HomeMy WebLinkAbout09831 ORDINANCE NO. 9831 AN EMERGENCY ORDINANCE APPROVING AND AUTHORIZING THE MAYOR TO SIGN A TENANTS IN COMMON AGREEMENT BETWEEN THE CITY OF PUEBLO, A COLORADO MUNICIPAL CORPORATION, AND THE COUNTY OF PUEBLO, A POLITICAL SUBDIVISION OF THE STATE OF COLORADO CONCERNING THE REAL PROPERTY AND TH IMPROVEMENTS LOCATED AT 201 W. 8 ST., PUEBLO, COLORADO BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO that: SECTION 1. The Tenants in Common Agreement (“Agreement”) between the City of Pueblo, a Municipal Corporation, and the County of Pueblo, a Political Subdivision of the State of Colorado, dated December 7, 2020, attached hereto, having been approved as to form by the City Attorney, is hereby approved. SECTION 2. The Mayor is hereby authorized and directed to execute said Agreement for and on behalf of the City, and the City Clerk is directed to affix the seal of the City thereto and attest same. SECTION 3. The officers and staff of the City are authorized and directed to perform any and all acts consistent with this Ordinance and the attached Agreement to implement the policies and procedures described herein. SECTION 4. Savings Clause: The Closing of the purchase of the Wells Fargo Building is scheduled for December 10, 2020, requiring City Council’s immediate consideration of this Ordinance. The immediate enactment of this Ordinance is necessary in order to preserve and protect the health, safety and welfare of the residents of the City. Pursuant to Sec. 3-20 of the City Charter, this Ordinance shall become effective on the date of final action by the Mayor and City Council. Gradisar VIA: Brenda Armijo, City Clerk SUBJECT: AN EMERGENCY ORDINANCE APPROVING AND AUTHORIZING THE MAYOR TO SIGN A TENANTS IN COMMON AGREEMENT BETWEEN THE CITY OF PUEBLO, A COLORADO MUNICIPAL CORPORATION, AND THE COUNTY OF PUEBLO, A POLITICAL SUBDIVISION OF THE STATE OF COLORADO CONCERNING THE REAL PROPERTY AND TH IMPROVEMENTS LOCATED AT 201 W. 8 ST., PUEBLO, COLORADO SUMMARY: The Ordinance approves a Tenants in Common Agreement with Pueblo County in connection th with the purchase by the City and County of the Wells Fargo Building located at 201 W. 8 Street, Pueblo, CO 81003 (ÐWells Fargo Bank BuildingÑ). PREVIOUS COUNCIL ACTION: On October 26, 2020, the City Council, by Resolution, accepted and approved the Assignment of a Contract to Buy and Sell Real Estate (Commercial) from Pueblo County to itself and the City of Pueblo concerning the real property and improvements known as the Wells Fargo Bank Building. BACKGROUND: Title to the Wells Fargo Bank Building will be acquired by the City and County as tenants in common. An initial agreement is necessary to specify the rights and responsibilities of the City and County, operating as tenants in common, with respect to the Wells Fargo Bank Building. The purpose of the attached Ordinance is to approve and authorize the Mayor to sign the initial ownership agreement between the City and County. FINANCIAL IMPLICATIONS: Other than the costs of acquisition and operational expenses, this Ordinance will not create any financial obligations on the part of the City. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Ordinance. STAKEHOLDER PROCESS: Not applicable to this Ordinance. ALTERNATIVES: City Council has the option of not approving the Tenants in Common Agreement which would allow the City and County to operate as unrestricted tenants in common with respect to the Wells Fargo Bank Building.
