ORDINANCE NO. 5540
AN ORDINANCE AMENDING TITLE VII OF THE 1971
CODE OF ORDINANCES RELATING TO TRASH, GARBAGE
AND SOLID WASTE , AND PROVIDING PENALTIES FOR
VIOLATIONS THEREOF
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that:

new material being added. )
SECTION 1 .
Chapter 2, Title VII of the 1971 Code of Ordinances of the
City of Pueblo, as amended, is hereby repealed in its entirety.
SECTION 2.
Section 7-3-6 of Chapter 3, Title VII of the 1971 Code of
Ordinances of the City of Pueblo, as amended, is hereby amended to
read as follows :
7-3-6: [DISPOSITION] DISPOSAL AT DESIGNATED FACILITIES
All rubbish, trash, litter and garbage shall be disposed
of only by delivery to [such places only as shall be] duly
designated solid waste disposal facilities [from time to time
by the Health Department as public dumping grounds , and] .
[ i ] It shall be unlawful and a municipal offense for any
person to dump, deliver or dispose of [dump] rubbish, trash,
litter and garbage [debris of any kind within the limits of
Pueblo or within one mile of the outer boundaries thereof , ]
anywhere within the City except at [such] a duly designated
solid waste disposal [dumping grounds] facility, if any.
SECTION 3.
Section 7-3-7 of Chapter 3 of Title VII of the 1971 Code of
Ordinances of the City of Pueblo is hereby repealed and amended by
re-enactment to read as follows :
7-3-7: TRANSPORT OF GARBAGE AND TRASH
( a) It shall be unlawful and a municipal offense for
any person to transport garbage , rubbish or trash in a
vehicle operated on any street or highway within the City,
( 1 ) in a manner which permits garbage, rubbish or
trash to spill , leak , drop or be deposited from the
vehicle; or
( 2 ) without the load being adequately secured and
enclosed or covered to prevent garbage, rubbish or trash
from dropping, spilling, leaking or otherwise escaping
from the vehicle.
SECTION 4 .
The health officer and such employees of the City-County
Health Department as he shall designate as health protection
officers, shall enforce this ordinance pursuant to the authority
heretofore granted in Section 7-1-4 of the 1971 Code of Ordinances
of the City of Pueblo.
SECTION 5.
Any violations of the provisions of this Ordinance declared
to constitute municipal offenses, shall be punishable by a fine
not to exceed $300, or by imprisonment for a term not to exceed 90
days, or by both such fine and imprisonment.
SECTION 6.
This Ordinance shall be effective immediately upon final pas-
sage and approval .
