HomeMy WebLinkAbout09971ORDINANCE NO. 9971 AN ORDINANCE APPROVING AND ACCEPTING A GRANT AGREEMENT BETWEEN THE CITY OF PUEBLO AND THE DENVER FOUNDATION FOR A GRANT AWARD IN THE AMOUNT OF $9,550 ON BEHALF OF THE PUEBLO YOUTH FOOD COUNCIL AND THE PUEBLO FOOD PROJECT, AND BUDGETING AND APPROPRIATING $9,550 TO PROJECT NO. CI2112 BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Grant Agreement Number DA-2021-93795 dated May 28, 2021 (“Agreement”) between the City of Pueblo, a Colorado Municipal Corporation, by and through the Pueblo Food Project on behalf of the Pueblo Youth Food Council, and the Denver Foundation, a copy of which is attached hereto, having been approved as to form by the City Attorney, is hereby approved. SECTION 2. The Mayor is hereby authorized to execute the Agreement on behalf of the City of Pueblo, the City Clerk shall affix the Seal of the City thereto and attest same, and any execution by electronic signature is attributable to the Mayor and the City of Pueblo. SECTION 3. Funds in the amount of $9,550.00 shall be accepted pursuant to the Agreement and budgeted and appropriated to Project No. CI2112. SECTION 4. The officers and staff of the City are hereby authorized to perform any and all acts consistent with this Ordinance and the attached Agreement to implement the transactions described therein. SECTION 5. This Ordinance shall become effective on the date of final action by the Mayor and City Council. Gradisar, Mayor SUBJECT: AN ORDINANCE APPROVING AND ACCEPTING A GRANT AGREEMENT BETWEEN THE CITY OF PUEBLO AND THE DENVER FOUNDATION FOR A GRANT AWARD IN THE AMOUNT OF $9,550 ON BEHALF OF THE PUEBLO YOUTH FOOD COUNCIL AND THE PUEBLO FOOD PROJECT, AND BUDGETING AND APPROPRIATING $9,550 TO PROJECT NO. CI2112 SUMMARY: Attached is an Ordinance approving and authorizing the City to accept a grant in the amount of $9,550 from the Denver Foundation to provide funds for emergency hunger relief work by the Pueblo Food Project during the COVID-19 emergency. This Ordinance budgets and appropriates the grant funds into Project No. CI2112. This Ordinance approves the Grant Agreement and check endorsement thereto. PREVIOUS COUNCIL ACTION: City Council previously approved Ordinance No. 9936 on May 24, 2021, approving a Trailhead Grant Award, establishing Project No. CI2112, and budgeting and appropriating grant funds to Project No. CI2112. BACKGROUND: The Pueblo Youth Food Council (also known as the Pueblo Fooducates) via the Pueblo Food Project applied for emergency hunger relief funds to respond to community needs during the COVID-19 emergency. The original grant proposal requested $20,000 from the Trailhead Institute, but only $10,450 was awarded. The Denver Foundation, in collaboration with the Trailhead Institute, requested to fund the remainder of the proposal, bringing the total award to $20,000. These funds are to be used in accordance with the submitted proposal. All activities are geared towards emergency hunger relief in Pueblo and lead by the Fooducates, overseen by the Pueblo Food Project. The City is the fiscal sponsor for and runs the Pueblo Food Project, which will be carrying out the activities for purposes of the grant. FINANCIAL IMPLICATIONS: There are no matching funds required for this grant. The City of Pueblo will receive the entire $9,550 on behalf of the Pueblo Food Project upon passage of the Ordinance. The total grant budget for Project No. CI2112 will become $20,000; $10,450 through Ordinance No. 9936 and $9,550.00 through this ordinance. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Ordinance. STAKEHOLDER PROCESS: Not applicable to this Ordinance. ALTERNATIVES: If the proposed Ordinance is not approved, the Pueblo Food Project will not receive the grant funds. RECOMMENDATION: Approval of the Ordinance. Accounting. For purposes of these grant terms, "grant funds" include the grant and any income earned thereon. Grantee will account for and maintain records of receipts and expenditures of the grant funds in accordance with generally accepted accounting principles. 2. Restrictions on Grant Use. Grantee will use the grant funds only for the purposes of the grant, and will comply with all applicable laws and regulations in administering and expending the grant funds. In no event will Grantee use any grant funds: (a) to lobby for or against, or otherwise to attempt to influence, government legislation; (b) to influence the outcome of any specific public election or to carry on, directly or indirectly, any voter registration drive; or (c) to undertake any activity other than for a charitable, educational or other tax-exempt purpose specified in section 170(c)(2)(B) of the Code. 3. Repayment. Grantee agrees to repay to The Gateway Fund II of The Denver Foundation any portion of the grant funds not used for the grant's purposes. 4. Additional Information. The Denver Foundation and The Gateway Fund II may request Grantee to provide such information as is necessary or appropriate for determining that the grant funds are being used for the purposes intended.
