AN ORDINANCE AMENDING ZONING RESTRICTIONS FOR
117 HECTOR GARCIA PLACE FROM I-3, HEAVY INDUSTRIAL
TO B-4, CENTRAL BUSINESS DISTRICT
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The zoning restrictions covering the following described property, and in addition half of
all adjacent dedicated roadway and alley rights-of-way, together generally identified in the
attached Rezone Exhibit, is hereby changed from I-3, Heavy Industrial to B-4, Central Business:
Lot 17 through 22, inclusive, Baxter's Subdivision, according to the filed plat
recorded May 23, 1887, in Map Book B at Page 14A, under Reception No.
22846, County of Pueblo, State of Colorado.
TOGETHER WITH The South half of the vacated East-West alley within Baxter's
Subdivision lying North of and adjacent to said Lots 17 through 22, inclusive,
Block 18; and the East half of the vacated North-South alley within Baxter's
Subdivision lying Westerly of and adjacent to said Lots 17 and South of the
centerline of said vacated East-West alley extended Westerly to the centerline of
said vacated North-South alley, as vacated by Vacation Ordinance filed for
record January 31, 1979, under Reception No. 597386, in the City of Pueblo,
County of Pueblo, State of Colorado.
Also being described as:
Lot 17 through 22, inclusive, (Block 18), Baxter's Subdivision, according to the
filed plat recorded May 23, 1887, in Map Book Bat Page 14A, under Reception
No. 22846, County of Pueblo, State of Colorado.
TOGETHER WITH The South half of the vacated East-West alley within Baxter's
Subdivision lying North of and adjacent to said Lots 17 through 22, inclusive,
Block 18; and the East half of the vacated North-South alley within Baxter's
Subdivision lying Westerly of and adjacent to said Lots 17 and South of the
centerline of said vacated East-West alley extended Westerly to the centerline of
said vacated North-South alley, as vacated by Vacation Ordinance filed for
record January 31, 1979, under Reception No. 597386, in the City of Pueblo,
County of Pueblo, State of Colorado.
SECTION 2.
The officers and staff of the City are authorized to perform any and all acts consistent
with the intent of the Ordinance to implement the policies and procedures described herein.
SECTION 3.
This Ordinance shall become effective immediately upon final action by the Mayor and
City Council.

SUBJECT: AN ORDINANCE AMENDING ZONING RESTRICTIONS FOR 117
HECTOR GARCIA PLACE FROM I-3, HEAVY INDUSTRIAL TO B-4,
CENTRAL BUSINESS DISTRICT
SUMMARY:
The applicant is requesting to rezone 117 Hector Garcia Place legally described as Lots
17 through 22, inclusive, Block 18, Baxter’s Subdivision in the City of Pueblo from I-3,
Heavy Industrial to B-4, Central Business District. The total rezone area is 0.44 acre of
developed land.
PREVIOUS COUNCIL ACTION:
None.
BACKGROUND:
The subject property, 117 Hector Garcia Place was subdivided as Baxter’s Subdivision
in 1887 and the alleys were vacated in 1979. The property is a 0.44 acre, developed
parcel that was previously used for industrial warehousing and storage, although no
active business use has occurred since 2016. The Pueblo Regional Comprehensive
Plan has designated the property as a Special Development Area, which requires
master planning prior to development or redevelopment. The applicant is proposing to
rezone the property to a B-4 Central Business District to allow for an adaptive reuse-
plan to include a restaurant/bar within the existing first floor and new residential units
within an additional two floors that will be added to the building. The zoning application
includes a master plan statement which conforms with the surrounding commercial and
service uses in general compliance with the Special Development Area designation.
The subject property meets all B-4 Zone District regulations for area and width.
FINANCIAL IMPLICATIONS:
There are no financial implications for the City.
BOARD/COMMISSION RECOMMENDATION:
The Planning and Zoning Commission, at their January 13, 2021 Regular Meeting,
voted 7-0 to recommend approval.
STAKEHOLDER PROCESS:
The Planning Department sent out Notice of the Planning and Zoning Commission
Public Hearing to all property owners located within 300 feet of the subject property.
A Public Notice poster was placed on the subject property 15 days prior to the Public
Hearing.
ALTERNATIVES:
If City Council does not approve this Ordinance the property would not be zoned in
accordance with the Pueblo Municipal Code.
Upon request of City Council, the Ordinance could be returned to the Planning and
Zoning Commission for consideration of proposed modifications.
RECOMMENDATION:
Approval of the Ordinance.
