AN ORDINANCE ESTABLISHING PROJECT PL2003 FOR
NORTHERN AVENUE STREETSCAPE / TRAIL PHASE III
PROJECT, APPROVING AN INTERGOVERNMENTAL
AGREEMENT, TAP M086-082 (22971) BETWEEN PUEBLO, A
COLORADO MUNICIPAL CORPORATION AND THE STATE
OF COLORADO, THE COLORADO DEPARTMENT OF
TRANSPORTATION, TRANSFERRING $125,000 FROM
PROJECT HU1601 TO PROJECT PL2003, BUDGETING AND
APPROPRIATING FUNDS IN THE AMOUNT OF $625,000 AND
AUTHORIZING THE MAYOR TO EXECUTE SAME
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Northern Avenue Streetscape / Trail Phase III Project, PL2003, is hereby
established.
SECTION 2.
The Intergovernmental Agreement (“IGA”) between Pueblo, a Colorado Municipal
Corporation, and State of Colorado for the use and benefit of the Transportation Alternative
Program, Department of Transportation for TAP M086-082 (22971), a copy of which is
attached, having been approved as to form by the City Attorney, is hereby approved.
SECTION 3.
Subject to encumbrances by the Colorado State Department of Transportation, funds
from TAP M086-082 (22971) in the amount of $500,000 are hereby budgeted and
appropriated for the Northern Avenue Streetscape / Trail Phase III Project, No. PL2003.
SECTION 4.
Funds in the amount of $125,000 are hereby transferred from the Traffic Signal
Northern & Prairie Project, HU1601 to the Northern Avenue Streetscape / Trail Phase III
Project, PL2003 and budgeted and appropriated.
SECTION 5.
The Mayor is authorized to execute and deliver the IGA in the name of the City and the
City Clerk is directed to affix the seal of the City thereto and attest same.
SECTION 6.
The officers and staff of the City are authorized and directed to perform any and all
acts consistent with the intent of the Ordinance and IGA to implement the policies and
procedures described therein.
SECTION 7.
This Ordinance shall become effective on the date of final action by the Mayor and
City Council.

SUMMARY:
This Ordinance creates Planning Project No. PL2003 for Northern Avenue Streetscape /
Trail Phase III Project, approves an Intergovernmental Agreement (“IGA”) between
Pueblo, a Colorado Municipal Corporation (“City”) and the State of Colorado, Colorado
Department of Transportation (“CDOT”) relating to the Northern Avenue Streetscape /
Trail Phase III Project, transfers funds in the amount of $125,000 from Project HU1601 to
PL2003 and budgets and appropriates funds totaling $625,000 for the Northern Avenue
Streetscape / Trail Phase III Project.
PREVIOUS COUNCIL ACTION:
Ordinance 9600 dated November 25, 2019 transferred funds in the amount of $125,000
from the 2019 Highway User Tax Fund (“HUTF”) balance to Project HU1601 and
budgeted and appropriated $125,000 for the Traffic Signal Northern and Prairie Project.
BACKGROUND:
This Ordinance establishes the Northern Avenue Streetscape/Trail Phase III Project,
PL2003. Funds in the amount of $125,000 from the existing Traffic Signal Northern &
Prairie Project HU1601 are being transferred, budgeted, and appropriated into the new
Project, PL2003, along with the $500,000 in funds from the CDOT Transportation
Alternatives (“TAP”) grant award. The signal replacement will be a part of the new project
in addition to the trail construction along Northern and Prairie Avenues. The $125,000
signal replacement funds are being used as the eligible local matching funds for the TAP
grant. The Ordinance also approves the grant agreement between the City and CDOT
(TAP M086-082) for the $500,000 in Transportation Alternative Funds. The overall
$625,000 project will continue the trail/shared use path along the north side of Northern
Avenue between Cambridge Avenue and Prairie Avenue and upgrade the signal at
Northern and Prairie Avenue. Over the last eight years the City has redeveloped the trail
system and constructed the landscaped center medians along Northern Avenue between
Pueblo Boulevard (State Highway 45) east to Cambridge Avenue.
FINANCIAL IMPLICATIONS:
The matching funds in the amount of $125,000 are being transferred from Project HU1601
to Project PL2003. Funds in the amount of $625,000 shall be budgeted and appropriated
for the Project, PL2003.

None.

None.
ALTERNATIVES:
Currently, there are no alternatives for completing the improvements without the funding
from the State of Colorado CDOT TAP grant.
RECOMMENDATION:
Approve the Ordinance.
