HomeMy WebLinkAbout09800 ORDINANCE NO. 9800 AN ORDINANCE AMENDING ZONING RESTRICTIONS FOR A 454.27-ACRE, CITY OWNED PARCEL, GENERALLY LOCATED NORTH AND WEST OF LIME ROAD AND EAST OF TOWER ROAD BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The zoning restrictions covering the following described property generally identified in the attached Rezone Exhibit is hereby changed from A-1, Agricultural One, to City I-3, Heavy Industrial District: RE-ZONING LEGAL DESCRIPTION FOR PROPOSED ST. CHARLES INDUSTRIAL PARK, FILING NO. 2 AREA NO. 1 A Parcel of land located in the northeast one-quarter of Section 1, Township 22 South, Range 65 West, the east one-half of Section 36, Township 21 South, Range 65 West, the northwest one-quarter of Section 6, Township 22 South, Range 64 West, and Section 31, Township 21 South, Range 64 West, the 6th P.M. in the County of Pueblo and State of Colorado and being more particularly described as follows: Basis of Bearings is the north line of Section 36, monumented on the west with a found 3 1/4" aluminum cap stamped with P.L.S. No. 33200 and monumented on the east with a found 3 1/4" aluminum cap stamped with P.L.S. No. 33200, to bear N. 89°19'04" W. and all bearings being relative thereto. Gradisar, Mayor VIA: Brenda Armijo, City Clerk FROM: Scott Hobson, Acting Director of Planning and Community Development AN ORDINANCE AMENDING ZONING RESTRICTIONS FOR A 454.27- ACRE, CITY OWNED PARCEL, GENERALLY LOCATED NORTH AND WEST OF LIME ROAD AND EAST OF TOWER ROAD SUMMARY: The City, as property owner, is requesting to rezone the subject property, St. Charles Industrial Park Phase 2 Annexation, from County A-1, Agricultural One to City I-3, Heavy Industrial District. PREVIOUS COUNCIL ACTION: The subject property was annexed into the City in July 2020 by Ordinance No. 9752. BACKGROUND: In February 2020, the City purchased 454.27 acres of land west of Lime Road and north of the Vossloh North America (formerly Rocla Inc). The property was purchased and annexed by the City in connection with the development of the St. Charles Industrial Park. Section 17-1-3(e) of the Pueblo Municipal Code requires the City to zone the recently annexed 454 acres to the “land use classification most nearly corresponding to the land use classification into which said land has been classified under the City’s Comprehensive Plan.” FINANCIAL IMPLICATIONS: There are no financial implications for the City. BOARD/COMMISSION RECOMMENDATION: The Planning and Zoning Commission, at their September 9, 2020 Regular Meeting, voted 7-0 to recommend approval. STAKEHOLDER PROCESS: The Planning Department sent out Notice of the Planning and Zoning Commission Public Hearing to all property owners located within 300 feet of the subject property. A Public Notice poster was placed on the subject property 15 days prior to the Public Hearing. ALTERNATIVES: If City Council does not approve this Ordinance, the current zoning would remain and the City would not be adhering to the Pueblo Municipal Code and would not be in compliance with the City’s Comprehensive Plan. Upon request of City Council, the Ordinance could be returned to the Planning and Zoning Commission for consideration of proposed modifications. RECOMMENDATION: Approval of the Ordinance.
