HomeMy WebLinkAbout14384RESOLUTION NO. 14384 A RESOLUTION APPROVING AND ADOPTING THE COVID-19 ELECTRONIC PARTICIPATION POLICY BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The COVID-19 Electronic Participation Policy, a true and correct copy of which is attached hereto, labelled Exhibit A and incorporated herein, is hereby approved and adopted. SECTION 2. The officers of the City are authorized and directed to perform any and all acts consistent with the intent of this Resolution to effectuate the policies and procedures described herein. SECTION 3. This Resolution shall become effective immediately upon final passage. Kogovsek, City Attorney SUBJECT: A RESOLUTION APPROVING AND ADOPTING THE COVID-19 ELECTRONIC PARTICIPATION POLICY SUMMARY: The proposed Resolution approves a policy which would permit members of City Council and other boards and commissions of the City to participate electronically during any period of a declared emergency under state or local law based upon an outbreak of the Coronavirus Disease 2019 (“COVID-19”) within the State of Colorado. PREVIOUS COUNCIL ACTION: None. BACKGROUND: Due to the recent outbreak of COVID-19, circumstances may arise where members of City Council and other boards and commissions of the City may be unable or prohibited from being physically present during a meeting. The proposed resolution authorizes electronic participation to address such issue. FINANCIAL IMPLICATIONS: There will be limited costs associated with accommodating such participation. BOARD/COMMISSION RECOMMENDATION: Not applicable. STAKEHOLDER PROCESS: Not applicable. ALTERNATIVES: The City Council could decide not to authorize such participation. In such case, there would be no express authority permitting such participation, and this could impair or impede the City’s ability to conduct business. RECOMMENDATION: Pass and approve the proposed Resolution and the COVID-19 Electronic Participation Policy. Attachments: COVID-19 Electronic Participation Policy EXHIBIT A COVID-19 ELECTRONIC PARTICIPATION POLICY (a) Definitions. As used herein, the terms "administrative body" and "interested party" shall have the same meaning as those terms are defined under Section 1-7-2, P.M.C, of CHAPTER 7 - Rules for Administrative and Quasi-Judicial Hearings. (b) Electronic Participation. During any period of a declared emergency under state or local law based upon an outbreak of the Coronavirus Disease 2019 ("COVID-19") within the State of Colorado, any member of City Council or other administrative body may appear, be deemed present and participate by telephone or other electronic means. Suitable arrangements shall be provided to accommodate such participation. Any such member shall endeavor to advise the City of their intent to participate by telephone or other electronic means at the earliest possible time and not less than twenty-four(24) hours prior to the requested participation absent an emergency. (c) Quasi-Judicial Hearings. Any person may orally state or file an objection with respect to the application of this Policy to a quasi-judicial hearing in which they are an interested party. Such objection must specifically identify the manner in which the interested party will be prejudiced by the application of this Policy to such hearing. Any objection timely stated or filed shall be presented to the President of City Council or, as applicable, the presiding officer of the administrative body for ruling. Any objection not timely stated or filed shall be deemed waived and not preserved for further review.
