A RESOLUTION RATIFYING AN EMERGENCY CONSTRUCTION
CONTRACT IN THE AMOUNT OF $ 14,889.04 WITH K.R.
SWERDFEGER CONSTRUCTION, INC. FOR PROJECT NO. 18-
098 (WWAN03) AND APPROVING THE PURCHASING AGENT’S
EXECUTION OF THE SAME
WHEREAS, an emergency sanitary sewer repair was authorized by the Pueblo City Mayor
in accordance with Section 1-10-5 of the Pueblo Municipal Code; and
WHEREAS, the point repair work was awarded to K.R. Swerdfeger Construction, Inc.,
under the 2019-2020 multi-year point repair contract; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
City Council ratifies and approves the contract for repair of the sanitary sewer in the prairie
near 2596 E. State Hwy 96 with K.R. Swerdfeger Construction, Inc., Project No. 18-098
(WWAN03) awarded to said bidder in the amount of $14,889.04.
SECTION 2.
Funds for Project 18-098 (WWAN03) shall be from the Sewer User Fund.
SECTION 3.
The Purchasing Agent was authorized to execute said contract on behalf of Pueblo, A
Municipal Corporation, and the City Clerk properly affixed the seal of the City thereto and attested
the same.
SECTION 4.
The officers and staff of the City are directed and authorized to perform any and all acts
consistent with the intent of this Resolution and the contract to effectuate the transactions
described therein. Furthermore, all actions previously taken by officers and staff of the City
consistent with the contract including any payments authorized under the contract are hereby
ratified.
SECTION 5.
This Resolution shall become effective immediately upon passage and approval.

SUMMARY:
This Resolution ratifies and approves award of a construction contract to K.R. Swerdfeger
Construction, Inc. for emergency sanitary sewer point repair in the prairie near 2596 E. State Hwy
96.
PREVIOUS COUNCIL ACTION:
None
BACKGROUND:
On February 8, 2020, the Wastewater Department discovered there was a leak in the 8-inch
forced main in the prairie near 2596 E. State Hwy 96, about 500 feet North of said address.
The repair work was performed under the Sanitary Sewer Point Repair multi-year contract under
which three contractors were qualified via competitive bid. Due to the minimal linear footage of
C900, an uncommon pipe material used only for forced mains, in the collection system, 8-inch
C900 pipe is not a bid item on the emergency repair contract. The 8-inch SDR 35 bid item was
used to determine the contractor. K.R. Swerdfeger was low bidder and accepted the job.
The cost breakdown for the project is as follows:

Grand Total: $ 14,889.04 100%
FINANCIAL IMPLICATIONS:
Funding for this project came from the sanitary sewer rehabilitation budget funded by the Sewer
User Fund. Funding was available and had been budgeted, appropriated and allocated to Project
No. 18-098 (WWAN03).

Not applicable

ALTERNATIVES:
Not approve the Resolution, but this would require a finding that there was not an emergency
condition.
RECOMMENDATION:
Approval of the Resolution.
