AN ORDINANCE ESTABLISHING PROJECT PL2006,
BUDGETING AND APPROPRIATING FUNDS IN THE AMOUNT
OF $300,000 RELATING TO THE PUEBLO BROWNFIELDS
ASSESSMENT PROJECT, AND APPROVING A COOPERATIVE
AGREEMENT BETWEEN THE CITY OF PUEBLO, A COLORADO
MUNICIPAL CORPORATION AND THE U.S. ENVIRONMENTAL
PROTECTION AGENCY REGION 8 IN THE AMOUNT OF
$300,000 RELATING TO SAID PROJECT AND AUTHORIZING
THE MAYOR TO EXECUTE SAME
WHEREAS, the Environmental Protection Agency, Region 8 (“EPA”) has awarded funds
through the Brownfields Assessment Grant to complete a Pueblo Brownfields Assessment
Project; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Cooperative Agreement between the City of Pueblo, a Colorado Municipal
Corporation, and the EPA (hereinafter referred to as the “Agreement”), a copy of which is
attached, having been approved as to form by the City Attorney, is hereby approved.
SECTION 2.
The Pueblo Brownfields Assessment Project, PL2006 is hereby established and funds in
the amount of $300,000 are hereby budgeted and appropriated into said Project.
SECTION 3.
The Mayor is authorized to execute and deliver the Agreement in the name of the City
and the City Clerk is directed to affix the seal of the City thereto and attest same.
SECTION 4.
The officers and staff of the City are authorized and directed to perform any and all acts
consistent with the intent of the Ordinance and Agreement to implement the policies and
procedures described therein.
SECTION 5.
This Ordinance shall become effective immediately upon final passage and approval.

SUMMARY:
This Ordinance approves a Brownfields Assessment Cooperative Agreement between
the City of Pueblo and the U.S. Environmental Protection Agency, Region 8 (“EPA”)
awarding $300,000 in funds to the City related to the Pueblo Brownfields Assessment
Project, and budgets and appropriates the funds into Capital Project PL2006.
PREVIOUS COUNCIL ACTION:
Resolution No. 14315 approved on November 25, 2019 authorized the City of Pueblo to
submit a grant application in the amount of $300,000 to the EPA for the Brownfields
Assessment Grant Program.
BACKGROUND:
The EPA awarded the City of Pueblo a $300,000 Brownfields Grant Agreement Number
BF 95809310-0 to assess and revitalize properties in the City’s downtown and riverfront
areas. The City is among 151 communities across the nation who were awarded funding
from the EPA Brownfields Program for Assessments, Revolving Loan Funds, or Cleanup
Grant programs. The EPA Brownfields Assessment funds will be used to inventory and
prioritize brownfield sites and conduct fifteen (15) or more Phase I and three (3) or more
Phase II environmental site assessments. The funding will also be used to develop four
cleanup plans and support community outreach activities. Assessment activities will focus
on Pueblo’s downtown and riverfront areas, which are both within a census designated
federal Opportunity Zone. A Brownfields Advisory Committee will be established as part
of the Project to help identify priority properties to assess and to assist with community
outreach activities. Priority sites include a decommissioned power plant, former railroad
and coal yards, filling stations and/or motor freight stations.
FINANCIAL IMPLICATIONS:
The total project budget, PL 2006 will be funded through the following sources:
Environmental Protection Agency (award date October 2020) $ 300,000.00

STAKEHOLDER PROCESS:
The Brownfields Advisory Committee will be active in an advisory role to the City.
ALTERNATIVES:
The Project will not move forward if the Ordinance is not approved.

Approve the Ordinance.
