AN EMERGENCY ORDINANCE AMENDING SECTION 14-4-
85.1 OF CHAPTER 4 OF TITLE XIV OF THE PUEBLO
MUNICIPAL CODE RELATING TO AND EXTENDING THE
DEADLINE FOR COVID-19 EMERGENCY PROJECT GRANTS
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (brackets indicate
matter being deleted, underscoring indicates new matter being added)
SECTION 1.
Section 14-4-85.1 of Chapter 4 of Title XIV of the Pueblo Municipal Code, as amended,
is hereby amended to read as follows:
Sec. 14-4-85.1. Sales and Use Tax Capital Improvement Project Fund; definitions.

(11) COVID-19 Emergency Project shall mean an amount equal to Five Million
Dollars ($5,000,000) made available for COVID-19 impacted businesses. Said Project shall
be available until Project is exhausted or October 1, 2020, whichever occurs first \[.\];
provided, however and subject to available funds, grants authorized pursuant to
Section 14-4-85.5 of this Chapter may be received, approved and made available under
the Project after October 1, 2020 if said funds will be spent and used on or before
December 30, 2020.
SECTION 2.
The officers and staff of the City are authorized and directed to perform any and all
acts consistent with this Ordinance to effectuate the policies and procedures described
herein.
SECTION 3.
Savings Clause: The immediate enactment of this Ordinance is necessary in order to
preserve and protect the health, safety and welfare of the residents of the City. Funds for
grants under the COVID-19 Emergency Project are currently available only through October
1, 2020. The immediate approval of this Ordinance is necessary in order to timely extend
said deadline before it expires. Accordingly, pursuant to Sec. 3-20 of the City Charter, this
Ordinance shall become effective on the date of final action by the Mayor and City Council.

EXTENDING THE DEADLINE FOR COVID-19 EMERGENCY PROJECT
GRANTS
SUMMARY:
The proposed Ordinance extends the deadline for receiving and approving COVID-19 Emergency
Project grants beyond the date of October 1, 2020 provided said funds are spent and used on or
before December 30, 2020.
PREVIOUS COUNCIL ACTION:
The Half-Cent Sales Tax Criteria Ordinance was last amended by City Council by Ordinance No.
9698 on April 13, 2020. Said Ordinance established the “COVID-19 Emergency Project” which
was funded with Five million Dollars ($5,000,000) from the 1992-2021 Sales and Use Tax Capital
Improvement Projects Fund. Pursuant to said Project, said funding was to be made available for
grants or loans to local businesses which have been negatively impacted by the COVID-19
pandemic.
BACKGROUND:
Funds for grants and loans under the COVID-19 Emergency Project are currently available only
through October 1, 2020. Pursuant to the May 18, 2020 Executive Order D 2020 070 issued by
the Governor of Colorado and the subsequent creation of the Coronavirus Relief Fund (“CRF”),
the City may apply for reimbursement of funds made available for grants under the COVID-19
Emergency Project. CRF reimbursements apply to eligible expenses incurred through December
30, 2020. The purpose of the proposed Ordinance is to extend the deadline for COVID-19
Emergency Project grants beyond October 1, 2020 provided said funds are spent and used by
December 30, 2020, which date is consistent with the CRF reimbursement limitation.
FINANCIAL IMPLICATIONS:
The Half Cent Sales Tax Fund currently contains sufficient unobligated monies to allow for the
extension of the deadline for the COVID-19 Emergency Project grants. The City will apply for
reimbursement of any such grants from the Coronavirus Relief Fund.

Not applicable to this Ordinance.

ALTERNATIVES:
Without this Ordinance, no further grants will be made under the COVID-19 Emergency Project.
RECOMMENDATION:
The administration is recommending approval of this Ordinance.
