AN ORDINANCE APPROVING AND AUTHORIZING THE
MAYOR TO SIGN AN INTERGOVERNMENTAL
AGREEMENT BETWEEN THE CITY OF PUEBLO, A
COLORADO MUNICIPAL CORPORATION AND THE
COUNTY OF PUEBLO, A POLITICAL SUBDIVISION OF
THE STATE OF COLORADO, RELATING TO THE
IMPLEMENTATION AND ENFORCEMENT OF THE “5 STAR
CERTIFICATION PROGRAM” VARIANCE
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO that:
SECTION 1.
The Intergovernmental Agreement (“Agreement”) between the City of Pueblo, a
Colorado Municipal Corporation, and the County of Pueblo, a Political Subdivision of the
State of Colorado, with an effective date of January 1, 2021, attached hereto, having been
approved as to form by the City Attorney, is hereby approved.
SECTION 2.
The Mayor is hereby authorized and directed to execute said Agreement for and
on behalf of the City, and the City Clerk is directed to affix the seal of the City thereto and
attest same.
SECTION 3.
The officers and staff of the City are authorized to perform any and all acts
consistent with this Ordinance and the attached Agreement, to implement the policies
and procedures described herein.
SECTION 4.
This Ordinance shall become effective on the date of final action by the Mayor and
City Council.

SUBJECT: AN ORDINANCE APPROVING AND AUTHORIZING THE MAYOR TO SIGN AN
INTERGOVERNMENTAL AGREEMENT BETWEEN THE CITY OF PUEBLO, A
COLORADO MUNICIPAL CORPORATION AND THE COUNTY OF PUEBLO, A
POLITICAL SUBDIVISION OF THE STATE OF COLORADO, RELATING TO THE
IMPLEMENTATION AND ENFORCEMENT OF THE “5 STAR CERTIFICATION
PROGRAM” VARIANCE
SUMMARY:
Attached is an Ordinance approving an Intergovernmental Agreement (“IGA”) for Pueblo County
to reimburse the City for the salaries and expenses of City employees in implementing and
enforcing the 5 Star Certification Program Variance throughout Pueblo County.
PREVIOUS COUNCIL ACTION:
City Council, (by Resolution No. 14516, dated December 1, 2012 stated the City’s support for the
County’s application to the State of Colorado’s Department of Public Health and the Environment
(“CDPHE”) for a 5 Star Certification Program Variance.
BACKGROUND:
Pueblo County has filed an application to CDPHE for a 5 Star Certification Program Variance.
The City has hired certain employees (“COVID-19 Technicians”) to educate local businesses
about compliance with CDPHE’s public health orders in response to the COVID-19 pandemic, as
summarized by the CDPHE COVID-19 Dial. The City’s COVID-19 Technicians are equipped to
educate local businesses about the requirements of 5 Star Certifications and to ensure
compliance therewith after a local business has been so certified. The attached proposed
Ordinance approves and authorizes the Mayor to sign an IGA with the County in which the City,
acting by and through its COVID-19 Technicians, agrees to:
1. Review all applications for the 5 Star Variance received from businesses located in
Pueblo County;
2. Take appropriate steps to educate all applicants concerning the requirements of a 5
Star Variance, and recommend that the Pueblo County Department of Public Health
and the Environment (“PDPHE”) certify those businesses who meet the requirements;
3. Periodically inspect all Pueblo County businesses receiving 5 Star Certifications to
insure compliance with the 5 Star Variance;
4. Recommend that the PDPHE de-certify those Pueblo County businesses which are
not in compliance with the terms and conditions of the 5 Star Variance;
5. Take all other actions required by CDPHE to ensure Pueblo County’s compliance with
the 5 Star Certification Program.
FINANCIAL IMPLICATIONS:
The City will invoice the County, on a monthly basis, for the costs of the salaries and expenses of
the City’s COVID-19 Technicians, incurred by the City, under the attached Agreement. The
County shall pay to the City, on a monthly basis, the amount of said salaries and expenses.

ALTERNATIVES:
City Council has the option of not implementing and enforcing the 5 Star Certification Program
Variance.
RECOMMENDATION:
Approve the attached ordinance.
