AN ORDINANCE ACCEPTING FUNDS FROM THE PUEBLO
CONSORTIUM’S HOME INVESTMENT PARTNERSHIP GRANT,
BUDGETING AND APPROPRIATING FUNDS IN THE AMOUNT
OF $7,500 INTO PROJECT NO. HO2001, ACCEPTING AND
APPROVING AMENDMENT NO. 2 TO THE PROFESSIONAL
SERVICE AGREEMENT BETWEEN THE CITY OF PUEBLO, A
MUNICIPAL CORPORATION, AND NORTHEAST AND BUCKS
CO. DBA MULLIN AND LONERGAN ASSOCIATES INC., A
PENNSYLVANIA CORPORATION, FOR THE PREPARATION OF
THE 2021 ANNUAL ACTION PLAN TO BE SUBMITTED TO THE
U.S. DEPARTMENT OF HOUSING AND URBAN
DEVELOPMENT, AND AUTHORIZING THE MAYOR TO
EXECUTE SAME
WHEREAS, there exists a need to conduct the 2021 Annual Action Plan for the Pueblo
community; and
WHEREAS, the U.S. Department of Housing and Urban Development requires a 2021
Annual Action Plan to receive grant funding; and
WHEREAS, the City of Pueblo, designated as an entitlement city by the U.S. Department
of Housing and Urban Development, wishes to have access to future funding allocations; NOW,
THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
HOME Investment Partnership grants funds in the amount of $7,500.00 are hereby
budgeted and appropriated to Project No. HO2001.
SECTION 2.
Amendment No. 2 to the Agreement for Professional Services (“Amendment”) between
Northeast and Bucks Co. dba Mullin and Lonergan Associates Incorporated, a Pennsylvania
Corporation, and the City of Pueblo, a Municipal Corporation, in the amount of $7,500.00, for a
total contract amount of $51,620.00 with $4,412.00 set aside in contingencies, for the
development of the 2021 Annual Action Plan, a copy of which is attached hereto and incorporated
herein, having been approved as to form by the City Attorney, is hereby approved.
SECTION 3.
The Mayor is hereby authorized to execute the Amendment in the name and on behalf of
the City of Pueblo, where the Mayor may execute the Amendment by electronic signature and
such electronic signature shall be attributable to the Mayor and the City of Pueblo.
SECTION 4.
The officers and staff of the City are authorized to perform any and all acts consistent with
this Ordinance to implement the policies and procedures described herein.
SECTION 5.
If any section, paragraph, clause, or provision of this Ordinance shall for any reason be
held to be invalid or unenforceable, the invalidity or unenforceability of such section, paragraph,
clause, or provision shall not affect any of the remaining provisions of this Ordinance.
SECTION 6.
This Ordinance shall become effective on the date of final action by the Mayor and City
Council.

SUMMARY:
This Ordinance accepts HOME Investment Partnership grant funds and budgets and appropriates
the additional $7,500 to Project No. HO2001, and authorizes Amendment No. 2 to the Agreement
for Professional Services between the City of Pueblo and Northeast and Bucks Co. dba Mullin
and Lonergan Associates Inc. for the preparation of the 2021 Annual Action Plan.
PREVIOUS COUNCIL ACTION:
City Council approved Ordinance No. 9642 on January 29, 2020, authorizing the professional
services agreement between the City of Pueblo and Northeast and Bucks Co. dba Mullin and
Lonergan Incorporated, and the 2020-2024 Consolidated Plan, 2020 Annual Action Plan, and the
2020-2024 Analysis of Impediments.
BACKGROUND:
HUD requires grantees to conduct a needs assessment of the community every five-years in
order to receive U.S. Department of Housing and Urban Development (“HUD”) grant funds. The
Consolidated Plan is the finished product of the needs assessment. There are five annual action
plans (“AAP”) within a Consolidated Plan. The AAP is submitted to HUD, identifying the projects
the City intends to undertake in the coming year. To be eligible for funding, the projects must
address a need identified in the Consolidated Plan.
FINANCIAL IMPLICATIONS:
HOME Investment Partnership Grant funds are available for this project.
BOARD/COMMISSION RECOMMENDATION:
The Citizen’s Advisory Committee has been apprised of the expanded role required of the
committee members during the Con-Plan process, but no formal action was required of the
committee.
STAKEHOLDER PROCESS:
Not applicable to this Ordinance.
ALTERNATIVES:
The City Council can choose not to amend the project.
RECOMMENDATION:
Approval of the Ordinance.

AMENDMENT#2
TO AGREEMENT FOR PROFESSIONAL SERVICES
BY AND BETWEEN
THE CITY OF PUEBLO, CO
AND MULLIN & LONERGAN ASSOCIATES, INC.
This Amendment#2,entered into as of this 24" day of ee:?;.t ,2021("Effective Date"),
by and between the City of Pueblo, CO, a Municipal Corporation, hereinafter referred to as the
City, and Northeast and Bucks Co. dba Mullin & Lonergan Associates, Incorporated, a
Pennsylvania Corporation, hereinafter referred to as the Consultant.
WITNESSETH THAT:
WHEREAS, the City is a grantee and recipient of federal funds under the Community
Development Block Grant Program (CDBG) and the HOME Investment Partnerships Program
(HOME); and
WHEREAS, the City desires to utilize a part of the HOME funds for additional professional
services and assistance in accordance with 24 C.F.R. § 92.207; and
WHEREAS, the City entered into the Agreement for Professional Services ("Agreement")
with the Consultant on January 27,2020 to prepare a HUD Five Year Consolidated Plan ("CP"),an
Annual Action Plan for Fiscal Year ("FY") 2020, and an Analysis of Impediments to Fair Housing;
and
WHEREAS, City and Consultant entered into Amendment#1 to the Agreement on May 5,
2020 to allow for Consultant to provide hourly rate technical services to the City for the CDBG
and HOME Programs; and
WHEREAS, the City wishes to further amend the Agreement to increase the contract
amount to allow for the preparation of the City's FY 2021 HUD Annual Action Plan and to extend
the length of the Agreement to allow for the provision of this service.
NOW,THEREFORE, the parties to this contract do mutually agree as follows:
1. Under Schedule 2, Cost/Pricing, of the Agreement, the total contract amount will be
increased by a lump sum fee of$7,500 for the preparation of the City's FY 2021 HUD
Annual Action Plan.
2. The Annual Action Plan for FY 2021 will be prepared on the same schedule as the
current Five-Year CP and Annual Action Plan for FY 2020, as set out in Schedule 3,
Project Schedule, of the Agreement except applied to 2021, and will be submitted to
HUD no later than August 6, 2021 in IDIS as required by HUD.
3. The Agreement end date is hereby extended until December 31, 2021.
4. All other terms of the Agreement as amended will remain the same.
The parties to this agreement intend to be legally bound as of the Effective Date and subject to
2 CFR Part 200.
