COMMERCIAL CHARTER NEIGHBORHOOD
SUMMARY:
The applicant is requesting to rezone the subject property from R-2, Single Family
Residential to CCN, Commercial Charter Neighborhood.
PREVIOUS COUNCIL ACTION:
None.
BACKGROUND:

Abeyta Investments purchased the property at 1201 East 7 Street in 2018 and proposes
to reinstitute the religious institution use and introduce banquet hall and office uses. The
religious institution use is a Use by Right and the banquet hall and church uses require a
Use by Review in the CCN Zone District. Mr. Abeyta received approval of a Special Use
Permit for the banquet hall and religious institution uses from the Zoning Board of Appeals
on June 25, 2019, contingent upon the approval of the CCN rezoning request.
FINANCIAL IMPLICATIONS:
There are no financial implications for the City.
BOARD/COMMISSION RECOMMENDATION:
The Planning and Zoning Commission, at their July 10, 2019 Regular Meeting, voted 5-0
(Schilling absent and one vacancy) to recommend approval.
STAKEHOLDER PROCESS:
The Planning Department sent out Notice of the Planning and Zoning Commission Public
Hearing to all property owners located within 300 feet of the subject property.
A Public Notice poster was placed on the subject property 15 days prior to the Public
Hearing.
ALTERNATIVES:
If City Council does not approve this Ordinance, the current zoning would remain.
Upon request of City Council, the Ordinance could be returned to the Planning and Zoning
Commission for consideration of proposed modifications.
RECOMMENDATION:
Approval of the Ordinance.

BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The zoning restrictions covering the following described property and generally
identified in the attached Rezone Exhibit, is hereby changed from R-2, Single Family
Residential to CCN, Commercial Charter Neighborhood:
LOTS 28 THRU 32 BLOCK 120 FLETCHER HILL ADDITION
SECTION 2.
The officers and staff of the City are authorized and directed to perform any and
all acts consistent with the intent of the Ordinance to implement the policies and
procedures described herein.
SECTION 3.
This Ordinance shall become effective immediately upon final action by the Mayor
and City Council.
