HomeMy WebLinkAbout09978ORDINANCE NO. 9978 AN ORDINANCE APPROVING AN AMENDMENT TO THE SUBDIVISION IMPROVEMENTS AGREEMENT WITH RESPECT TO PARKSIDE ESTATES AT BOULEVARD PARK, 2ND AMENDMENT SUBDIVISION AND AUTHORIZING THE MAYOR TO EXECUTE SAID AMENDMENT BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Amendment to Subdivision Improvements Agreement for the Amended Parkside Estates at Boulevard Park a/k/a Parkside Estates at Boulevard Park, 2nd Amendment (“Amendment”), a copy of which is attached hereto, having been approved as to form by the City Attorney, is hereby approved. The Mayor is authorized to execute and deliver said Amendment in the name of the City and the City Clerk is directed to affix the seal of the City thereto and attest same. SECTION 2. The City Clerk is directed to cause said Amendment to be recorded in the office of the Pueblo County Clerk and Recorder forthwith. SECTION 3. The officers and staff of the City are authorized to perform any and all acts consistent with this Ordinance and the attached Amendment which are necessary or desirable to implement the transactions described therein. SECTION 4. This Ordinance shall become effective on the date of final action by the Mayor and City Council. Hayes, P.E.; Director of Public Works SUBJECT: AN ORDINANCE APPROVING AN AMENDMENT TO THE SUBDIVISION IMPROVEMENTS AGREEMENT WITH RESPECT TO PARKSIDE ESTATES AT BOULEVARD PARK, 2ND AMENDMENT SUBDIVISION AND AUTHORIZING THE MAYOR TO EXECUTE SAID AMENDMENT SUMMARY: Upon approval by City Council and the Mayor, the attached Ordinance approves and authorizes the Mayor to execute an Amendment (Amendment No. 2) to the Subdivision Improvements Agreement for Amended Parkside Estates at Boulevard Park (dated July 20, 2007) requiring the nd Subdivision to construct W. 22 Street between Ruberson Drive and Spaulding Avenue. PREVIOUS COUNCIL ACTION: On December 11, 2000, by Ordinance 6625, City Council approved the Parkside Estates and Boulevard Park Subdivision which created 176 single-family lots. On November 27, 2006, by Ordinance No. 7542, City Council approved the Amended Parkside Estates at Boulevard Park Subdivision Plat and Subdivision Improvements Agreement which re- subdivided the land to create 61 single-family lots and one large parcel for school sites. On August 27, 2007, by Ordinance No. 7649, City Council approved the final plat of Parkside nd Estates at Boulevard Park 2 Amendment, including the Subdivision Improvements Agreement dated July 20, 2007, which re-platted 39.18 acres to facilitate the construction of limited residential development and Dolores Huerta Preparatory High School. BACKGROUND: CCA Building Corporation is planning to construct Ersilia Cruz Middle School in the Parkside Estates at Boulevard Park Subdivision. Based on a previous property boundary rearrangement, the development of the parcel triggers the requirement for widening W. 22nd Street and installing required public improvements between Ruberson Drive and Spaulding Avenue. This Ordinance will amend the Subdivision Improvements Agreement dated July 20, 2007 to include these required improvements. FINANCIAL IMPLICATIONS: There are no immediate financial implications to the City associated with this proposed ordinance. Once the roadway improvements are completed and accepted by the City, they will be added to the City’s road network inventory for ongoing operation and maintenance. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Ordinance. STAKEHOLDER PROCESS: City staff have cooperated with CCA Building Corporation to negotiate the terms of the Amendment. ALTERNATIVES: If this Ordinance is not approved, the Subdivision Improvements Agreement cannot be amended and the required public improvements will not be made. RECOMMENDATION: Recommend approval of the Ordinance. Ordinance 9978 AMENDMENT TO SUBDIVISION IMPROVEMENTS AGREEMENT (Parkside Estates at Boulevard Park, 2nd Amendment) Whereas, Pueblo, a municipal corporation (the "City") and CCA Building Corporation, as subdivider (the "Subdivider") entered into a Subdivision Improvements Agreement dated July 20, 2007 (the "Agreement"), for the Amended Parkside Estates at Boulevard Park a/k/a Parkside Estates at Boulevard Park, 2nd Amendment (the "Subdivision"). Now therefore, in consideration of the foregoing, the approval of the Agreement by City, and the mutual covenants contained herein, City and Subdivider agree as follows: 1. The capitalized terms in this Amendment shall have the same meaning as those terms are used in the Agreement unless the context clearly provides otherwise. 2. This Amendment shall be incorporated in and become a part of the Agreement and enforceable as provided in the Agreement and this Amendment. 3. The Required Public Improvements described in Exhibit 1 and Exhibit 2 to the Agreement includes the construction and installation of 22nd Street as more specifically identified in the construction plans attached hereto and labelled Exhibit 1 (herein the "22nd Street Improvements") which Subdivider acknowledges and agrees that Subdivider is presently required to construct and install pursuant to City's subdivision ordinances and the Agreement. The current estimate of costs for the 22nd Street Improvements is attached hereto and labelled Exhibit 2 ("Improvement Costs"). 4. Subdivider shall construct and install the 22nd Street Improvements on or before October 31, 2022. The 22nd Street Improvements shall not be deemed to have been constructed and installed unless all Required Public Improvements including Omitted Public Improvements, if applicable, have been constructed and installed and until after approval thereof by the City's Director of Public Works ("Director"). 5. Upon failure, refusal, or neglect of Subdivider or any subsequent owner of land within the Subdivision to timely construct and install the 22nd Street Improvements, no additional Building Permits shall be issued to Subdivider or the subsequent owner or to any other person to build or construct any building or structure in the Subdivision until such default is remedied to the satisfaction of the Director. In addition, the City may treat the amount of Improvement Costs, including any changes thereto due to Omitted Public Improvements, if applicable, or changes in costs with respect to any of the 22nd Street Improvements not constructed and/or approved by the Director as a debt due the City from the Subdivider or subsequent owner, which debt shall be a lien upon all the land in the Subdivision and notice of lien may be filed for record in the office of the County Clerk and Recorder at any time after such default. The Agreement, as amended by this Amendment, shall remain in full force and effect and the covenants of this Amendment shall run with the land within the Subdivision and shall extend to, be binding upon, and inure to the benefit of City and Subdivider and their respective heirs, personal representatives, successors, and assigns. 7. This Amendment is entered as a condition of approval of the Rearrangement of Property Boundaries in Parkside Estates at Boulevard Park, 2nd Amendment, and nothing contained in said Rearrangement shall be relied upon or construed to affect or in any manner limit the Agreement, as amended by this Amendment, and the covenants of this Amendment.
