HomeMy WebLinkAbout09911ORDINANCE NO. 9911 AN ORDINANCE APPROVING AND AUTHORIZING THE EXECUTION OF FY2020 FEDERAL 5307 GRANT AGREEMENT, FY2020 FEDERAL 5307 ER GRANT AGREEMENT, AND FY2020 FEDERAL 5307 CARES GRANT AGREEMENT BETWEEN THE CITY OF PUEBLO AND THE UNITED STATES OF AMERICA, DEPARTMENT OF TRANSPORTATION, FEDERAL TRANSIT ADMINISTRATION BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The FY2020 Federal 5307 Grant Agreement, FY2020 Federal 5307 ER Grant Agreement, and FY2020 Federal 5307 CARES Act Grant Agreement (“Grant Agreements”) between the City of Pueblo and the United States of America, Department of Transportation, Federal Transit Administration, for the purpose of subsidizing Pueblo Transit’s fiscal year 2020 operational expenses, copies of which are attached hereto, having been approved as to form by the City Attorney, are hereby approved. SECTION 2. The Mayor is authorized to execute and deliver the Grant Agreements in the name of the City and the City Clerk is directed to affix the seal of the City thereto and attest same. SECTION 3. The officers and staff of the City are authorized to perform any and all acts consistent with the intent of this Ordinance and the attached Grant Agreements to implement the transactions described herein. SECTION 4. This Ordinance shall become effective on the date of final action by the Mayor and City Council. Gradisar, Mayor VIA: Belinda Kimball, Acting City Clerk FROM: Benjamin Valdez, Transit Director SUBJECT: AN ORDINANCE APPROVING AND AUTHORIZING THE EXECUTION OF FY2020 FEDERAL 5307 GRANT AGREEMENT, FY2020 FEDERAL 5307 ER GRANT AGREEMENT, AND FY2020 FEDERAL 5307 CARES GRANT AGREEMENT BETWEEN THE CITY OF PUEBLO AND THE UNITED STATES OF AMERICA, DEPARTMENT OF TRANSPORTATION, FEDERAL TRANSIT ADMINISTRATION SUMMARY: The attached Grant Agreements between the City of Pueblo and the United States of America, Department of Transportation, Federal Transit Administration, are for the purpose of subsidizing Pueblo Transit’s fiscal year 2020 operational expenses. PREVIOUS COUNCIL ACTION: Council has previously approved the past operating grant between the City of Pueblo and the Federal Transit Administration to subsidize the City’s mass transit system. City staff presentation at the September 21, 2020 Work Session with respect to Future Transit Administrations and Maintenance and Facility (“Transit A&M Facility”). BACKGROUND: The City had budgeted $2,315,788.00 to match federal funding for operation of Pueblo Transit for fiscal year 2020. In response to COVID-19, the federal government made additional funds available for transit agencies. The Grant Agreements presented by this Ordinance cover the operation of Pueblo Transit for fiscal year 2020 but at a much lower match requirement ($432,289.00) based on such federal funding provided in response to COVID-19. The difference between the budgeted match of $2,315,788 and the actual match is approximately $1,081,078.30. By separate Ordinance, the administration is requesting that said amount of $1,234,709.00be set aside and appropriated for funding the Future Transit A&M Facility. There will be an additional Ordinance to establish project(s) and to Budget and Appropriate the 4307E and CARES Act Grand funding. FINANCIAL IMPLICATIONS: With the increase of funding due to COVID-19, the federal government has adjusted the 5307 Grant Programs and funding requirements, to reduce local match requirement while increasing FTA’s share of funds. The total City share for all three Grants is $432,289.00. The City share of funds are available in the Transit Operating fund. GRANT OUTLINE:  FY 2020 Federal 5307 – Total Award $1,924,597.00  FY2020 Federal 5307 ER – Total Award $252,883.00. FTA 100%  FY2020 Federal 5307 CARES ACT – Total Award $4,545,991.00. FTA 100% BOARD/COMMISSION RECOMMENDATION: Pueblo Transit Board recommends approval. STAKEHOLDER PROCESS: Not applicable. ALTERNATIVES: The alternative shall this Ordinance not pass, the City of Pueblo will be responsible for all expenses incurred in FY 2020. RECOMMENDATION: Approval of the Ordinance.
