Adams, MPO Manager SUBJECT: A RESOLUTION APPROVING AMENDMENT NO. 1 TO THE PROFESSIONAL SERVICES AGREEMENT BETWEEN WILSON & COMPANY, INC. AND THE CITY OF PUEBLO, A COLORADO MUNICIPAL CORPORATION IN THE AMOUNT OF $46,530 FOR PROFESSIONAL SERVICES ASSOCIATED WITH THE PUEBLO AREA COUNCIL OF GOVERNMENTS – LONG RANGE PLAN UPDATE SUMMARY: Attached is a Resolution for City Council consideration approving Amendment No. 1 to the Professional Services Agreement with Wilson & Company, Inc. concerning professional services associated with the Pueblo Area Council of Governments (PACOG) Long-Range Transportation Plan Update. PREVIOUS COUNCIL ACTION: City Council approved Resolution No. 14364, dated February 24, 2020, an agreement between Wilson & Company, Inc. and the City related to the PACOG Long-Range Transportation Plan Update. BACKGROUND: This Resolution will approve Amendment No. 1 to the Professional Services Agreement with Wilson & Company, Inc. concerning professional services associated with the PACOG Long- Range Transportation Plan Update Study to provide for an analysis identifying City of Pueblo Roadway Classification Design Standards and update as needed. The current standards were drafted and adopted in 2004. Since that time, the City’s vision with respect to economic development has evolved and matured. This Study will revisit roadway infrastructure standards and policies to bring both in better alignment with the City’s current path and goals. FINANCIAL IMPLICATIONS: The agreement amendment will be for an amount not to exceed $46,530 and will be paid from the Urban Transportation Planning Projects Budget, Project TP2040, work element 2045C and has no financial impact to the City. BOARD/COMMISSION RECOMMENDATION: None. STAKEHOLDER PROCESS: Staff from the City of Pueblo Urban Transportation Planning Division has reviewed the additional work items included in the Agreement Amendment with the PACOG Transportation Advisory Committee which includes Pueblo Transit and the CDOT representatives. ALTERNATIVES: Not Applicable. RECOMMENDATION: Approval of the Resolution. AND THE CITY OF PUEBLO, A COLORADO MUNICIPAL CORPORATION IN THE AMOUNT OF $46,530 FOR PROFESSIONAL SERVICES ASSOCIATED WITH THE PUEBLO AREA COUNCIL OF GOVERNMENTS – LONG RANGE PLAN UPDATE WHEREAS, Resolution No. 14364, dated January 24, 2020, approved an agreement between Wilson & Company, Inc. and the City related to the Pueblo Area Council of Governments (PACOG) –Long-Range Transportation Plan Update; and, WHEREAS, under the Fix Americas Surface Transportation Act (Fast Act), the Pueblo Area Council of Governments prepares and adopts a 25-year Long Range Transportation Plan for the Pueblo Area. Identifying Goals and infrastructure needs for all modes of transportation; and, WHEREAS, PACOG board members have expressed a desire to incorporate an evaluation of the City’s Roadway Functional Classification standards and policies as part of the consultant services; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. Amendment No. 1 to the Professional Services Agreement for the Pueblo Area Council of Governments –Long-Range Transportation Plan Update Plan between Wilson & Company, Inc. and the City of Pueblo, a Colorado Municipal Corporation, a copy of which is attached hereto, having been approved as to form by the City Attorney, is hereby approved. The cost for the professional services will be paid from the Urban Transportation Planning Projects Budget, Project TP 2040, Work Element 2045C. SECTION 2. The Mayor is hereby authorized to execute Amendment No. 1 of said Agreement on behalf of Pueblo, a Colorado Municipal Corporation, and the City Clerk shall affix the Seal of the City thereto and attest same. SECTION 3. The officers and staff of the City are authorized and directed to perform any and all acts consistent with the intent of the Resolution and the attached agreement to implement the transaction described therein. SECTION 4. This Resolution shall become effective immediately upon passage and approval. ("Engineer"). WHEREAS, Owner and Wilson & Company Inc. entered into that certain agreement for professional engineering services dated February 24, 2020 ("Agreement"); and WHEREAS, Owner and Engineer desire to modify the Agreement pursuant to the provisions set forth herein. NOW, THEREFORE, in consideration of the foregoing premises, the mutual promises set forth herein and other good and valuable consideration, the receipt and adequacy of which is hereby acknowledged, Owner and Engineer hereby agree to the following: AGREEMENT I. Scope of Services and Cost of Services. Engineer shall render certain professional services for Owner in connection with City Project No. 19-064 Long Range Transportation Plan Update,in accordance with Amendment I,dated August 10,2020 attached hereto and incorporated herein by this reference. 