HomeMy WebLinkAbout09745As Amended July 27, 2020 ORDINANCE NO. 9745 AN ORDINANCE ESTABLISHING PROJECTS HU2001 AND SR2003 - STREET REHABILITION PROJECT-FORTINO, OUTLOOK, GREENWOOD AND EAGLERIDGE, BUDGETING AND APPROPRIATING FOUR MILLION, TWO HUNDRED TWENTY THOUSAND, SEVEN HUNDRED SIXTY-FIVE DOLLARS ($4,220,765) TO PROJECT HU2001 FROM THE HUTF FUND AND TWO MILLION, FOUR HUNDRED EIGHTY-TWO THOUSAND, FOUR HUNDRED FIFTY-FOUR DOLLARS AND TWENTY-NINE CENTS ($2,482,454.29) TO PROJECT SR2003 FROM THE STREET REPAIR UTILITY FUND, FOR A TOTAL AMOUNT OF SIX MILLION, SEVEN HUNDRED THREE THOUSAND, TWO HUNDRED NINETEEN DOLLARS AND TWENTY-NINE CENTS ($6,703,219.29) FOR STREET REPAIRS PROJECTS BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. Projects SR2003 and HU2001 are hereby established. SECTION 2. Funds in the amount of Two Million, Four Hundred Eighty-Two Thousand, Four Hundred Fifty-Four Dollars and Twenty-Nine Cents ($2,484,454.29) are budgeted and appropriated from the Street Repair Utility Enterprise Fund to Project Number SR2003- Street Rehabilitation Project- Fortino, Outlook, Greenwood and Eagleridge. SECTION 3. Funds in the amount of Four Million, Two Hundred Twenty Thousand, Seven Hundred Sixty- Five Dollars ($4,220,765 are budgeted and appropriated from the HUTF Fund to Project Number HU2001 - Street Rehabilitation Project – Fortino, Outlook, Greenwood and Eagleridge. SECTION 4. The City of Pueblo’s Director of Finance is hereby instructed to segregate and keep separate the monies retained in the Street Repair Utility Enterprise Fund and the monies retained in the HUTF fund and not comingle said funds for any purpose, as required by XII and Chapter 11 of the Pueblo Municipal Code and Section 20 of Article X of the Colorado Constitution. SECTION 5. This Ordinance is adopted for the administrative convenience and is not intended as, nor shall this Ordinance be construed as, a transfer of the City of Pueblo’s tax revenues to the City’s Street Repair Utility Enterprise. SECTION .6 The officers and staff of the City are authorized and directed to perform any and all acts consistent with this Ordinance to implement the policies and procedures described herein. SECTION 7. This Ordinance shall become effective on the date of final action by the Mayor and City Council. The amount of transfer totals $6,703,219.29 and is intended to repair Pueblo arterial roadways in 2020 as part of the City of Pueblo’s annual road maintenance program. PREVIOUS COUNCIL ACTION: Not applicable to this Ordinance. BACKGROUND: The City’s Arterial Roadway System has been evaluated, pavement construction indexes have been determined and the planned rehabilitation of these roadways has been prioritized based on road conditions, available budget and prior year repair commitments. This project is the first of the roadways to be rehabilitated as identified in the Pueblo Arterial Roadway Pavement Management Plan. FINANCIAL IMPLICATIONS: Funds in the amount of $4,220,765 are being transferred from the HUTF Fund to Project HU2001 and $2,482,454.29 are being transferred from the Street Repair Utility Fund to Project Number SR2003. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Ordinance. STAKEHOLDER PROCESS: Not applicable to this Ordinance. ALTERNATIVES: If City Council does not approve this Ordinance, there will be no funding in the Project Number SR2003 and HU2001 accounts to pay for the rehabilitation of Pueblo arterial roadways in 2020.
