HomeMy WebLinkAbout14387RESOLUTION NO. 14387 A RESOLUTION EXTENDING THE DECLARATION OF A LOCAL DISASTER MADE BY THE MAYOR REGARDING THE COVID-19 PANDEMIC WHEREAS, the occurrence or imminent threat of widespread or severe damage, injury or loss of life or property resulting from COVID-19 pandemic requires emergency action and resources to avert danger or damage and to protect public health; and, WHEREAS, the home rule Charter of the City Pueblo and the Colorado Disaster Emergency Act, C.R.S. §24-33.5-701, et seq., grant authority to the principal executive officer, Mayor Nicholas A. Gradisar, to declare a local disaster; and, WHEREAS, on March 13, 2020, Mayor Gradisar entered an executive order declaring a local disaster as a result of the COVID-19 pandemic (hereinafter "Declaration") (copy attached); and, WHEREAS, pursuant to state law, C.R.S. §24-33.5-709(1), the effect of the period of local disaster cannot exceed seven days except by or with the approval of City Council; and, WHEREAS, it would be appropriate and in the interests of the public health and safety, and would further protect property, for the City Council to take immediate action for public safety, health and welfare, by indefinitely extending the effective date of the March 13, 2020 Mayoral Declaration until the danger posed by the coronavirus causing COVID-19 disease has been abated; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Local Disaster Emergency Declaration issued by Mayor Nicholas A. Gradisar on March 13, 2020, shall be and is hereby extended and shall remain in effect until terminated by the Mayor or by City Council in accordance with state and local laws. SECTION 2. The officers and staff of the City are authorized and directed to perform any and all acts consistent with this Resolution to effectuate the policies and procedures described herein. SECTION 3. This Resolution shall become effective immediately upon final passage, nunc pro tunc March 20, 2020. Gradisar SUBJECT: A RESOLUTION EXTENDING THE DECLARATION OF A LOCAL DISASTER MADE BY THE MAYOR REGARDING THE COVID-19 PANDEMIC SUMMARY: The attached proposed Resolution extends the March 13, 2020 declaration by Mayor Gradisar of a local disaster as a result of the COVID-19 pandemic. PREVIOUS COUNCIL ACTION: None. BACKGROUND: The Home Rule Charter of the City of Pueblo and the Colorado Disaster Emergency Act, C.R.S. 24-33.5-701, et seq., grant authority to the principal executive officer of a city to declare a local disaster. FINANCIAL IMPLICATIONS: Unknown at this time. The Declaration and continuation of a local disaster emergency may help to reduce the City’s costs of responding to the COVID-19 pandemic. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Resolution. STAKEHOLDER PROCESS: Not applicable to this Resolution. ALTERNATIVES: The City Council could decide not to extend the Mayoral Declaration of a local disaster emergency and allow the Declaration to expire. RECOMMENDATION: Approval of the Resolution.
