HomeMy WebLinkAbout04936 A ORDINANCE NO. 4936 AN ORDINANCE RELATING TO THE PUEBLO COMMISSION ON ENERGY AND AMENDING CHAPTER 5 OF TITLE II OF THE 1971 CODE OF ORDINANCES BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: (Brackets indicate material being deleted, underscoring indicates material being added) SECTION 1. Section 2-5-2 of Chapter 5 of Title II of the 1971 Code of Ordinances of the City of Pueblo is hereby amended to read as follows : "2-5-2 : ESTABLISHMENT, MEMBERSHIP AND FUNDS - PUEBLO COMMISSION ON ENERGY There is hereby created the Pueblo Commission on Energy as an advisory commission to the City Council. [ , which] The Commission shall consist of sixteen members to serve without compensation, who are broadly representative of the energy related industries in the community and equally represen- tative of the consumer interest. The City Council shall, by Resolution, appoint the members of the Commission, five of whom shall serve a term of two years, five of whom shall each serve a term of three years , and six of whom shall each serve a term of four years. All succeeding appointments shall be for terms of four years. The Commission shall select a chairman [from among its members] and [may fill] such other offices as it may determine necessary from among its members. The expense for carrying on the Commission' s activities shall be paid out of the funds of the City as might be appropriated for such purpose by the City Council. " SECTION 2. Section 2-5-4 of Chapter 5 of Title II of the 1971 Code of Ordinances of the City of Pueblo is hereby amended to read as follows : "2-5-4: POWERS AND DUTIES The powers and duties of the Commission shall be as follows : (a) To advise Council in regard to energy matters. (b) To act as a clearing house for information on energy, its uses, regulation and development. (c) To, at the direction of the City Council, hold hearings, request without the power of subpoena the attendance of witnesses, hear the statements of any interested person, and to request without the power of subpoena the production of any evidence relating to any matter under investi- gation or in question. (d) To make periodic reports to the Council on its activities. (e) To develop a community awareness program as to the results of effective conservation practices. (f) To consult and cooperate with the various governmental and private agencies , including the Board of Education, in developing courses of instruction for presentation in public and private schools, public libraries, museums and other suitable places. [ (g) To seek the assistance of such technical and professional personnel as it may determine necessary to assist it in the performance of its duties and purposes. ] [ (h) ] (g) To submit an annual report to the City manager and City Council. [ (i) ] (h) To adopt, amend, [publish] and rescind such rules and regulations [regarding] for the operation of the Commission as are consistent with the powers and duties [outlined in the Charter and Ordinances of the City of Pueblo. ] of the Commission as expressly granted herein. " SECTION 3 . Section 2-5-6 of Chapter 5 of Title II of the 1971 Code of Ordinances of the City of Pueblo is hereby amended to read as follows : "2-5-6 : APPOINTMENT OF STAFF [The City Council may provide for personnel as may be necessary to effectuate the purposes of this Chapter. Such personnel to be appointed in the manner provided by Charter and Ordinances of the City of Pueblo. ] The Commission shall have no regular staff or personnel unless specifically authorized by the City Council by resolution.
