A RESOLUTION APPROVING AN AMENDMENT TO A
PROFESSIONAL ENGINEERING SERVICES AGREEMENT
BETWEEN PUEBLO, A MUNICIPAL CORPORATION, AND
SHORT-ELLIOTT-HENDRICKSON, INC, IN THE AMOUNT OF
$25,006.70 RELATED TO PROJECT NO. 20-024 (PL2003), TAP
M086-082 (22971), NORTHERN AVENUE STREETSCAPE/TRAIL
PHASE 3 AND AUTHORIZING THE PURCHASING AGENT TO
EXECUTE SAME
WHEREAS, Project No. 20-024 (PL2003), TAP M086-082 (22971) Northern Avenue
Streetscape/Trail Phase 3 Project was awarded to Short Elliott Hendrickson, Inc, on August 25,
2020;
WHEREAS, additional design and engineering work contemplated by the Amendment is
needed; and
WHEREAS, it is in the best interests of the City to proceed with and complete such design
in the manner herein provided; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Amendment dated April 27, 2021, by and between the City of Pueblo, a Municipal
Corporation, and Short Elliott Hendrickson, Inc., a Colorado Corporation, a copy of which is
attached hereto, having been approved as to form by the City Attorney, is hereby approved, and
City Council authorizes the additional work contemplated by the Amendment to be performed in
the amount of $25,006.70.
SECTION 3.
Funds in the amount of $25,006.70 will paid from Project PL2003.
SECTION 4.
The Purchasing Agent is hereby authorized to execute the Amendment on behalf of
Pueblo, a Municipal Corporation, and the City Clerk shall affix the seal of the City thereto and
attest the same.
SECTION 5.
The officers and staff of the City are authorized to perform any and all acts consistent with
the intent of this Resolution and the contract to implement the transactions described therein.
SECTION 6.
This Resolution shall become effective immediately upon passage and approval.

SUMMARY:
This Resolution increases the professional engineering services agreement awarded to Short-
Elliott-Hendrickson, Inc. (SEH), in the amount of $25,006.70 for Project No. 20-024 (PL2003),
TAP M086-082 (22971), Northern Avenue Streetscape/Trail Phase 3.
PREVIOUS COUNCIL ACTION:
Resolution 14465 passed and approved for original agreement for professional engineering
services.
BACKGROUND:
In general, this Amendment will provide for additional design and engineering work to add an
alternate design at the intersections of Cambridge Ave & Northern Ave and S. Prairie Ave &
Northern Ave. In order to complete the additional designs, the consultant, SEH, will need to
perform additional field work, and design engineering. Based on the preferred location of the
traffic signal pole at the southwest corner of S. Prairie Ave and Northern Ave, property acquisition
is required. As part of this Amendment, the consultant will also be required to prepare Right-of-
Way plans to meet CDOT requirements.
FINANCIAL IMPLICATIONS:
The funding for the original agreement ($63,037.19) and the amendment ($25,006.70) will be paid
from the Northern Avenue Streetscape/Trail Phase 3 Project, PL2003.
BOARD/COMMISSION RECOMMENDATION:
Not applicable.
STAKEHOLDER PROCESS:
Not applicable.
ALTERNATIVES:
Denial of this Resolution will result in design and engineering being inadequate to complete
CDOT requirements which could result in the loss of committee CDOT grant funding.
RECOMMENDATION:
Approval of the Resolution.

AMENDMENT NO. 1 TO THE
AGREEMENT FOR PROFESSIONAL ENGINEERING SERVICES
BY AND BETWEEN
CITY OF PUEBLO AND SHORT-ELLIOTT-HENDRICKSON, INC.
This Amendment No. 1 to the Agreement for Professional Engineering Services
("Amendment") is executed to be effective as of the 13th day of July, 2021 by and between the City of
Pueblo, Colorado, a Colorado Municipal Corporation ("Owner") and Short-Elliott-Hendrickson, Inc., a
registered Minnesota Corporation authorized to do business in the State of Colorado("Engineer"). Owner
and Engineer are sometimes referred to herein as a "Party" and collectively, as the "Parties."
WITNESSETH THAT:
WHEREAS,Owner and Engineer entered into that certain Agreement for Professional Engineering
Services dated the 25th day of August, 2020(the "Agreement") for Bid 20-024(PL2003), TAP M086-082
(22971),Northern Avenue Trail Phase 3; and
WHEREAS, Owner and Engineer desire to modify the Agreement pursuant to the provisions set
forth herein.
NOW, THEREFORE, in consideration of the foregoing premises, the mutual promises set forth
herein and other good and valuable consideration, the receipt and adequacy of which is hereby
acknowledged, Owner and Engineer hereby agree to the following:
AGREEMENT
1. Details of Additional Work. The Northern Avenue Trail — Phase 3 alignment and
associated improvements will be located in the City of Pueblo right-of-way along the north side of Northern
Avenue from Cambridge Avenue to Prairie Avenue; along the west side of Prairie Avenue from Northern
Avenue to approximately Mesa Avenue; including the northern median reconstruction at Mesa Avenue and
Prairie; and signal improvements for northwest and southwest corners of the intersection of Prairie Avenue
and Northern Avenue.The trail will consist of a 10' concrete trail with associated landscape and streetscape
improvements along Northern Avenue, in accordance with grant submitted to Colorado Department of
Transportation. (See attached Scope of Work.)
2. Cost of Services. Owner will pay Engineer as full compensation for all services required
in the Scope of Work to be performed by Engineer under this Amendment No. l for a maximum amount
of$25,006.70 as set forth in the attached Additional Services- Fee Schedule.
3. Time for Performance. Engineer's obligation to render services shall continue for such
period of time as may reasonably be required for completion of the work contemplated in the Scope of
Work(attached)and as outlined in the Work Schedule dated January 18, 2021. Owner and Engineer may
decrease or extend Work Schedule as needed to complete all tasks as identified in the Scope of Work by
mutual written agreement.
4. Successors and Assigns. This Amendment shall be binding upon and inure to the benefit
of the Parties hereto and their respective successors and assigns.
5. Ratification. Except as expressly modified by this Amendment No. 1,the Agreement shall
remain in full force and effect. Except as modified by this Amendment No. 1, any obligations to be
performed under the Agreement by either party are not waived nor excused in any manner but shall be

