HomeMy WebLinkAbout04299 AMENDED 3-14-77 ORDINANCE NO. 4299 AN ORDINANCE AMENDING TITLE II OF THE 1971 CODE OF ORDINANCES OF PUEBLO, COLORADO, RE- LATING TO THE ESTABLISHMENT OF THE PUEBLO COMMISSION ON ENERGY AND SETTING FORTH THE DUTIES AND RESPONSIBILITIES OF SUCH COMMISSION. BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: (Brackets indicate material to be deleted, underscoring indicates material to be added) SECTION 1. Title II of the Code of Ordinances of the City of Pueblo is hereby amended by adding Chapter 5 and numbered Sections 2-5-1 through 2-5-7, inclusive, which said sections shall read as follows: PUEBLO COMMISSION ON ENERGY SECTION SUBJECT 1 Declaration of Policy 7 Establishment, Membership and Funds - Pueblo Commission on Energy 3 Functions of Commissions Powers and Duties 5 Findings and Recommendations 6 Appointment of Staff 7 Relation to City Departments and Agencies 1. DECLARATION OF POLICY This Chapter is enacted to provide an entity through which the City of Pueblo may officially encourage and bring about better and more effective use of energy in all its forms within the City of Pueblo and to aid in the development of contingency plans as may be necessary in the event of emergency energy shortages. 2 . ESTABLISHMENT, MEMBERSHIP AND FUNDS - PUEBLO COMMISSION ON ENERGY There is hereby created the Pueblo Commission on Energy, which shall consist of sixteen members to serve without compensation, who are broadly representative of the energy related industries in the community and equally representative of the consumer interest. The City Council shall, by Resolution, appoint the members of the Commis- sion, five of whom shall each serve a term of two years, five of whom shall each serve a term of three years, and six of whom shall each serve a term of four years. All succeeding appointments shall be for terms of four years. The Commission shall select a chairman from among its members and may fill such other offices as it may determine necessary. The expense for carrying on the Commission' s activities shall be paid out of the funds of the City as might be appropriated for such purpose by the City Council. 3 . FUNCTIONS OF THE COMMISSION The functions of the Commission shall be to foster the concept of energy conservation and understanding among the citizens of the City of Pueblo, and to encourage and disseminate information as may be appropriate to this purpose; to cooperate with State and Federal agencies and non-governmental organizations having like or kindred functions; to make such investigations and studies in the field of energy conservation as in the judgment of the Commission will aid in effectuating its general purpose; and to recommend programs, activities and legislation to the City Council to carry out the functions of the Commission. 4 . POWERS AND DUTIES The powers and duties of the Commission shall be as follows: (a) To advise Council in regard to energy matters. (b) To act as a clearing house for information on energy, its uses, regulation and development. (c) To, at the direction of the City Council, hold hearings, re- quest without the power of subpoena the attendance of witnes- ses, hear the statements of any interested person, and to re- quest without the power of subpoena the production of any evi- dence relating to any matter under investigation or in question. (d) To make periodic reports to the Council on its activities. (e) To develop a community awareness program as to the results of effective conservation practices. -2- 1 � (f) To cooperate with the various governmental agencies, including the Board of Education, in developing courses of instruction for presentation in public and private schools, public libraries, museums and other suitable places. (g) To seek the assistance of such technical and professional personnel as it may determine necessary to assist it in the performance of its duties and purposes. (h) To submit an annual report to the City Manager and City Council. (i) To adopt, amend, publish and rescind rules and regula- tions regarding the operation of the Commission consis- tent with the powers and duties outlined and the Charter and Ordinances of the City of Pueblo. 5. FINDINGS AND RECOMMENDATIONS The Commission after the completion of any investigation or hearing shall make a report in writing setting forth the facts found by it and its recommendations to the City Council and other organi- zations or parties involved. 6 . APPOINTMENT OF STAFF The City Council may provide for personnel as may be necessary to effectuate the purposes of this Chapter. Such personnel to be appointed in the manner provided by Charter and Ordinances of the City of Pueblo. 7. RELATION TO CITY DEPARTMENTS AND AGENCIES All departments of the City are to cooperate with the Commission and furnish information or documents from a department which is within the purview of the Open Records Act of the State of Colorado or other applicable statutes. All other information or documents may be fur- nished at the discretion of the City Manager or City Council. All re- quests for information or documents shall be at the official request of the Commission and not by any individual member of the Commission. -3- . SECTION 2. If any clause, sentence, paragraph, or part of this Chapter, or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction to be invalid, such judgment shall not affect, impair, or invalidate the remainder of this Chapter or the application thereof to other persons or circumstances.
