SUBJECT: A RESOLUTION ESTABLISHING AN APPROVED LIST OF CONTRACTORS
TO PERFORM EMERGENCY SANITARY SEWER POINT REPAIRS DURING
CALENDAR YEARS 2021, 2022, AND 2023 AND AUTHORIZING THE
PURCHASING AGENT TO EXECUTE SAME
SUMMARY:
This Resolution establishes an approved list of contractors to perform emergency sanitary
sewer point repairs during calendar years 2021, 2022, and 2023.

BACKGROUND:
The City of Pueblo owns and operates a sanitary sewer system to convey raw sewage for
treatment to the James R. Dilorio Water Reclamation Facility. Parts of this system are beyond
its life expectancy.
Sanitary sewer problems requiring point repairs are most often discovered when residents
report service problems or our Wastewater Collection crew discovers broken pipes, sagging
pipes, leaking pipes, obstructions clogging pipes or unstable manholes. Thus, it’s often not
possible to anticipate when and where a repair will be needed. Repairs need to be completed as
quickly as possible to limit the time that the public in the vicinity may be without service or at risk
for back-ups.
The City of Pueblo requires formal competitive bids for projects to assure that costs are
controlled. Pursuant to Sections 1-10-5 and 1-10-6, P.M.C., the Mayor is authorized to approve
emergency construction projects without formal bidding and without prior City Council approval:
Such contracts are subsequently presented to the City Council for ratification and approval.
This Resolution authorizes contracts under 2021, 2022, and 2023 Sanitary Sewer Emergency
Point Repair Project No. 20-059 and will provide both competitive bid cost controls and rapid
response capability by creating a list of qualified contractors who have provided a list of unit
prices.
The Purchasing Department solicited unit cost competitive bids from contractors for various
elements of sanitary sewer point repair, including per lineal foot pipe costs for differing pipe
sizes and depths, unit costs for manholes, unit costs for curb and gutter as well as mobilization
costs. Three bids were received and attached is that summary sheet. All bidders form a list of
qualified firms to whom point repairs projects can be offered.
When a point repair project arises, the Wastewater Department staff will evaluate the repairs
needed, determine the unit quantities for the work and compare the qualified vendors bid price
to determine who will complete the work for the lowest cost. The vendor will be required to sign
a standard contract for each project. The project then will proceed without prior Council approval
but shall subsequently be presented to Council for ratification and approval.
FINANCIAL IMPLICATIONS:
Funding for this project will come from the sanitary sewer rehabilitation budget funded by the
Sewer User Fund. Funding is available and has been budgeted, appropriated and allocated to
Project No. 20-059 (WWAN03).

ALTERNATIVES:
Alternative No. 1 – No Action
Under this alternative, the City would not create an approved list of contractors to make repairs
to the existing sanitary sewer system if and when emergencies occur. Under this alternative, the
risk of sanitary sewer overflows and backups increases which creates serious health and safety
issues to the public.
Alternative No. 2 – Place Mains on the Rehabilitation List
Under this alternative, the City would make no immediate improvements and would not create
an approved list of contractors for emergency repairs. Any emergency issues would be placed
on a rehabilitation list and prioritized by the level of importance for future improvements. This
would significantly increase the time it takes to repair the main. This would increase the risk to
the public safety and health and allow the damaged main to continue to degrade.
RECOMMENDATION:
Approval of the Resolution.

2021, 2022, AND 2023 AND AUTHORIZING THE
PURCHASING AGENT TO EXECUTE SAME
WHEREAS, proposals for performing sanitary sewer point repairs under Project
No. 20-059 have been received and examined; and
WHEREAS, the proposal of Parker Excavating Inc., K.R. Swerdfeger
Construction Inc., and FRPHIECS & Landscape, Inc. (Flow Right), (collectively the
“Approved List”) have been determined to be responsive; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
Council hereby authorizes, subject to an unexpended balance of appropriations
therefore, that upon approval of the Mayor contracts for effecting emergency sanitary
sewer point repairs may be awarded from time to time, to the lowest bidder on the
Approved List, as determined by unit prices for elements of constructions submitted by
responsive bidders under Project No. 20-059 based on the requirements and unit
quantities of each repair project that may arise, and that the same be awarded to said
bidder in the required amount at the time of each project.
SECTION 2.
Funds for Project 20-059 (WWAN03) shall be from the Sewer User Funds.
SECTION 3.
The Purchasing Agent is hereby authorized to execute said contract on behalf of
Pueblo, a Municipal Corporation, and the City Clerk shall affix the seal of the City
thereto and attest the same.
SECTION 4.
The officers and staff of the City are authorized to perform any and all acts
consistent with this Resolution to implement the policies and procedures described
therein.
SECTION 5.
This Resolution shall become effective immediately upon passage and approval.
