HomeMy WebLinkAbout14462RESOLUTION NO. 14462 A RESOLUTION ADOPTING A FEE SCHEDULE FOR APPLICATIONS FOR MATTERS BROUGHT BEFORE THE LAND USE ADMINISTRATIVE OFFICIAL, HISTORIC PRESERVATION COMMISSION, PLANNING AND ZONING COMMISSION, SUBDIVISION REVIEW COMMITTEE, TECHNICAL ADVISORY COMMITTEE, AND ZONING BOARD OF APPEALS AND REPEALING RESOLUTION NUMBERS 9729, 10014, 10787, 11597, 11951, 13004, 13041, 13588, 14223, 14224 WHEREAS, Sections 12-4-8, 17-4-5, 17-4-10, 17-4-12, 17-4-29, 17-4-32, 17-4-65, 17-5- 37, 17-5-38, 17-6-5, 17-8-13, and 17-12-6 of the Pueblo Municipal Code provide that City Council shall by Resolution establish a schedule of fees, charges and expenses for applications before the Historic Preservation Commission, Land Use Administrative Official, Planning and Zoning Commission, Subdivision Review Committee, Technical Advisory Committee, and Zoning Board of Appeals; and, WHEREAS, the Pueblo City Council hereby finds and determines that the following fee schedule is fair and reasonable in relation to the cost and expense, both direct and indirect, in providing the identified services and processing the application; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The City of Pueblo is hereby exempt from the payment of fees established by this Resolution. SECTION 3. Resolution Numbers 9729, 10014, 10787, 11597, 11951, 13004, 13041, 13588, 14223, 14224 are hereby repealed as of the effective date of this Resolution. SECTION 4. The officers and staff of the City are authorized and directed to perform any and all acts consistent with the intent of this Resolution to implement the policies and procedures described herein. SECTION 5. This Resolution shall become effective immediately upon final approval. Flores and Members of City Council CC: Nicholas Gradisar, Mayor VIA: Brenda Armijo, City Clerk FROM: Scott Hobson, Acting Director of Planning and Community Development SUBJECT: A RESOLUTION ADOPTING A FEE SCHEDULE FOR APPLICATIONS FOR MATTERS BROUGHT BEFORE THE LAND USE ADMINISTRATIVE OFFICIAL, HISTORIC PRESERVATION COMMISSION, PLANNING AND ZONING COMMISSION, SUBDIVISION REVIEW COMMITTEE, TECHNICAL ADVISORY COMMITTEE, AND ZONING BOARD OF APPEALS AND REPEALING RESOLUTION NUMBERS 9729, 10014, 10787, 11597, 11951, 13004, 13041, 13588, 14223, 14224 SUMMARY: This Resolution adopts a Planning and Community Development Department fee schedule for applications for matters brought before the Land Use Administrative Official, and certain committees, boards and commissions, and repeals all previous resolutions related to the fee schedule. The proposed Resolution and fee schedule will be easier to revise in the future. PREVIOUS COUNCIL ACTION: The following previous Resolutions pertained to the fee schedule for the Planning and Community Development Department: 9729 for applications for rezoning, subdivision, annexation, and matters brought before the Zoning Board of Appeals and the Land Use Administrative Official, and repealed resolution 5073; 10014 amended resolution 9729 by adding fees for applications brought before the Land Use Administrative Official; 10787 for planned unit development, 11597 for student housing, 11951 for medical marijuana facilities, 13004 for conditional use permits for child care homes and retail marijuana facilities, 13041 amended 9729 pertaining to applications for the Zoning Board of Appeals, 13588 for conditional use permits, 14223 lowered fees for child care homes, 14224 for retail and medical conditional use permits. BACKGROUND: The current fee schedule does not accurately reflect the fee for historic landmark demolition permits established by Resolution and the fee for Special Area Plans that was established by Ordinance. Fair and equitable adjustments to the fee schedule are proposed to reduce the Child Care Home limited use permit from $500 to $150. A fee of $500 is being proposed for an amendment to a Planned Unit Development zoning. The current fee schedule only has a fee of $500 plus $50 per acre for establishing a new Planned Unit Development zoned area. The updated fee schedule also includes clarifications of public notice fees and adopting fees that are currently not addressed for rezoning applications pertaining to a Commercial Charter Neighborhood District, Residential Charter Neighborhood District, Master Planned Community District, and a Planned Unit Development District. FINANCIAL IMPLICATIONS: The fees will accurately reflect staff time and other expenses pertaining to land use applications. BOARD/COMMISSION RECOMMENDATION: Not applicable. STAKEHOLDER PROCESS: Not applicable. ALTERNATIVES: If the Resolution is not approved, the current fee schedules will remain and will not be updated. The fee schedule table included in this Resolution will not repeal the previously adopted fee Resolutions. RECOMMENDATIONS: Approve the Resolution.
