HomeMy WebLinkAbout09958 ORDINANCE NO. 9958 AN ORDINANCE AMENDING THE FISCAL YEAR 2021 STAFFING ORDINANCE BY ADDING A POSITION FOR TRAINING PURPOSES WITHIN THE LAW DEPARTMENT WHEREAS, it is necessary to revise the positions for the ultimate efficiency and functionality for the City’s Law Department; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (brackets indicate matter being deleted, underscore indicates matter being added) SECTION 1. The following section captioned “Law Department” “of Ordinance No. 9852, being the 2021 Staffing Ordinance, is amended as follows: The following positions shall be authorized for FY 2021: Law Department City Attorney 1 Senior Assistant City Attorney 1 Assistant City Attorney I \[2\] 3 Assistant City Attorney II 2 Legal Assistant 1 Legal Support Assistant 1 Total \[8\] 9 SECTION 2. Effective December 2, 2021, the position established pursuant to above Section 1 shall be abolished and the 2021 Staffing Ordinance shall be amended as follows: Law Department City Attorney 1 Senior Assistant City Attorney 1 Assistant City Attorney I \[3\] 2 Assistant City Attorney II 2 Legal Assistant 1 Legal Support Assistant 1 Total \[9\] 8 SECTION 3. The officers and staff of the City are authorized to perform any and all acts consistent with the intent of this Ordinance to implement and transactions described therein. SECTION 4. This Ordinance shall be deemed to amend the Fiscal Year 2021 Budget and staffing with respect to the number and allocation of positions within the City’s Law Department and shall become effective on the date of final action by the Mayor and City Council. Gradisar VIA: Marisa Stoller, City Clerk FROM: Daniel Kogovsek, City Attorney Marisa Pacheco, Human Resources Director SUBJECT: AN ORDINANCE AMENDING THE FISCAL YEAR 2021 STAFFING ORDINANCE BY ADDING A POSITION FOR TRAINING PURPOSES WITHIN THE LAW DEPARTMENT SUMMARY: The Law Department requests to temporarily increase the staffing level of the department by one (1) full time equivalent (FTE) for training purposes. The classification shall be Assistant City Attorney I and the additional FTE shall be abolished upon the anticipated retirement of the Assistant City Attorney staff member assigned to the Pueblo Municipal Court on December 1, 2021. PREVIOUS COUNCIL ACTION: On December 28, 2020 Ordinance No. 9852 was approved by City Council. This Ordinance provided authorized staffing for Fiscal Year 2021. BACKGROUND: The Assistant City Attorney assigned to Municipal Court prosecution activities has announced plans to retire on December 1, 2021. There is no mechanism in ordinance to allow for temporary overfilling of a position in order to facilitate critical training and transition activities. Therefore, the City Attorney requests the addition of an Assistant City Attorney I FTE on a temporary basis to accomplish necessary training. It is anticipated that the position requested by this ordinance will be filled on or around November 1, 2021 and will be trained during the month of November for those job duties that will be assigned. It is further requested that the additional FTE be abolished upon separation of the current Assistant City Attorney II assigned to Municipal Court via retirement. FINANCIAL IMPLICATIONS: Funding for the wages and benefits for the position will come from the General Fund and can be covered by the Law Department’s existing budget. The cost for the one month of the additional position is approximately $8,298.91. BOARD/COMMISSION RECOMMENDATION: Not Applicable. STAKEHOLDER PROCESS: None. ALTERNATIVES: The no action alternative would be to retain the current staffing level which would eliminate any opportunity to train a newly hired Assistant City Attorney I. RECOMMENDATION: Approval of the Ordinance.
