AN ORDINANCE ESTABLISHING AN APPROVED LIST OF
CONTRACTORS TO PERFORM EMERGENCY STORM
SEWER POINT REPAIRS DURING CALENDAR YEARS
2020 THROUGH 2022 AND AUTHORIZING THE
PURCHASING AGENT TO EXECUTE THE SAME
WHEREAS, proposals for performing storm sewer point repairs under Project No.
20-019 have been received and examined, and;
WHEREAS, the proposals from Pate Construction Co., Inc., Russ Grading and
Excavating Inc., K.R. Swerdfeger Construction, Inc., and Parker Excavating, Inc.,
(collectively the “Approved List”) have been determined to be responsive; NOW,
THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
Council hereby authorizes, subject to an unexpended balance of appropriations
therefore, that upon approval of the Mayor, contracts for effecting emergency storm sewer
point repairs may be awarded from time to time, to the lowest bidder on the Approved
List, as determined by unit prices for elements of construction submitted by responsive
bidders under Project No. 20-019, based on the requirements and unit quantities of each
repair project as may arise, and that the same be awarded to said bidder in the required
amount at the time of each project.
SECTION 2.
Funds for Project 20-019 (SW1501) shall be from the “Stomwater Point Repairs
and Pipe Cleaning” capital project budget funded by the Stormwater Utility Enterprise.
SECTION 3.
Upon approval of the Mayor, the Purchasing Agent is hereby authorized to execute
said contract on behalf of Pueblo, a Municipal Corporation, and the City Clerk shall affix
the seal of the City thereto and attest the same. Any such contract shall be submitted to
the City Council for ratification and approval.
SECTION 4.
The officers and staff of the City are directed and authorized to perform any and
all acts consistent with the intent of this Ordinance and the contract to effectuate the
transactions described therein.
SECTION 5.
This Ordinance shall become effective on the date of final action by the Mayor and
City Council.

SUMMARY:
This Ordinance will establish an approved list of contractors to perform emergency storm
sewer point repairs during calendar years 2020 through 2022. Since the established list
will be utilized upon approval of the Mayor, this Ordinance has been modified to reflect
such.

BACKGROUND:
The City of Pueblo owns and operates a storm sewer system for the purpose of conveying
stormwater to outfall to rivers and creeks. Portions of the storm sewer system are more
than 100 years old and were constructed using clay tile, corrugated metal, and brick.
From time to time, the City discovers broken pipes or obstructions in pipes that cannot be
cleared. In such emergency cases, point repairs must be made in an expeditious manner
by excavating and replacing the damaged storm sewer pipes.
Storm sewer problems requiring point repairs are most often discovered when residents
report problems such as sinkholes and storm sewer backups. It is often not possible to
anticipate when and where point repairs will be needed. Between the time that the
problem occurs and the time it is repaired, the public and nearby properties may be at
risk of health and safety issues, along with property damage due to flooding. It is in the
best interest of the community that storm sewer point repairs be completed as rapidly as
possible after discovery.
The City of Pueblo normally requires competitive bids for construction projects in order to
assure that costs are controlled. The City also has provisions that allow the Mayor to
approve emergency construction projects without bidding and without prior City Council
approval. This Resolution, authorizing contracts from 2020 through 2022 Storm Sewer
Point Repair will provide both competitive bid cost controls and rapid response capability
by establishing a list of qualified contractors who have provided a list of unit prices.
The Purchasing Department solicited unit cost competitive bids from contractors for
various elements of storm sewer point repair, including per-linear-foot pipe replacement
costs for differing pipe sizes and depths, unit costs for manholes, unit costs for curb-and-
gutter repair, and mobilization costs. Four bids were received. A bid summary sheet is
attached. The four responsive bidders form a list of qualified contractors to whom point
repair projects can be offered.
When a point repair project arises, Stormwater Department staff will evaluate the repairs
needed, determine the unit quantities for the work required and determine which of the
qualified vendors would be able to complete the repairs at the lowest cost by using the
unit prices provided by each vendor in their bid. The point repair will then be offered to
the vendor providing the lowest cost. The vendor will be required to sign a standard City
construction contract for each project. The project will then proceed immediately without
further Council action until after the project is complete.
FINANCIAL IMPLICATIONS:
Funding for this project will come from the “Stormwater Point Repairs and Pipe Cleaning”
capital project budget funded by the Stormwater Utility. Funding is available and has
been budgeted, appropriated, and allocated to Project No. 20-019 (SW1501).

ALTERNATIVES:
Alternative No. 1 – No Action
Under this alternative, the City would not create an approved list of contractors to make
repairs to the existing storm sewer system if and when emergencies occur. The risk of
flooding due to storm sewer overflows and backups increases which potentially causes
property damage and public safety issues.
Alternative No. 2 – Place Mains on the Rehabilitation List
Under this alternative, the City would make no immediate improvements and would not
create an approved list of contractors for emergency repairs. Any emergency problem
areas would be placed on a rehabilitation list and prioritized by the level of importance. This
alternative would significantly increase the time it takes to repair the damaged system and
there would still be a risk of property damage and public safety issues due to flooding until
the system is repaired.
RECOMMENDATION:
Approval of the Ordinance.
