HomeMy WebLinkAbout09856ORDINANCE NO. 9856 AN EMERGENCY ORDINANCE ESTABLISHING PROJECT HU2003 – STREET REHABILITATION PROJECT, BUDGETING AND APPROPRIATING TWO MILLION, SIX HUNDRED SEVENTY-EIGHT THOUSAND, ONE HUNDRED THIRTY-ONE DOLLARS AND NINETY-EIGHT CENTS ($2,678,131.98) TO PROJECT HU2003 AND TRANSFERRING TWO MILLION, SIX HUNDRED SEVENTY-EIGHT THOUSAND, ONE HUNDRED THIRTY-ONE DOLLARS AND NINETY-EIGHT CENTS ($2,678,131.98) FROM PROJECT HU2001 TO PROJECT HU2003 FOR STREET REHABILITATION REPAIRS BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. Project HU2003 is hereby established. SECTION 2. Funds in the amount of two million, six hundred seventy-eight thousand, one hundred thirty-one dollars and ninety-eight cents ($2,678,131.98) are budgeted and appropriated transferring funds from project account HU2001 to HU2003. SECTION 3. The City of Pueblo’s Director of Finance is hereby instructed to segregate and keep separate the monies retained in the Street Repair Utility Enterprise Fund and the monies retained in the HUTF fund and not comingle said funds for any purpose, as required by XII and Chapter 11 of the Pueblo Municipal Code and Section 20 of Article X of the Colorado Constitution. SECTION 4. This Ordinance is adopted for the administrative convenience and is not intended as, nor shall this Ordinance be construed as, a transfer of the City of Pueblo’s tax revenues to the City’s Street Repair Utility Enterprise. SECTION 5. The officers and staff of the City are authorized to perform any and all acts consistent with this Ordinance to implement the policies and procedures described herein. SECTION 6. Savings Clause: The immediate enactment of this Ordinance is necessary in order to preserve and protect the health, safety and welfare of the residents of the City. Funds must be immediately appropriated for the rehabilitation of six additional Pueblo Arterial Roadways in 2021. These streets include Northern Ave. (east only), Grand Ave., High Street, 24th Street, Hudson Ave, and Broadway Ave. Pursuant to Sec. 3-20 of the City Charter, this Ordinance shall become effective on the date of final action by the Mayor and City Council. The amount of transfer totals $2,678,131.98 and is intended to repair Pueblo arterial roadways as part of the City of Pueblo’s annual road maintenance program. PREVIOUS COUNCIL ACTION: Ordinance 9745 passed and approved establishing Project Accounts HU2001. Resolution 14514 approving Amendment No. 2 to Martin Marietta for additional road repair, milling and asphalt overlay work for Project No. 20-035 – Street Rehabilitation Project. BACKGROUND: The City’s Arterial Roadway System has been evaluated, pavement construction indexes have been determined and the planned rehabilitation of these roadways has been prioritized based on conditions. FINANCIAL IMPLICATIONS: Funds in the amount of $2,678,131.98 are being transferred from Project Account HU2001 to Project Account HU2003. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Ordinance. STAKEHOLDER PROCESS: Not applicable to this Ordinance. ALTERNATIVES: If this Ordinance is not approved, there will be no funding in Project Number HU2003 to pay for the rehabilitation of Pueblo arterial roadways. RECOMMENDATION: Approve the Ordinance.
