A RESOLUTION AWARDING A CONSTRUCTION CONTRACT IN
THE AMOUNT OF $57,092.25 TO K.R. SWERDFEGER
CONSTRUCTION, INC., FOR EMERGENCY STORM SEWER
POINT REPAIR AT 14TH STREET AND PORTLAND AVENUE
AND AUTHORIZING THE PURCHASING AGENT TO EXECUTE
SAME
WHEREAS, an emergency storm sewer repair was authorized by the Mayor of The City
of Pueblo in accordance with Section 1-10-5 of the Pueblo Municipal Code; and
WHEREAS, the point repair work was awarded to K.R. Swerdfeger Construction, Inc.,
under the 2020-2022 Storm Sewer Point Repair contract; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:

This contract is for repair of stormwater pipes and a manhole at the intersection of 14
Street and Portland Avenue by K.R. Swerdfeger Construction, Inc., Project No. 20-019 (SW1501)
and is hereby awarded to said bidder in the amount of $57,092.25.
SECTION 2.
Funds for Project 20-019 (SW1501) shall be from the Stormwater Utility Fund.
SECTION 3.
The Purchasing Agent is hereby authorized to execute said contract on behalf of Pueblo,
A Municipal Corporation, and the City Clerk shall affix the seal of the City thereto and attest the
same.
SECTION 4.
The officers and staff of the City are authorized to perform any and all acts consistent with
the intent of this Resolution and the contract to implement the transactions described therein.
Furthermore, all actions previously taken by officers and staff of the City consistent with the
contract including any payments authorized under the contract are hereby ratified.
SECTION 5.
This Resolution shall become effective immediately upon passage and approval.

SUMMARY:
This Resolution awards a construction contract to K.R. Swerdfeger Construction, Inc. for
emergency storm sewer point repair at 14th Street and Portland Avenue.
PREVIOUS COUNCIL ACTION:
None
BACKGROUND:
The Stormwater Utility was notified that there was a sinkhole developing at the intersection of
14th Street and Portland Avenue near a stormwater manhole. Televised inspection of the
Stormwater infrastructure revealed structural defects in the main line and a lateral. An emergency
repair was required to repair the defective stormwater pipes, manhole, and the appurtenant
surface repairs.
The bid summary sheet with the unit prices for the estimated work performed by K.R. Swerdfeger
Construction, Inc. and the change order for the project are attached. This work was performed
under the 2020-2022 Storm Sewer Point Repair Ordinance #9755 which contractors were
qualified via competitive bid.
During the project the costs were modified as noted on the attached change order.
The cost breakdown for the project is as follows:

FINANCIAL IMPLICATIONS:
Funding for this project came from the Stormwater Utility budget. Funding was available and had
been budgeted, appropriated, and allocated to Project No. 20-019 (SW1501).

Reason For Change:
The 18 inch lateral pipe from the manhole to the northeast corner was able to be installed without damaging the
existing brick inlet.
This document shall become an amendment to the contract and all provisions of the contract apply hereto.
The adjustment to the contract amount and contract time, if any, made by this change order constitutes full
compensation to the Contractor for the work included within this change order, and Contractor's acceptance
hereof constitutes a waiver of any contract and equitable claims on account thereof.
