A RESOLUTION SETTING THE DATE, TIME AND PLACE FOR
THE HEARING ON ANY OBJECTIONS TO AN ABATEMENT
ASSESSMENT AS SEPTEMBER 16, 2020 AT 9:00 A.M. IN CITY
COUNCIL CHAMBERS AND DIRECTING THE MAYOR TO
APPOINT A HEARINGS OFFICER
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
Pursuant to Chapter 8 of Title VII of the Pueblo Municipal Code, City Council hereby
directs the Mayor to appoint a hearings officer to hear any protests or objections to the lien
assessment notices that will be posted and/or mailed on or about August 28, 2020.
SECTION 2.
A hearing shall be held at 9:00 a.m. on September 16, 2020 in the City Council Chambers
at which time any protests or objections to the report may be heard. Any person interested in or
affected by proposed charge may file written protests or objections with the City Clerk no later
than seven (7) days prior to the time set for the hearing on the report pursuant to P.M.C. § 7-8-3.
Each objection must be in writing, contain a description of the property in which the signer thereof
is interested, a description of the signer’s interest in the property, and the grounds for such protest
th
or objection. No protests shall be accepted later than close of business on the seventh (7) day
prior to the hearing.
SECTION 3.
The City Clerk is hereby directed to cause notice of said hearing to be posted upon the
property involved, published once in a newspaper of general circulation within the City, and served
by certified mail, postage prepaid addressed to the owner of the property as the owner’s name
and address appears on the last assessment roll of the county, if such so appears, or as known
to the City Clerk. Such notice or mailing shall be given at least fifteen (15) days prior to the date
set for the hearing and shall specify the day, hour and place when the hearing shall be held and
when City Council shall pass upon the City’s Report of Abatement Lien Assessments and the
recommendations of the Hearings Officer.
SECTION 4.
The officers of the City are directed and authorized to perform any and all acts consistent
with the intent of this Resolution to effectuate the policies and procedures described herein.
SECTION 5.
This Resolution shall become effective immediately upon final passage and approval.

SUMMARY:
Attached is a Resolution directing the Mayor to appoint a hearings officer to hear objections
relating to lien assessment notices that will be mailed out on or about August 28, 2020, and setting
the date, time and place for the hearing as September 16, 2020 at 9:00 a.m. in City Council
Chambers.
PREVIOUS COUNCIL ACTION:
On September 14, 2015, Council approved Ordinance No. 8917, which provides for the
assessment of abatement costs. On October 13, 2015, Council approved Ordinance No. 8926,
which certified Assessment Roll No. 2015-1. On December 14, 2015, Council approved
Ordinance No. 8953, which certified Assessment Roll No. 2016-1. On September 26, 2017,
Council approved Ordinance No.’s 9043 and 9044, which certified Assessment Roll No.’s 2016-
2 and 2016-3, respectively. On October 23, 2017, Council approved Ordinance No. 9189 which
certified Assessment Roll No. 2017-1. On October 23, 2018, Council approved Ordinance No.
9355 which certified Assessment Roll No. 2018-1. On July 22, 2019, Council approved Ordinance
No. 9502 which amended the notice of hearing and protest deadlines by expanding each by five
days to create more time between the protest filing deadline and hearing date. On October 15,
2019 Council approved Ordinance No. 9570 which certified Assessment Roll No. 2019-1.
BACKGROUND:
Chapter 8 of Title VII of the Pueblo Municipal Code allows for anyone interested in a property for
which an abatement lien assessment will be certified to the County Treasurer to object to, or
protest the assessment. Pursuant to Section 7-8-4, City Council may direct the Mayor to appoint
a hearings officer to hear the objections and protests. The hearings officer will provide
recommendations for the resolution of any objections or protests to City Council for its review and
consideration. Thereafter, City Council may elect to certify any or all of the assessments to the
County Treasurer for collection.

ALTERNATIVES:
City Council may choose not to pass this Resolution.
RECOMMENDATION:
The Law Department recommends approval of this Resolution.
