HomeMy WebLinkAbout14477 RESOLUTION NO. 14477 A RESOLUTION AUTHORIZING THE CITY OF PUEBLO TO REFUND SANITARY SEWER FEES OF $420.53 TO BRAD CRAIG WHEREAS, the City’s Wastewater Department has been notified that Brad Craig paid sanitary sewer fees for property located at 1637 W. 14th Street which property is not connected to the City’s wastewater system; and WHEREAS, pursuant to Section 16-6-6 of the Pueblo Municipal Code, the Director of Wastewater has determined that grounds exist for a refund pursuant to Section 16-6-5 of the Code; and WHEREAS, a refund for the paid amount can only be authorized by Pueblo City Council; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The City shall refund to Brad Craig the sum of $420.53 for the erroneous collection of fees th charged for 1637 W. 14 Street during the period of July 2018 through July 2020. SECTION 2. Such refund shall be paid through the Claim Settlement Fund, Account Number 5254110055007 in the amount of $420.53. SECTION 3. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of this Resolution to effectuate the policies and procedures described therein. SECTION 4. This Resolution shall become effective immediately upon passage and approval. Gradisar, Mayor VIA: Brenda Armijo, City Clerk FROM: Nancy Keller, Wastewater Director SUBJECT: A RESOLUTION AUTHORIZING THE CITY OF PUEBLO TO REFUND SANITARY SEWER FEES OF $420.53 TO BRAD CRAIG SUMMARY: This Resolution authorizes the refund of erroneously collected sanitary sewer fees in the amount of $420.53 to the owner of property located at 1637 W. 14th Street, Pueblo, Colorado. PREVIOUS COUNCIL ACTION: None BACKGROUND: The Wastewater Department recently received a written request from Brad and Christine th Craig who are the owners of the property located at 1637 W. 14 Street. The Craigs are seeking a refund of the sewer fees assessed under the water account held in the name of Brad Craig for the property. This address is a piece of land with a tin shed on it, and only an outside spicket. There is no residence on this property, no sewer line, and no connection with the City’s wastewater system. Sanitary sewer fees should not have been assessed with respect to this address. Pursuant to City Ordinance 16-6-7, refunds based upon sewer user charges appearing on billings issued more than ninety (90) days prior to receipt of a written request can only be authorized by City Council and are limited to a maximum period of two years. The Craigs are requesting the refund of wastewater fees in the amount of $420.53 for the charges from July 2018 to July 2020. FINANCIAL IMPLICATIONS: The refund of $420.53 will be paid from the Claim Settlement Fund, Account number 5254110055007. Funds are available and have been appropriated.
