AN ORDINANCE AMENDING ZONING RESTRICTIONS
FOR PROPERTY LOCATED EAST OF I-25 AND AT THE
TERMINUS OF INDIANA AVENUE FROM COUNTY I-3 TO
CITY I-3, HEAVY INDUSTRIAL DISTRICT
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The zoning restrictions covering the following described property, and in addition
half of all adjacent dedicated roadway and alley rights-of-way, together generally
identified in the attached Rezone Exhibit is hereby changed from a County I-3 to City I-3,
Heavy Industrial District.
Parcel 1
A parcel of land located in a portion of the East one-half (1/2) of Sections 12, and 13,
Township 21 South, Range 65 West of the 6th P.M. in the County of Pueblo and State of
Colorado, being more particularly described as follows.
Considering the South line of Block 39 in Lake Minnequa Addition as filed for record in
the Pueblo County records to bear N. 88°54’21” E. and all bearings contained herein
being relative thereto.
Commencing at the Southeast corner of said Block 39; thence N. 88º54’21” E., a distance
of 125.00 feet to the east right-of-way line of the Denver and Rio Grande Railroad as
presently located; thence N. 01º04’44” W. along said east right-of-way line, a distance of
300.00 feet; thence N. 01º04’44” W. continuing along said east right-of-way line, a
distance of 950.00 feet; thence N. 88º54’21” E., a distance of 226.00 feet; thence N.
40º24’00” E., a distance of 636.00 feet; thence N. 88º54’21” E., a distance of 342.00 feet;
thence S. 01º05’39” E., a distance of 90.00 feet; thence S. 88º54’21” W., a distance of
44.00 feet; thence S. 01º05’39” E., a distance of 190.00 feet; thence N. 88º54’21” E., a

SECTION 2.
The officers and staff of the City are authorized and directed to perform any and
all acts consistent with the intent of the Ordinance to implement the policies and
procedures described herein.
SECTION 3.
This Ordinance shall become effective immediately upon final action by the Mayor
and City Council.

SUBJECT: AN ORDINANCE AMENDING ZONING RESTRICTIONS FOR PROPERTY
LOCATED EAST OF I-25 AND AT THE TERMINUS OF INDIANA AVENUE
FROM COUNTY I-3 TO CITY I-3, HEAVY INDUSTRIAL DISTRICT
SUMMARY:
The applicant is requesting to rezone the subject property from County I-3 to City I-3,
Heavy Industrial District
PREVIOUS COUNCIL ACTION:
The Evraz Annexations 3, 4, and 5 were approved by Ordinance Nos. 9554, 9555, 9556
dated September 23, 2019.
BACKGROUND:
The proposed rezoning consists of three sites, EVRAZ Annexation areas 3, 4, and 5,
which were approved by City Council in 2019. These three parcels sit adjacent to the
2018 EVRAZ Annexation areas 1 and 2. Following the initial annexation, an additional
9.19 acres of EVRAZ property was annexed to provide an expanded footprint for
development of a heavy industrial steelmaking facility within City limits. The three parcels,
totaling 9.19 acres, will be combined with the original annexation area (49.97 acres) and
subdivided into one lot, creating one developable I-3, Heavy Industrial lot totaling 59.16
acres. The property is currently zoned County I-3, and subject to the City’s development
code is required to be zoned within the City. The property is located east of I-25, at the
terminus of Indiana Avenue and south of Harlem Street. The applicant is proposing to
rezone the property to City I-3, Heavy Industrial Zone District in order to facilitate future
heavy industrial development and uses. An Ordinance requesting to subdivide the 59.16-
acre parcel into one lot has been submitted concurrently with this zoning request.
FINANCIAL IMPLICATIONS:
There are no financial implications for the City.
BOARD/COMMISSION RECOMMENDATION:
The Planning and Zoning Commission, at their June 10, 2020 Regular Meeting, voted 7-
0 to recommend approval.
STAKEHOLDER PROCESS:
The Planning Department sent out Notice of the Planning and Zoning Commission Public
Hearing to all property owners located within 300 feet of the subject property.
A Public Notice poster was placed on the subject property 15 days prior to the Public
Hearing.
ALTERNATIVES:
If City Council does not approve this Ordinance, the current zoning would remain, and the
area will not be developed as planned.
Upon request of City Council, the Ordinance could be returned to the Planning and Zoning
Commission for consideration of proposed modifications.
RECOMMENDATION:
Approval of the Ordinance.