2. Successors and Assigns. This First Amendment shall be binding upon and inure to the benefit of the parties hereto and their respective successors and assigns. 3. Ratification. Except as expressly stated herein, the Agreement shall remain in full force and effect. If there is any conflict between the Agreement,the terms of this First Amendment shall control. 4. Counterparts. This First Amendment may be executed in one or more counterparts, each of which shall be deemed an original and all of which shall constitute one and the same document with the same effect as if all parties had signed the same original. The parties further agree that transmission of this First Amendment by any electronic format, telecopy or via email in a PDF format, shall be deemed transmission of the original First Amendment for all purposes. This study will revisit roadway infrastructure standards and policies to bring both in better alignment with the City's current path and goals with respect to new development. SCOPE OF WORK DESCRIPTION Task A-Project Management and Coordination Wilson & Company Project Manager, Maureen Araujo, FAICP, will be responsible for implementing project controls and management coordination protocols to direct project tasks and decisions in an orderly fashion, manage the budget and schedule, and to provide effective project coordination with the PACOG, stakeholders, and the project team. Project controls will include: Project Schedule Tracking: The Wilson & Company Project Manager has prepared a detailed project schedule and will review and the schedule on a biweekly basis and will track and update the schedule at one-month intervals, or more frequently as needed. Budget Tracking:The Wilson & Company Project Manager will track project budget on a biweekly basis utilizing a detailed work plan. The work plan will be utilized to provide the Project Manager monthly updates on the status of the consultant contract progress. Invoices and Progress Reports:The Wilson & Company Project Manager will prepare monthly invoices supported by status reports indicating tasks performed, and including budget and schedule status updates. Project Management Communication: To support continuous communication between the PACOG Project Manager and the Wilson & Company Project Team, The Wilson & Company Project Manager will schedule and participate in meetings or phone calls as needed, and in addition to biweekly coordination meeting, or will alternatively provide email status communications, to keep the PACOG Project Manager informed of project progress and all issues and concerns related to the project. Task B— Data Collection Overview The Wilson & Company team will assemble three types of data to support analysis and formulation of recommendations to update both roadway standards and policies. Current Pueblo standards and policies will be assembled as the baseline for analysis and development of revised standards and policies. Geospatial data will be assembles to support analysis of existing and planned land uses and the relationships between these development patterns and the roadway network and associated existing and forecast traffic flows. Task C— Review and Analysis The Wilson & Company team will develop an integrated geospatial analysis tool that will include layers for: current roadway network (with functional classification, number of lanes, posted speed limit and traffic flow attributes); platted parcels; existing land uses, zoning; master- planned development, and right-of-way reservations. The final geospatial database will be used to support layered map analysis and to identify right-sizing recommendations for roadway cross section standards in residential, commercial and other use areas. Based on analysis findings, recommendations for streamlined standards and polices will be developed. Two technical memoranda will be prepared to summarize the analysis and findings. The first will address recommendations for revised functional classifications and polices related to their implementation. The second will address associated revisions to construction specifications and standard details that may be needed to support new functional classification and design standards. Task D— Documentation and Deliverables Two final reports and a geospatial mapping deliverable (Esri shapefile set, Google Earth KMZ map or geo-located PDF map)will comprise the final deliverables. The first report is the replacement/revised version of Pueblo's Roadway Classification Design Standards and Policies (2004). The second report will summarize applicable revisions to Standard Construction Specifications and Details for City of Pueblo, Colorado(revised March 28, 2005).
