ORDINANCE NO. 9973 AN ORDINANCE AMENDING ZONING RESTRICTIONS TO THE BELMONT PLACE PLANNED UNIT DEVELOPMENT GUIDE BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The zoning restrictions for the Belmont Place Planned Unit Development Guide upon passage of this Ordinance are hereby amended and shall apply to the following described property: THE WEST 1/2 OF THE SOUTHWEST 1/4 AND THAT PORTION OF THE WEST 1/2 OF THE NORTHWEST 1/4 IN SECTION 21, TOWNSHIP 20 SOUTH, RANGE 64 WEST OF THE 6TH PRINCIPAL MERIDIAN, LYING SOUTH OF THE SOUTHERLY RIGHT OF WAY LINE OF COLORADO STATE HIGHWAY NO. 47, COUNTY OF PUEBLO, STATE OF COLORADO SECTION 2. Gradisar, Mayor VIA: Marisa Stoller, City Clerk FROM: Scott Hobson, Acting Director of Planning and Community Development SUBJECT: AN ORDINANCE AMENDING ZONING RESTRICTIONS TO THE BELMONT PLACE PLANNED UNIT DEVELOPMENT GUIDE SUMMARY: The applicant is requesting to amend the Belmont Place Planned Unit Development Guide, updating the allowed uses based on statutory requirements, new Federal Communications regulations, increasing lot size, width, reducing front yard setbacks, reducing overall residential density, and including a mechanism with which future amendments to the PUD Development Guide are requested and approved. PREVIOUS COUNCIL ACTION: None. BACKGROUND: The subject site is currently unimproved and is located east of Troy Avenue and south of the Hwy 50 Bypass. The area was annexed into the City in 1972 and is identified as a Special Development Area by the Pueblo Comprehensive Plan. In 2002, the Planning and Zoning Commission approved the University Village South Master Development Plan (MP-02-3) that included this property. At that time, business, single-family, multi-family residential and mobile home uses were proposed. The site was zoned PUD in 2006 and was amended in 2007 to accommodate the realignment of the residential street pattern and trail alignment. The original PUD and the proposed PUD contain four land use areas that allow commercial, multifamily residential, single-family residential and park development. The proposed PUD Development Guide updates land uses according to current state and federal regulations, reduced front-yard setbacks. The previous iterations of the PUD Development Guide allowed a maximum of 12 dwelling units per acre in two of the mixed residential land use areas and a maximum of 6 units per acre in the lowest density residential land use areas, located between the future extensions of Nottingham Drive and Dick Trefz Street. The proposed PUD Development Guide Amendment allows a maximum of eight units per acre in all residential land use areas, totaling 411 residential units. The previous PUD allowed a maximum of 573 residential units; therefore, the residential density of the proposed PUD is decreased by 162 residential units and the commercial units allowed remain relatively unchanged. FINANCIAL IMPLICATIONS: There are no financial implications for the City. BOARD/COMMISSION RECOMMENDATION: The Planning and Zoning Commission, at their June 9th, 2021, Regular Meeting, voted 4-0 to recommend approval, Commissioners Avalos and Bailey absent. STAKEHOLDER PROCESS: The Planning Department sent out Notice of the Planning and Zoning Commission Public Hearing to all property owners located within 300 feet of the subject property. A Public Notice poster was placed on the subject property 15 days prior to the Public Hearing. ALTERNATIVES: If City Council does not approve this Ordinance the property would not be zoned in accordance with the Pueblo Municipal Code. Upon request of City Council, the Ordinance could be returned to the Planning and Zoning Commission for consideration of proposed modifications. RECOMMENDATION: Approval of the Ordinance. PROJECT NARRATIVE The intent of this document is to adjust development areas and guidelines to meet a different subdivision structure than originally prescribed. The same development concept is maintained with Commercial land uses on the north end adjacent to State Highway 47 and Single Family Residential land uses on the south end north of Constitution Rd. Areas between the commercial and single family are designated as Mulity-Family Residential. PHASING The Development has been divided into several phases to facilitate development. Please see the Land Use Map. DEVELOPMENT STANDARDS The PUD Development areas/zones have been re-designated as follows: COMMERCIAL DISTRICT: C-1 The proposed Commercial District is intended to provide medium-to-large scale retail as well as hotel/motel uses. MULTI-FAMILY NEIGHBORHOOD DISTRICT: MFN-1 The proposed Multi-Family Neighborhood District is intended to provide medium density (8 dwelling units per acre) residential and assisted living uses as well as complementary neighborhood office and retail uses available by Special Use Permit. SINGLE FAMILY RESIDENTIAL DISTRICT: SFG-1 The proposed Single Family Residential District is intended to provide low density (4 dwelling units per acre) with assisted living uses available by Special Use Permit. PAR K The proposed Park District is intended to provide areas for open space, trails, parks and utilities. A proposed trail system is included. Exhibit B presents the proposed Trip Generation calculations. WASTEWATER MASTER PLAN Sanitary sewer main lines have been Master Planned for the proposed development. Exhibit C contains the sewer main sizing calculations. Flows are generally to the south to the existing 18" dia. trunk line that serves the Villa Bella Development area north of Highway 47. However, two of the Commercial lots on the north end of the property may be served by the 8" main in Nottingham Dr. This plan includes a connection the proposed sewer in Nottingham Dr. tot he 18" trunk line at Design Point#3 (see map). DRAINAGE PLAN Stormwater drainage within this development is constrained by natural features mainly consisting of very large arroyos. Stormwater detention easements shall be designated at time of subdivision application. However, we have identified several areas that should be considered for major (or possibly regional) detention ponds. The FEMA designated 100-yr Flood Zone appears to have changed since the inception of the Belmont Place Development Guide and will present challenges in certain areas. See included map. SIGNAGE All Signage within the PUD development area shall per installed per the provisions of Section 17-10-06. (b), "Master Sign Program," Pueblo Municipal Code. FUTURE AMENDMENTS TO THE DEVELOPMENT PLAN The Property Owner shall have the right to make future Amendments to this PUD and Development Guide. Future Amendments shall not require consent from other owners of property located within the PUD boundaries. However, the Property Owner shall provide written notification of future amendments to all owners of property located within the PUD boundaries.
