HomeMy WebLinkAbout09801 ORDINANCE NO. 9801 AN ORDINANCE AMENDING ZONING RESTRICTIONS FOR LOT 51 PUEBLO MEMORIAL AIRPORT INDUSTRIAL PARK ANNEXATION REZONING FROM COUNTY I-3, HEAVY INDUSTRIAL DISTRICT TO CITY I-3, HEAVY INDUSTRIAL DISTRICT BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The zoning restrictions covering the following described property and generally identified in the attached Rezone Exhibit, is hereby changed from County I-3, Heavy Industrial District to City I-3, Heavy Industrial District: Lot 51, Pueblo Memorial Airport Industrial Park Subdivision, .95-acres. SECTION 2. The officers and staff of the City are authorized and directed to perform any and all acts consistent with the intent of the Ordinance to implement the policies and procedures described herein. SECTION 3. This Ordinance shall become effective immediately upon final action by the Mayor and City Council. Gradisar, Mayor VIA: Brenda Armijo, City Clerk FROM: Scott Hobson, Acting Director of Planning and Community Development SUBJECT: AN ORDINANCE AMENDING ZONING RESTRICTIONS FOR LOT 51 PUEBLO MEMORIAL AIRPORT INDUSTRIAL PARK ANNEXATION REZONING FROM COUNTY I-3, HEAVY INDUSTRIAL DISTRICT TO CITY I-3, HEAVY INDUSTRIAL DISTRICT SUMMARY: The City, as property owner, is requesting to rezone the subject property from County I- 3, Heavy Industrial District to City I-3 Heavy Industrial District. PREVIOUS COUNCIL ACTION: The City owned property was annexed on February 24, 2020 by Ordinance No. 9668. BACKGROUND: Lot 51 was zoned Pueblo County I-3, Heavy Industrial. Lot 51 was annexed to support existing and future industrial uses located north of the subject site on Lots 52 and 53, Pueblo Memorial Airport Industrial Park Subdivision, which were annexed into the City in 2006. Section 17-1-3(e) of the Pueblo Municipal Code requires the City to zone the subject site to the “land use classification most nearly corresponding to the land use classification into which said land has been classified under the City’s Comprehensive Plan.” FINANCIAL IMPLICATIONS: There are no financial implications for the City. BOARD/COMMISSION RECOMMENDATION: The Planning and Zoning Commission, at their June 10, 2020 Regular Meeting, voted 7- 0 to recommend approval. STAKEHOLDER PROCESS: The Planning Department sent out Notice of the Planning and Zoning Commission Public Hearing to all property owners located within 300 feet of the subject property. A Public Notice poster was placed on the subject property 15 days prior to the Public Hearing. ALTERNATIVES: If City Council does not approve this Ordinance the property would not be zoned in accordance with the Pueblo Municipal Code. Upon request of City Council, the Ordinance could be returned to the Planning and Zoning Commission for consideration of proposed modifications. RECOMMENDATION: Approval of the Ordinance.