performed in accordance with the terms and conditions of the Agreement as it existed prior to this
Amendment No. 1.
6. Counterparts. This Amendment may be executed in one or more counterparts, each of
which shall be deemed an original and all of which shall constitute one and the same document with the
same effect as if all Parties had signed the same original. The Parties further agree that transmission of this
Amendment by any electronic format,telecopy or via email in a PDF format,shall be deemed transmission
of the original Amendment for all purposes. Electronic signatures shall be deemed valid and binding to the
same extent as the original

as of the effective date.

SCOPE OF WORK—
ADDITIONAL SERVICES
Northern Avenue Trail Phase III
Project Understanding and Limits:The Northern Avenue Trail—Phase III alignment and associated
improvements will be located in the City of Pueblo Right-of-Way along the north side of Northern
Avenue from Cambridge Avenue to Prairie Avenue; along the west side of Prairie Avenue from
NorthernAvenue to approximately Mesa Avenue; including the northern median reconstruction at
Mesa Avenue and Prairie; and signal improvements for northwest and southwest corners of
intersection of Prairie Avenue and Northern Avenue.The trail will consist of a 10'concrete trail with
associated landscape andstreetscape improvements along Northern Avenue, in accordance with grant
submitted to Colorado Department of Transportation.
Scope:The Basis Services provided by SEH as set forth herein is provided subject to the attached
Agreement for Professional Services.
Unless task is explicitly included in scope of work, task is explicitly excluded.
Project Management
1. Attend two(2) project review meetings with City of Pueblo staff to review alternative
concepts for Cambridge Avenue/Northern Avenue northeast corner and two(2)alternative
signal location concepts for Prairie Avenue/Northern Avenue southwest corner.
2. Project management to include records management, archiving and communications.
3. Monthly invoicing and status reporting throughout course of project.
4. Maintaining project budget and schedule.
Preliminary Design
1. Design Survey- In order to maintain safety of the survey crews on the busy Northern Avenue and
Prairie Avenue corridor,SEH proposes utilizing drone technology.
a. Perform a topographic survey.
i. SEH will research and prepare initial survey data for upload to GPS equipment.
ii. SEH will establish horizontal and vertical control based on NGS monuments
located in the field. Once control is established,three monuments will be
positioned outside of the project limits and coordinates and elevations will be
associated with each monument.
iii. Once the control is established, ten (10)Ground Control Points (GCP)—Aerial
Targets will be set.
iv. Perform Drone Flight using Matric M210 V2_RTK UAS with Zenmuse X7 Camera.
1. Flight planning.
2. Drone flight mission of Northern Avenue corridor between Cambridge
Avenue and Prairie Avenue, collecting aerial data using 3D modeling.
a. Median
b. Supplemental intersection topography of Cambridge Avenue
and Prairie Avenue.
3. Process flight data.

v. Perform ground true survey for confirmation and calibration of drone survey at
critical points.
1. Utility structures and locates.
a. SEH will contract with a private utility locator for the purpose of
locating underground utilities. Once marked on the ground,
SEH will perform ground survey of markings.
2. Curb flowlines at BC/EC/mid-points.
b. A final topographic map will be provided showing all the above-mentioned features
along with one-foot contours.
2. Prepare intersection alternative concept for the northeast corner of Cambridge Avenue and
Northern Avenue to be incorporated as Add Alternate within final construction documents.
a. Curb line 'bump-out'
b. ADA compliance for ramp configuration.
c. Pedestrian signal relocation layout.
3. Prepare up to two(2)alternative concepts for signal relocation at southwest corner of Prairie
Avenue and Northern Avenue intersection.
a. Signal location.
b. Provide assessment of acquisition needs for discussion with City staff.
c. Provide assessment of constructability concerns for discussion with City staff.
4. Prepare design and details for resurfacing of Northern Avenue median between Cambridge
Avenue and Prairie Avenue.
Final Design(FOR—Final Office Review)
1. Prepare CDOT Format Right-of-Way Plans
a. Perform field work to identify required control for development of right-of-way plans.
b. Prepare right-of-way plans for the purpose of property/easement acquisition in CDOT
approved format to include:
i. Title Sheet
ii. Ownership Tabulation Sheets
iii. Project Control Diagram
iv. Land Survey Control Diagram
v. Monumentation Sheets
vi. Plan Sheets
vii. Ownership Map
c. Attend one (1) Right-of-Way Plan Review Meeting with CDOT and City's property
acquisition staff.
i. Revise and submit final ROW plans for approval by CDOT.
2. An Add Alternate design for Cambridge Avenue northeast corner and Northern Avenue
median design will be included in the complete set of construction documents required for a
CDOT FOR(Final Office Review)submittal.
Final PS&E Submittal
1. An Add Alternate design for Cambridge Avenue northeast corner and Northern Avenue
median design will be included in the complete set of construction documents required for a
CDOT PS&E (Plans, Specifications and Estimate)submittal.
