY OF PUEBLO
FROM THE U.S. TREASURY UNDER THE AMERICAN RESCUE
PLAN ACT INTO SAID PROJECT NO. CI2113
RECITALS
The following recitals are incorporated in and made a part of this Ordinance.
WHEREAS, the U.S. House of Representatives, on March 10, 2021, passed the U.S.
Senate-amended H.R. 1319 (P.L. 117-2) known as the American Rescue Plan Act (“ARPA”); and
WHEREAS, President Biden signed ARPA on March 11, 2021 and the statute became
law on that date; and
WHEREAS, ARPA provides $1.9 trillion in additional relief to respond to the novel
coronavirus (“COVID-19”); and
WHEREAS, based on the federal allocation formula, it is expected that the City of Pueblo
will receive approximately $36.7 million in ARPA funds from the U.S. Treasury as follows:
“First Tranche” on May 10, 2021
“Second Tranche” on May 10, 2022; and
WHEREAS, all funds distributed to the City under ARPA need to be appropriated into a
project fund with appropriate accounting with respect to the use and qualification of such funds;
and
WHEREAS, the City is obligated to maintain appropriated accounting with respect to use
of the distributed funds for eligible expenses and this Ordinance is in furtherance of meeting such
obligations; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
Project Number CI2113 is hereby established, and all distributed funds received from the
U.S. Treasury pursuant to ARPA by the City of Pueblo in an amount up to $36.7 million are
budgeted and appropriated to said project. Distributed funds shall only be used for payment of
eligible expenses.
SECTION 2.
With respect to any eligible expense paid to or from any other project or allotment, the
Director of Finance, with the approval of the Mayor and City Council, is authorized to transfer from
Project Number CI2113 to said project or allotment those distributed funds received by the City
for payment of such eligible expenses.
SECTION 3.
Savings Clause: The COVID-19 pandemic has been declared an emergency disaster by
the Mayor, the Governor of Colorado and the President of the United States. The immediate
enactment of this Ordinance is necessary in order to preserve and protect the health, safety and
welfare of the residents of the City. Pursuant to Sec. 3-20 of the City Charter, this Ordinance shall
become effective on the date of final action by the Mayor and City Council.

SUMMARY:
This Ordinance establishes Project No. CI2113 and budgets and appropriates up to $36.7 million
in funds which may be distributed to the City from the U.S. Treasury under the American Rescue
Plan Act (“ARPA”) for covered costs incurred or to be incurred during the period that begins on
March 11, 2021 (the date ARPA became law) and ends on December 31, 2024.

Not applicable to this Ordinance.
BACKGROUND:
The U.S. House of Representatives, on March 10, 2021, passed the U.S. Senate-amended H.R.
1319 (P.L. 117-2) known as the American Rescue Plan Act. President Biden signed ARPA on
March 11, 2021 and the statute became law on that date. ARPA provides $1.9 trillion in additional
relief to respond to the novel coronavirus (“COVID-19”). For the first time, all 19,000 municipal
governments in the U.S. are entitled to a direct, non-competitive federal formula grant from the
U.S. Treasury.
Based on the federal allocation formula, it is expected that the City of Pueblo will receive
approximately $36.7 million in ARPA funds from the U.S. Treasury as follows:
“First Tranche” on May 10, 2021
“Second Tranche” on May 10, 2022
All funds distributed to the City need to be appropriated into a project fund with appropriate
accounting with respect to the use and qualification of such funds.
FINANCIAL IMPLICATIONS:
It is expected that the City of Pueblo will receive approximately $36.7 million in federal funds from
the U.S. Treasury under ARPA.
